Location 1: 5'x10' Brick Red Concrete Slab to be poured at Westminster. Moon and Sun Stencil to be applied and black traffic paint to be used to fill sandblasted areas. Drawing design files to be provided by client. Location 2: 112" x 56" Brick Red Concrete Slab to be poured at Westminster. Trow Triangle to be added to represent sidewalks in Santa Ana. Poem to be selected and to be applied to slab. Half of the text to be filled with black paint and the rest to be left as is. Font and poem to be selected at later date and approved by client. $5,000 deposit needed to begin production at the Westminster location. Not Included/Excluded: Permits. Off hours work. Full containment. Plant cleaning. Protection. Traffic control. Any locations outside of the provided address above. Anything not clearly listed in the above "Scope of Work" is not included in this proposal. Special Conditions a Alternates: No other trades should be working within 25' from sandblasting. Estimated time - 1 day for cocrete and 1 day for stencil application and painting. Lead time for stencil production - 1-2 weeks. File for stencil should be provided as a dwg or CAD file. Cleanup will be done only off hardscape. No people should be present within 20' from sandblasting. Plan with updated markers locations should be provided 2 days prior to mobilization. Note: All work is guaranteed as specified above and will be performed as per instructions of contractor. MINIMUM SCOPE AND LIMIT OF INSURANCE Coverage shall be at least as broad as: • Commercial General Liability (CGL): Insurance Services Office Form CG 00 01 covering CGL on an "occurrence" basis, including property damage, bodily injury and personal & advertising injury with limits no less than $1,000,000 per occurrence. If a general aggregate limit applies, eitherthe general aggregate limit shall apply separately to this project/location (ISO CG 25 03 or 25 04) or the general aggregate limit shall betwice the required occurrence limit. • Automobile Liability: ISO Form Number CA 00 01 covering any auto (Code 1), or if Recipient has no owned autos, hired, (Code 8) and non -owned autos (Code 9), with limit no less than $1,000,000 per accident for bodily injury and property damage. • Workers' Compensation insurance as required by the State of California, with Statutory Limits, and Employer's Liability Insurance with limit of no less than $1,000,000 per accident for bodily injury or disease. If the Recipient maintains broader coverage and/or higher limits than the minimums shown above, the Entity requires and shall be entitled to the broader coverage and/or the higher limits maintained by the Recipient. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the Entity. Self -Insured Retentions Self -insured retentions must be declared to and approved by the Entity. The Entity may require the Recipient to provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention. The policy language shall provide, or be endorsed to provide, that the self -insured retention may be satisfied by either the named insured or Entity. Other Insurance Provisions The general liability policy is to contain, or be endorsed to contain, the following provisions: 1 1. The Entity, its officers, officials, employees, agents, and volunteers are to be covered as additional insureds with respect to liability arising out of work or operations performed by or on behalf of the Contractor including materials, parts or equipment furnished in connection with such work or operations. 2. For any claims related to this contract, the Recipient's insurance coverage shall be primary insurance coverage at least as broad as ISO CG 20 0104 13 as respects the Entity, its officers, officials, employees, agents, and volunteers. 3. The Insurance Company agrees to waive all rights of subrogation against the Entity, its elected or appointed officers, officials, agents, and employees for losses paid under the terms of any policy which arise from work performed by the Recipient for the Entity. This provision also applies to the Recipient's Workers' Compensation policy. 4. Each insurance policy required above shall provide that coverage shall not be canceled,except with notice to the Entity. Acceptability of Insurers Insurance is to be placed with insurers authorized to conduct business in the state with a current A.M. Best's rating of no less than A: VII, unless otherwise acceptable to the Entity. Verification of Coverage Recipient shall furnish the Entity with original Certificates of Insurance including all required amendatory endorsements (or copies of the applicable policy language effecting coverage required by this clause) and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to Entity before work begins. The Entity reserves the right to require complete, certified copies of all required insurance policies, including endorsements affecting the coverage required by these specifications, at any time. Special Events Coverage for Contractors Special events coverage is available for an additional fee to provide the liability insurance required by this agreement. Recipient can obtain additional information and cost from the Entity. Subcontractors Recipient shall require and verify that all subcontractors maintain insurance meeting all the requirements stated herein, and Recipient shall ensure that Entity is an additional insured on insurance required from subcontractors. Special or Low Risk Activities Entity reserves the right to modify these requirements, including limits, based on the nature ofthe risk, prior experience, insurer, coverage, or other special circumstances. The Entity reserves the right to modify or waive insurance requirements for certain low risk recreational activities. FA INDEMNIFICATION To the fullest extent allowed by law, CONTRACTOR and its Subcontractors hereby agree to defend, indemnify, and hold harmless CITY, its City Council, boards and commissions, officers, agents, employees, representatives and volunteers (hereinafter collectively referred to as " Indemnitees"), through legal counsel acceptable to CITY, from and against any liability, claims, actions, costs, damages or losses, including reasonable costs and attorney' s fees, for injury, including death to any person or damage to any property, arising directly or indirectly from, or in any manner relating to, any of the following: i) Performance or nonperformance of the Work of Improvement by CONTRACTOR or its Subcontractors of any lower tier; ii) Performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of any of the obligations under the Contract Documents; iii) The construction activities of CONTRACTOR or its Subcontractors of any lower tier, either on the project site or on other properties; iv) The payment or nonpayment by CONTRACTOR of any of its Subcontractors of any lower tier, for Work of Improvement performed on or off the project site; and v) Any personal injury, property damage or economic loss to third persons related to and arising from the performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of the Work of Improvement. vi) The indemnity obligations of Subcontractors provided by this Section shall be included in all subcontract documents issued by CONTRACTOR. Nothing in the Contract Documents shall be construed to give rise to any implied right of indemnity in favor of CONTRACTOR against CITY or any other Indemnitee.
