HomeMy WebLinkAbout2023-062 - Authorizing the Application to State Water Resource Control Board for Financial Assistance for the Wells 27 and 28 PFAS Treatment System ProjectRESOLUTION NO. 2023-062 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING AN APPLICATION TO THE STATE WATER RESOURCES CONTROL BOARD FOR FINANCIAL ASSISTANCE FOR THE WELLS 27 AND 28 PFAS TREATMENT SYSTEM PROJECT WHEREAS, the California State Water Research Control Board Drinking Water State Revolving Fund provides financial assistance to reduce people's exposure to per - and polyfluoroalkyl substances ("PFAS") and other emerging contaminants through their drinking water; and WHEREAS, due to the presence of PFAS found in routine well monitoring, several wells in the Orange County Water Basin have been taken offline, including the City's Well 27 and Well 28; and WHEREAS, on May 19, 2020, City Council approved the PFAS Treatment Facilities and Program Agreement ("PFAS Agreement") with the Orange County Water District ("OCWD") to provide the funding, design, construction, and operation assistance for PFAS treatment facilities for qualifying City of Santa Ana groundwater wells; and WHEREAS, per the terms of the PFAS Agreement, the City shall support and assist OCWD to obtain any grants that may be used by OCWD to fund construction and/or future operations and maintenance costs of PFAS treatment systems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: Section 1. The Executive Director of the Public Works Agency (the "Authorized Representative") or designee is hereby authorized and directed to sign and file, for and on behalf of the City, a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for the planning, design, and construction of the City of Santa Ana Wells 27 and 28 PFAS Treatment System Project. Section 2. The Authorized Representative, or his/her designee, is designated to provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes thereto. Section 3. The Authorized Representative, or his/her designee, is designated to represent the City in carrying out the City's responsibilities under the financing agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws. This Resolution shall take effect immediately upon its adoption by the Coty Council, and the Clerk of the Council shall attest to and certify the cote adopting this Resolution.
