The City of Santa Ana is the Lead Agency on the IS/MND. Psomas is a full -service environmental, engineering, construction management, and land survey firm. Psomas' Environmental and Resource Management Group provides California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) documentation; biological resources surveys and assessments; regulatory services and permitting; habitat restoration planning; cultural resources assessments and monitoring; air quality, greenhouse gas emissions, and noise analyses; and Geographic Information Systems (GIS) mapping and spatial analyses. Psomas proposes a Project team with CEQA expertise on in -fill re -development commercial projects with relevant experience in the California Environmental Quality Act (CEQA) to assist the City and the Project team with preparation of an IS/MND. 1, Alia Hokuki, AICP, am a Senior Project Manager with over 27 years of experience in preparing environmental documentation pursuant to CEQA for a variety of project types, including nonresidential in -fill projects, including commercial, retail, institutional (education and healthcare), and infrastructure projects. In addition, I will operate as the main point of contact to the City and Project team and be the day-to-day Project Manager with the responsibility of ensuring work is completed on schedule and within budget. I will be supported by a team of highly qualified and experienced in-house staff, and all technical analyses included in this SOW will be conducted by Psomas' technical staff. The site is currently developed with the two single-family residences with detached garages and associated improvements. The eastern and western residences are approximately 3,000 sf and 1,800 sf in size, respectively. The proposed Project will be developed as a 3,975-sf McDonald's fast-food restaurant with a drive - through lane and associated parking and landscaping. To accommodate development of the proposed Project, the two existing single-family residential units with detaches garages will be demolished. Local access is from East Santa Clara Avenue and North Tustin Avenue, and regional access is provided by State Route 55 (SR-55). The Project site is in a built -out and urbanized portion of the City of Santa Ana and is surrounded by residential development to the south across from East Santa Clara Avenue and commercial/retail to the east, north, and west. The Project site has a General Plan Land Use designation of General Commercial (GC) and Zoning designation of General Agricultural (At). A Zone Change is required to designate the site as Arterial Commercial (C5). Also, a Conditional Use Permit is required to allow the operation of the proposed drive -through lane. ENVIRONMENTAL ANALYSIS APPROACH Based on the Request for Proposal (RFP), the City has determined that an Initial Study/Mitigated Negative Declaration is required for the proposed re -development of the site. We concur that an IS/MND prepared in accordance with CEQA (California Public Resources Code, Sections 21000 et seq.) and the State CEQA Guidelines (California Code of Regulations, Title 14, Section 15000 et seq.), would be the appropriate CEQA document for the proposed Project. Additionally, Psomas will take into account the City's requirements and specifications and will use the CEQA Appendix G Environmental Checklist Form (2020 CEQA Guidelines) to prepare the IS/MND. SCOPE OF ENVIRONMENTAL SERVICES Below is the SOW for the proposed McDonald's at Santa Clara Avenue Project IS/MND based on our understanding of the Project and the information received from the City. This SOW includes the following tasks: • Task 1 Project Initiation • Task 2 Technical Analyses/Studies Task 3 Initial Study/Mitigated Negative Declaration • Task 4 Project Management, Meetings, and Public Hearings awrov QsltyowamaMaWcmnaia ISMNO-WOMAox A-t Cost Estimate Mc Donald's at Santa Clara Avenue Project TASK 1 PROJECT INITIATION Subtask 1.1 Kick -Off Meetin Psomas will attend a virtual or in -person kick-off meeting with the City, the Applicant, and the Project team, as appropriate. This meeting will provide an opportunity to discuss the approach to preparing the environmental document; further define the SOW; identify and discuss the key community issues and concerns, as applicable; and identify information needs. The Project schedule will be discussed, and key milestones defined. It is assumed that available Project information, including an updated site plan, as applicable, would be provided at this meeting. It is also assumed that the technical studies prepared by the Applicant (i.e., a Water Quality Management Plan [WQMP]; Hydrology and Hydraulics Report; Geotechnical Report; and Traffic Analysis) will be provided to Psomas for incorporation into the IS/MND, at this meeting. Psomas also assumes that considering the demolition of the existing residential units on the site, the Applicant will prepare a Phase I Environmental Site Assessment (ESA). If requested, Psomas will prepare and electronically submit the meeting minutes from the kick-off meeting to the City for review and comment. Upon receipt of comments, the meeting minutes will be revised and distributed. Subtask 1.1 Deliverables • Electronic Copies (email) of Draft and Final Meeting Minutes (if requested) Subtask 1.2 Data Collection and Site Visit Psomas will prepare a Data Needs Request to obtain data related to Project construction activities and operations that will be needed for the technical analyses contained in the IS/MND. Work can typically proceed on tasks that are not dependent on forthcoming information. Psomas will review existing City documents, including but not limited to the Santa Ana General Plan (2022); the General Plan Final Recirculated Draft EIR (2021) (General Plan EIR); the Zoning Ordinance; and otherpertinent documents. Additionally, Psomas will conduct a site visit to assist in the description of the environmental setting and to photographically document the site and surrounding area. Subtask 1.2 Deliverables Electronic Copy (email) of Data Needs Request Subtask 1.3 Proiect Description Upon receipt of Project information, Psomas will draft a Project description appropriate for an IS/MND. The Project description will ineludedetails related to short-term construction activities and long-term land uses and operations of the Project. The draft Project Description will be submitted electronically to the City for review and comment. Once approved by the City, the Project description will be distributed to the Project team to initiate technical analyses. Subtask 1.3 Deliverables Electronic Copy (email) of the Draft and Final Project Description a.wro osais�]] orsama MalMmD nM .ISMND-asoi2z.mox A-2 Cost Estimate McDonald's at Santa Clara Avenue Project TASK 2 TECHNICAL ANALYSES/STUDIES Subtask 2.1 Peer Review of Existine Technical Studies We understand thatthe Applicant will prepare and provide to Psomas a Water Quality Management Plan (WQMP); Hydrology and Hydraulics Report; Geotechnical Report; and Traffic Analysis. Upon receipt of the studies, Psomas' Project Manager and technical experts will conduct a peer review of the studies for adequacy and compliance with CEQA. Upon review of each of the studies for CEQA adequacy, a Memorandum will be prepared and submitted to City staff summarizing the comments and recommendations of the Project Manager and technical experts, as appropriate. If additional studies/reports are prepared by the Applicant and provided to Psomas for peer review and incorporation into the IS/MND, a budget augment will be required (through the contingency budget) for the additional peer review. Subtask 2.2 Deliverables • Electronic Copies (email) of Peer Review Memoranda Subtask 2.2 Pronosed Technical Analvses Several technical analyses will be prepared as part of IS/MND sections by Psomas' in-house technical experts in support of an adequate environmental document, consistent with CEQA requirements. These analyses include Air Quality, Energy, Greenhouse Gas (GHG) Emissions, and Noise. The scopes of the said analyses are provided below. Additionally, South Environmental as a subconsultant to Psomas will prepare a Historic Built Environment Assessment to analyze the Project's potential impacts related to historic resources. The scope is provided below. Air Oualitv and Greenhouse Gas Emissions Psomas will develop Air Quality and Greenhouse Gas (GHG) emissions analyses based on a review the Project site plans, traffic study, and related Project data. Pso nas will prepare a Data Needs Request for the Project team to provide data relative to phasing, construction methods, grading quantities, building energy use, stationary sources, vehicle traffic, and Project features related to the required technical analyses. Based on information provided, Psomas will draft reasonable worst -case scenarios for anticipated construction activities (i.e., most intensive phase, type of construction, construction start and completion dates, anticipated soil export and import, equipment mix) and long-term operations to be used as the basis of the air quality modeling. Psomas will conduct the air quality analysis consistent with the South Coast Air Quality Management District's (SCAQMD's) recommended methods for CEQA analyses and will evaluate the Project's contribution to regional emissions to the air basin as well as localized concentrations to uses proximate to the Project site. For the regional emissions analysis, Psomas will calculate the Project's construction and operational criteria pollutant regional (mass) emissions using the California Emissions Estimator Model (CaIEEMod). Model results will be compared with the SCAQMD's CEQA regional emissions thresholds to determine the potential for Project related impacts to the air basin's regional emissions. For theanalysis of potential impacts to the local area proximate to the Project site, the SCAQMD requires that Project -related construction emissions be evaluated against the localized significance thresholds (LSTs). LSTs are used to determine whether sensitive uses near the Project site are exposed to air pollution that exceeds the ambient air quality standards (AAQS). For the operations phase of the Project, it is expected that a qualitative analysis will demonstrate that the Project would not generate traffic congestion at a major intersection at a magnitude that would cause a local carbon monoxide (CO) a.wrw«aincnr 05.m. A,MDon®a_ismxoA-3 Cost Estimate Mc Donald's at Santa Clara Avenue Project "hotspot". Thus, no dispersion modeling is included in this SOW for CO analysis. Project related emissions of construction phase toxic air contaminants (TACs) and odors will also be addressed qualitatively. Additionally, the analysis will include an evaluation of Project conformity with the Air Quality Management Plan for the South Coast Air Basin. Psomas will prepare a GHG emissions analysis. The quantitative Project analysis will use the data and scenarios developed for the air quality analysis; assumptions for the Project's anticipated electricity, natural gas, and water usage; proposed Project features that would conserve energy and water; sustainability features; and other data relative to GHG emissions. Psomas will calculate construction and operational GHG emissions concurrently with the air quality emissions using CalEEMod. Psomas will compare the change in GHG emissions with criteria that have been recommended by the SCAQMD or a threshold determined by coordination with City staff. Psomas will also determine whether implementation of the Project would conflict with applicable State, regional, and the City's Climate Action Plan, Santa Ana Green policies, or regulations adopted for the purpose of reducing air quality and GHG emissions. The findings will be provided as Air Quality and.Greenhouse Gas Emissions sections in the IS/MND, and model results will be included as appendices in the IS/MND. Energy Psomas will develop an Energy Analysis for the Project, which includes a discussion regulatory setting, energy demands, Project energy efficiency measures, impact assessment, and any necessary mitigation measures. The regulatory setting will include a discussion of the local, State, and federal policies and regulations that apply to the Project. The discussion of Project related energy demands includes quantification of anticipated energy consumption from the construction and operations phases. Construction phase energy demand is due to diesel and gasoline consumption used during the development of the Project. The operations phase of the Project would consume energy related to lighting and heating needs as well as vehicle trips. Potential impacts will be assessed relative to Project consistencywith the City of Santa Ana's energy efficiency and conservation goals and State of California Energy Efficiency Standards. An Energy section in the 1S/MND will be developed with the findings of the energy analysis and quantification sheets provided as appendix to the 1S/MND. Noise Psomas will conduct noise and vibration analyses to evaluate potential impacts attributable to the Project. Psomas will visit the Project siteto identify existing noise sources and to measure existing noise levels at the Project site boundaries. Four short-term noise measures (20-minute measurements) will be taken at the Project boundaries. These measurements will document noise levels at the Project site from noise sources such as traffic along East Santa Clara Avenue, North Tustin Avenue, and noise sources from nearby commercial and residential uses. Psomas will analyze temporary noise and vibration impacts from construction activities and will also review the Project plans, design, and traffic impact analyses to evaluate operational noise impacts to offsite sensitive receptors. The Project is anticipated to involve noise sources, which include drive - through activities, HVAC (heating, ventilation, and air conditioning) units, and parking lot activities. The analysis will compare noise impacts with the standards in the City's General Plan and Noise Ordinance. Increases in traffic noise on local roadways will also be quantified using the Federal Highway Administrations RD-77-108 traffic noise model. If mitigation measures are required to minimize noise and vibration impacts, recommend measures will be coordinated with the City and Applicant. The findings will be summarized in the IS/MND and supporting calculations will be included as appendix in the IS/MND. R:W1op sds Clty of Santa Ma%MoDonaltl ISMNO-W0123dooz A-4 Cast Estimate Mc Donald's at Santa Clara Avenue Project Historic Built Environment Assessment As a subconsultant to Psomas, South Environmental will prepare a Historic Built Environment Assessment understanding that buildings located at 2101 East Santa Clara and 2109 East Santa Ana Avenue are more than 45 years old. Property Survey. The exterior portions of all accessible existing built environment within the Project site will be surveyed by a qualified architectural historian, and detailed notes and photographs of all buildings and structures will be taken. It is assumed the survey will take no more than one day to complete and that safe access to the exterior of both properties will be provided. Property Evaluation. South Environmental will complete a historic significance evaluation for the two properties, identified as 2101 East Santa Clara Avenue and 2109 East Santa Ana Avenue, in consideration of California Register of Historical Resources (CRHR) and City of Santa Ana designation criteria to determine if the properties are considered historical resources for the purposes of CEQA Guidelines Section 15064.5. This may include accessing local libraries and archives and contacting relevant historical societies. South Environmental will also review all available building permits and construction documents to determine the nature and extent of alterations made to the properties over time. The properties will be evaluated on the required State of California Department of Parks and Recreation Series 523 Forms (DPR forms). South Environmental will prepare a report that will address potential Project -related impacts under CEQA Guidelines Section 15064.5. The report will summarize the results of the survey, the property significance evaluations, and the Project's potential to impact historical resources under CEQA. All DPR forms will be included as an appendix to the report. TASK 3 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION Subtask 3.1 Administrative Draft Initial Studv/Mitigated Negative Declaration Psomas will prepare an Administrative Draft IS/MND using the CEQA Environmental Checklist Form (Appendix G). In compliance with Section 15063 of the State CEQA Guidelines, the IS/MND will contain the location of the Project site; a discussion of the environmental setting; a description of the Project; identification of the Project's potential environmental effects; and a discussion of any required mitigation. The discussion of the environmental setting will be based on a review of existing information, including the General Plan EIR; technical studies provided by the Applicant and analyses prepared by Psomas; review of aerial photographs; and a site visit. The environmental analysis will include an explanation for all checklist responses to provide an understanding of how the IS/MND conclusions were reached. Project -specific mitigation will be developed for impacts that are determinedto be potentially significant. The following discussion describes the work effort to be undertaken to assess potential environmental impacts of the Project relative to each topical issue. Aesthetics. The discussion in the IS/MND will assess the potential visual changes in comparison with the existing views of the site. The site is currently developed with two single-family residences and detached garages and associated improvements. Photographs of the site will be taken from different vantage points and incorporated into the discussion and analysis, but preparation of a visual simulation study is not included in this SOW. "Public views" of the site from the roadways will be analyzed, as required by the IS checklist question. If significant impacts are identified, in discussion with the City, Psomas will propose appropriate mitigation measures. The potential impacts emanating from the changed light and glare associated with the proposed residential development will also be analyzed in the IS/MND. Rw,oposas=y msanta AnaPomonala ISM ND-moizs.mox A-5 Cost Estimate Mc Donald's at Santa Clara Avenue Agricultural and Forest Resources. The site has been disturbed and developed. The Project site and the general area is within urban built-up land, and the Project site is not being used, nor anticipated to be used for agricultural purposes. Based on the RFP, the currently Zoning designation of the site is General Agricultural (At), but the Project requires a Zone Change from Al to Arterial Commercial (C5). No forest land occurs on the Project site or in the surrounding area. The IS/MND will contain a statement identifying the site's lack of agricultural and forestry resources. Air Quality. The findings of the Air Quality Analysis, under Subtask 2.1, will be incorporated in the Air Quality section of the IS/MND, and the data will be included as an appendix. Biological Resources. The proposed Project site is within a highly developed area of the City of Santa Ana. Based on a preliminary review of the Project site and surrounding environment by a Psomas biologist, on -site and surrounding resources are limited to ornamental trees. These resources will be characterized as part of the IS and mitigation measures will be identified, if needed, to avoid significant impacts related to nesting birds and raptors during Project construction. • Cultural Resources and Tribal Cultural Resources. Psomas will submit a request to the California Historical Resources Information System (CHRIS) at the South -Central Coastal Information Center (SCCIC) to conduct a records search for the Project site, including a'/2-mile search radius surrounding the Project site. The SCCIC currently estimates 2 to 3 months from the date of request to receive the results of the records search. Additionally, Psomas will request the Native American Heritage Commission (NAHC) conduct a search of the Sacred Lands File (SLF) database for the Project site. The NAHC currently estimates 6 to 8 weeks from the data of request to receive the results of the records search. This SOW does not include a cultural resources pedestrian survey of the Project site. Additionally, Psomas will provide tribal consultation support as needed to the Lead Agency to fulfill the agency -to -agency consultation requirements Assembly Bill 52 (AB 52). AB 52 requires a Lead Agency to provide formal notification to tribal representatives that are traditionally and culturally affiliated to the geographic area where a project is located. This task assumes the preparation of up to eight letters on Lead Agency letterhead; one round of review by the Lead Agency; and up to four hours of telephone consultation in concert with the Lead Agency, as needed, to consult with the tribes. The tribal representatives have 30 days to request consultation upon receiving the AB 52 notification letter. Psomas can provide further support related to tribal consultation, such as additional meetings, minutes, oradditional site visits, subject to a scope and budget augment. The results oftheabove records searches, and tribal consultations will be compiled and described in the Cultural Resources and Tribal Cultural Resources sections of the IS/MND, as appropriate. If significant impacts are identified, Psomas will recommend mitigation measures to address the impacts. Further, the findings of the Historic Built Environment Assessment Report, under Subtask 2.1, will be incorporated in the Cultural Resources section of the IS/MND, and the report will be included as an appendix. • Energy. The findings of the Energy Analysis, under Subtask 2.1, will be incorporated in the Energy section of the IS/MND, and the data will be included as an appendix. • Geology and Soils. We understand that a Geotechnical Report has been prepared by the Applicant's consultant and will be provided to Psomas for incorporation into the IS/MND. Upon peer review of the report, the findings will be incorporated in the Geology and Soils section of the IS/MND, and report will be included as appendix in the IS/MND. Additionally, Psomas will request a paleontological resources records search and literature review for the Project site from the Vertebrate Paleontology Section of the Los Angeles County Museum RVr, osain lly afsamae Wa Danala ism No-oeoi21mcx A-6 Cost Estimate Mc Donald's at Santa Clara Avenue of Natural History (NHM). The NHM provides a letter summarizing information on geological formations and known paleontological localities (if any) near the Project site, and a determination of the paleontological sensitivity of the geologic units underlying the site. The NMH currently estimates 2 to 3 weeks from the date of request to receive the results of the records search. • Greenhouse Gas Emissions. The findings of the GHG Emissions Analysis, under Subtask 2.1, will be incorporated in the GHG Emissions section of the IS/MND, and the data will be included as an appendix. • Hazards and Hazardous Materials. Psomas will contract with Environmental Data Resources (EDR) to complete a radius search of hazardous materials databases. Psomas will summarize the findings ofthereport in the Hazards and Hazardous Materials section of the IS/MND and include the report as an appendix. In light of the demolition of existing single-family residences and detached garages, we assume that a Phase I ESA will be prepared and will be provided to Psomas for incorporation intotheIS/MND. Upon peer review of the said reports/studies, the findings will be summarized in the Hazards and Hazardous section of the IS/MND, and the studies/reports will be included as appendices in the IS/MND. Additionally, Psomas will qualitatively address other potential impacts related to hazards, including potential impacts related to chemical transport, storage, and handling; airport hazards; emergency response and emergency evacuation plans; and wildland fires. Hydrology and Water Quality. We understand that a WQMP and a Hydrology and Hydraulics Report have been prepared and will be provided to Psomas for use in the IS/MND. It is assumed that information on hydrology and drainage will include the pre- and post -development conditions; theavailable capacity of existing infrastructure; andpotential impacts related to storm drainage. The analysis associated with water quality will identify tributaries, impaired waters, and pollutants of concern. It will also identify whether the total maximum daily load standards have been established; storm water rate and volume that dictates the Best Management Practices (BMPs) proposed; and the potential for hydrologic conditions of concern. Upon peer review of the said reports, the findings will be incorporated in the Hydrology and Water Quality section of the IS/MND, and the WQMP and Hydrology Hydraulics Report will be included as appendices to the IS/MND. • Land Use and Planning. Psomas will describe the existing condition of the site and the surrounding land uses based on a site visit (Task 1.2) and review of the relevant available documents and information and analyze the Project's compatibility with the surrounding uses. The Project requires a Zone Change and a Conditional Use Permit to accommodate the proposed development, including the operation of the drive -through lane. Psomas will also evaluate the proposed Project's consistency with relevant local planning documents, including the 2022 General Plan policies and the Zoning Ordinance. • Mineral Resources. Based on the California Department of Mines and Geology (CDMG), Generalized Mineral Land Classification of Orange County, California, the proposed Project site and the surrounding area are designated as MRZ-3, which identifies "area containing mineral deposits the significance of which cannot be evaluated from available data". The Mineral Resources section of the IS/MND will include a discussion of the findings. • Noise. The findings of the Noise Analysis, under Subtask 2.1, will be incorporated in the Noise section of the IS/MND, and the data will be included as an appendix. • Population and Housing. The proposed Project will replace the existing residences by a McDonald's drive -through establishment. The Project will result in direction population growth; however, the increase in employment will be discussed. Psomas understands that fire and police services will be provided by the Orange County Fire Authority and Santa Ana Police Department, respectively. The potential effects associated with implementation of the proposed Project are related to the provision of adequate service levels and the need to upgrade and/or provide additional facilities to serve the proposed Project. Psomas will coordinate with the above service providers to identify existing public service facilities and to determine whether the proposed Project can be adequately serviced without any increase in personnel or expansion of existing resources, including facilities. • Transportation. Psomas understands that the Applicant's traffic consultant has prepared a Traffic Analysis, which will be provided to Psomas for use in the IS/MND. Upon peer review of the said Analysis, the findings will be incorporated in the Transportation section of the IS/MND, and the Analysis will be included as appendix in the IS/MND. • Utilities and Service Systems. Implementation of the proposed Project would not generate population at the Project site; however, the proposed Project has the potential to increase the demand for wet and dry utility services (e.g., water, wastewater treatment, solid waste, electricity, gas, telephone, and cable). The preparation of a Water Supply Assessment (WSA) for the proposed Project is not required, as the Project is below thethreshold for WSA for non-residential uses. Psomas will coordinate with applicable utility providers to obtain the necessary information regarding existing capacity, supply, and future demand from the proposed Project. It is assumed that utility plan showing connections for wet and dry utilities will be provided by the Applicant's civil engineers. • Wildfire. According to CalFire, the Project site is not located within any fire hazard zone. Given that the site and general area is not within the path of a high fire hazard designation, no impacts to future development are anticipated. The fire hazard zones will be identified and described in detail in the IS/MND. Upon completion, the Administrative Draft IS/MND will be submitted for review by the City. All environmental comments on the IS/MND will receive responses. The Response to Comments (RTC) document will be submitted to the City for review and then revised based on comments received and transmitted to the City. The City's decision -making body must consider the proposed IS/MND together with any comments received during the public review process. A total of 30 hours of technical staff time is assumed to prepare the RTC document. Should a large number of comments be received, the estimated budget for completing the RTC document may need to be revised and a budget augment requested. One round of review by the City staff is assumed for the Final IS/MND. Psomas will prepare the Notice of Determination (NOD) for the Project, which will be signed by the City upon certification of the IS/MND and action on the Project.
