HOLLIMAN & ASSOCIATES FOR PREPARATION OF RECYCLED WATER MASTER PLAN N THIS SECOND AMENDMENT TO AGREEMENT is entered into on this 15th day of August 2023, oby and between T.R. Holliman and Associates, Inc. ("Consultant'), and the City of Santa Ana, a i— charter city and municipal corporation duly organized and existing under the Constitution and laws v of the State of California ("City"). Consultant and City are also referred to herein as "Parties" or individually as a "Party." RECITALS A. The parties entered into Agreement No. A-2018-029, dated February 20, 2018, by which Consultant agreed to prepare a Recycled Water Master Plan for the Water Resources Division of the Public Works Agency ("Agreement"). B. The parties entered into a First Amendment to the Agreement (A-2021-008) on January 19, 2021, to expand the scope of work, increase the overall compensation, and extend the term of the Agreement until February 19, 2023. C. On January 19, 2023, the parties extended the term of the Agreement for an additional six (6) months until August 19, 2023, to allow Consultant to complete work related to the Agreement, as amended. The Agreement is current and in -effect. D. The parties desire to further amend the Agreement to extend the term of the agreement for a fmal one (1) year period. This Second Amendment contemplates no other revisions to the terms and conditions of the Agreement. THE PARTIES THEREFORE AGREE: Section 3, TERM, shall be amended to extend the term of the Agreement until August 18, 2024. 2. Except as hereinabove modified, the terms and conditions of said Agreement, as amended, remain unchanged and in full force and effect.
