Fwd: Citizen Proposal to Address Recall Election Deficiencies
Letter to SA Council_Recall_103123.pdf

Phan, Thai <TPhan _,santa-ana.org>, Phil Becerra City Of Santa Ana Council <pbacerrao,santa-ana.org>,
Hernandez, Johnathan <JRyanHernandezgsanta-ana.org>
Mayor Amezcua
Members of the Santa Ana City Council
Attached you will find my proposal to address the deficiencies in the current recall election.
One of the key omissions of the current oral and written discourse is the undemocratic
impact it will have on voters who have already cast their ballots. Also, to continue on "as
is" disenfranchises over 1500 voters (as the law has been currently presented).
This proposal is simply from a common sense, citizen perspective that seeks to protect
and preserves the democracy in Santa Ana for all involved parties.
VICTOR D MENDEZ

October 31, 2023
Mayor Amezcua
Members of the Santa Ana City Council
City Hall
Santa Ana, CA
Dear Mayor Amezcua and Members of the Santa Ana City Council:
I listened to and read the content associated with the current conflict over the legality of the recall
election, which is still slated for November 14, 2023.
1 was astonished that through the entire discourse (written and oral), there was no mention of the
undemocratic impact on those who have already cast their ballots.
The authority to disqualify a ballot rest with the Registrar of Voters (ROV) and the Courts. Anyone who
voted in 2000 and witnessed the process resulting in the election of former President Bush can certainly
attest to the very diligent and at times challenging process a disputed election can bring.
In as much there are significant technical deficiencies as the election currently stands, the Council should
not disregard 5,000 voters of Ward 3 who want a recall election, as well as those who have already
voted.
Rather than wait for the courts to arrive at a decision, I would propose the following to ensure the
election is operated fairly and correctly to all involved parties and maintains the integrity of our
democracy:
1. Request the ROV to extend the election date to mid to late January 2024
2. The ROV should set a deadline for the Recall proponents to meet the legal threshold for valid
signatures
3. The additional ballots (not previously distributed) should be distributed by the ROV as soon as
the date is set by Council
4. If the Recall proponents are unable to meet the deadline or do not submit a sufficient number of
valid signatures, then at that point the election should be cancelled.
In effect, due process for the voters of Ward 3 must be the priority and preserved. Political decisions and
all special and outside interests must be segregated from the discussion.
Sincerely,
Victor Mendez

Subject: Fwd: 601 N. Fairview and Buisness Park Redesign
Good afternoon,
I am writing to draw the City Council's attention to an issue regarding the project submitted by Vista Charter
School. They are seeking to fence the school and assert full ownership of the parking area, supposedly based on
a claim that CR&R has granted them these rights.
Upon reviewing the amended Civic Center CC&R and related documents, it is clear that these documents do
not explicitly mention ownership of the parking area. Instead, they primarily focus on the allocation of
maintenance responsibilities, assessments, and certain rights concerning specific areas within the property, such
as Buildings A/B, Buildings C/D, and Common Areas. Ownership or specific rights related to parking areas are
not detailed in this documentation.
Additionally, the owners of Buildings C/D are requesting that Vista Charter School provide specific references
within the CR&R documentation that grant them ownership of the parking areas, and/or if they possess receipts
confirming the purchase of these parking areas. Clarification on these matters would be greatly appreciated in
order to ensure a transparent and fair understanding of the situation. Also, as stewards of tax payer money, we
ask that the city clarify the parking situation to avoid any future conflicts that involve the city of Santa Ana if
plans are approved on just claims without solid references.

afternoon Ingrid and Collin,
I am writing to seek clarification regarding the claim of parking ownership for Buildings A/B. I believe it is
important that we base such claims on concrete and documented information.
I was unable to find explicit mention of ownership of the parking areas. The CR&R primarily focuses on the
allocation of maintenance responsibilities, assessments, and certain rights related to specific areas within the
property.
To ensure a transparent and fair process, it is crucial that we provide the necessary documentation or references
to support any claims related to parking ownership. This will not only help in resolving any potential disputes
but also ensure that we are all operating within the bounds of the CC&R.
I look forward to your response and any additional documentation that can shed light on this matter.
Thank you,

Subject: Agenda iii- public hearing : Ceasefire now
As an American citizen, Orange County resident and voting constituent we are demanding a ceasefire now. As a Tex
paying citizen we did not vote for war crimes and unconditional support to war criminals. We didn't not ask for taxation
for genocide representation. When the Jews of the Holocaust says "neveragain, it was meant for EVERYONE.
Isreal's inhumane ethnic cleaning of the Palestinians has now gone BEYOND proportionality. It is now collective
punishment for all. Even the citizens in the West Bank where there is no Hamas. They're own Jewish Liberals, demanding
a ceasefire as they stopped supporting Netanyahu a long time ago.
How can ANY public servant sit here, claiming to be a part of a republic that is BY THE PEOPLE, FOR THE PEOPLE, yet be
so tone deaf to what the people are demanding.
Protest after protest, sit-in after sit-in. Marches and rallies internationally done in the name of humanity. Yet somehow
autocractic authoritarians still reigns supreme in this so called DEMOCRACY.
We are now seeing 10,000 civilians dead. 5 thousand just children. Those who aren't killed by bombs, white phosphorus,
and trauma from the devastation will assuredly perish from lack of water, food, sanitation, hygiene, trauma wounds,
infections and lack of humanitarian aid.
We are imploring you to please ask
For a CEASEFIRE. Not a humanitarian pause, but a total and complete full stop. My sons best friend, who is originally
from Palestine just had 20 family members MURDERED. 3 were under the age of 10. This cannot go on anymore. It's
been 30 days. Enough is enough.

Subject: Support for Resolution
Hello,
I am writing today to express my support for solidarity with Palestinians in Gaza, to urgent for a cease-fire and
an end to genocide, and an end to apartheid. More than 10,000 Palestinians murdered by Israel and with the
support of our government and tax dollars is NOT okay. Our tax dollars need to be used for our cities and
states, and to help house, feed, clothe and provide health and livelihood to our residents and citizens. Santa Ana
City council should absolutely vote in favor of any such resolution. Never again means never again for anyone
and the city council should advocate for the support of Palestinians.
Thank you

Subject: Supporting request to prioritize and agendize resolution in solidarity with Palestinians
in Gaza and call for ceasefire
Hello City Council members,
For a majority of us, this past month, we have become witness to the biggest atrocity and test of humanity of
our lifetimes. Especially with the widespread use of social media, we were able to witness it all with the
rawness it entailed in real time, without it being filtered through mainstream and/or biased media outlets.
The images of whole cities being wiped out, hospitals, refugee camps being bombed, the body parts of small
children being obliterated to pieces, all in the name of "self-defense" has been morally unacceptable and a
disgrace upon humanity today.
As we continue about our daily lives in our privileged lifestyles and standards of living, entire families have
been mercilessly wiped off the face of the earth. An entire people have been subject to nothing short of ethnic
cleansing, nothing short of genocide!
Human life is sacred, regardless of race, color, religion, nationality or political affiliation. One life taken is one
too many, and here we are, watching idly as not one, not ten, not one hundred, not one thousand, but 10,000
lives have been taken!! More than 4,000 of these lives taken are babies and children, not even being given a
chance at life.
As adults, we look at those images and we as adults are traumatized. But those babies and children, they are
living inside of it!!! These children are having to witness their mothers, fathers, siblings, whole extended
families being obliterate in front of their very eyes! Can you imagine being in their shoes?!!
Indeed the city council has many things on their agenda regarding local issues. However, when it is our tax
dollars that are funding this genocide, this carnage, this absolute horror, I believe this issue takes precedence
over any other agenda or talking point. It must take precedent!
If we have been given a platform and a voice, we must use it to speak up for those being silenced by bombs and
unspeakable traumas!
We must, as members of the human family, must come together and say "no!!" to the mass murder of
our brothers and sisters, our nieces and nephews, our aunts and uncles in Palestine, in Gaza!
We must call for a ceasefire NOW! We must call for an end to the Israeli occupation of the land of Palestine
and to the apartheid regime that has been suffocating our brothers and sisters in Palestine for as long as we have
been alive on this Earth!
"Never again" means "never again for anyone"!!
Thank you!

Agenda

I hope this message finds you in good health and spirits. I am writing to you today to discuss a matter
of concern that has a significant impact not only on the global stage but also touches the hearts and
lives of many in our diverse community.
For the past 30 days, the world has witnessed a harrowing human tragedy unfold in Gaza. Continuous
airstrikes have resulted in the loss of approximately 11,000 innocent civilians, of which over 4,000 are
children. The relentless bombardment has left 1.5 million people displaced and the city in ruins.
Hospitals, schools, and refugee camps have been targeted, essential services have been cut off, and
prohibited weapons, including white phosphorus, have reportedly been used, further exacerbating the
crisis.
Our community is a tapestry woven from many threads, including Muslim and Palestinian members,
and others from various backgrounds who are deeply affected by these events. They have lost family
members and friends in these attacks, and they suffer the anguish of knowing the plight of their loved
ones under siege. It's a pain that is both personal and profound, and it resonates throughout our
community.
Acknowledging this crisis and issuing a statement of solidarity will send a powerful message of hope
and unity. It will demonstrate to the members of our community, and to the world, that we are
unwavering in our commitment to human rights and the sanctity of human life, irrespective of race,
religion, or geography. It is a necessary and compassionate gesture that honored the values we
uphold as a community.
I trust that the Council will consider this request. Let us stand on the right side of history, as
champions of peace and humanity.

Subject: Resolution in solidarity with Palestinians
Dear City of Santa Ana,
It makes me immensely proud to see my area community stand with those who are targeted and unfairly oppressed,
the innocent Palestinians. All I know is that even Palestinian lives are precious. I don't want our nation to be complicit
in an unjust occupation, or worse, a genocide of the Palestinian people, which the entire world is witnessing. What are
we teaching our children if we do not affirm the humanity of fellow Palestinians? We must raise our voices for a
ceasefire now! We also must address the problematic financial relationship of our nation with Israel. I certainly don't
work hard and pay my taxes for them to be misused and fund the systematic killing off of innocent Palestinian children,
mothers, and fathers! Financing the terrorist regime of Israel is the most unAmerican thing we could do. The right to life,
liberty and the pursuit of happiness are American values with which we should be leading the world. We must stop
funding Israel immediately! There is no reason to give away 3.8 billion USD annually nor grant another 14 billion to
Israel in the midst of the bombardment! If we as Americans would never stand for it then why should we fund a system
of apartheid and occupation alongside all the horrors and war crimes being committed against Palestinians, a civilian
population? That money being denied the American people should rightfully go back into strengthening our society. Of
course, we the American people reject the forced displacement of civilians, the killing of children, the bombings of
schools, refugee camps, and hospitals, the denial of basic needs of water, food and fuel, the use of white phosphorous,
and evil schemes to bomb fleeing refugees. I fully support this resolution which sides with the humanity of our fellow
human beings.

Subject: Senior Citizen Residents of 2222 East First St Thank Mayor V
Mayor Amezcua -
I did not have the opportunity to comment last night, but on behalf of the 600 senior
citizen residents living at I wish to personally thank you for your
recent efforts in protecting our health and safety.
• Your quick response to enable a team to repair our nearby water main ensured
that the residents, many who are disabled and most are elderly women, had
access to water without undue delay.
• The effort you put in to shore up the communications between City Net and QOLT
prevented the establishment of a homeless encampment that was created no less
than 50 feet from 2222.
• Lastly, you took time away this past Sunday to deploy QOLT to our location to deal
with a homeless man who was living in a bike storage room at 2222. Several
female residents were very concerned over this clear and present danger to their
personal safety and we are grateful for your prompt attention.
I know you did not run for Mayor to get accolades. You ran to serve the residents. On
the other hand, it is important to balance out criticisms of your work with actual positive
results for the people of Santa Ana, especially Senior Citizens who are too often ignored.
