Pursuant to Section S ("Extension Periods") of the above -referenced Lease Agreement, entered into by
RailWorks Track Services. Inc., and the City of Santa Ana, dated February 1.2022. the time period of the
Lease Agreement is hereby extended for up to three (3) additional one -month periods, from August I, 2023
through October 31, 2023, RailWorks has three (3) months remaining in its extension option. The parties
agree that either party may terminate this Agreement at any time upon thirty (30) days' prior written notice
to the other party. Any insurance certificates are required to be extended and/or renewed to cover this
extension. All other terms and conditions of the Lease Agreement remain unchanged and in full force and
effect.
