HomeMy WebLinkAboutPresentation - #38Item # 38 Community Development Agency November 7, 2023 Slide 1 Santa Ana Rental Registry Informational Report November 7, 2023 Item # 38 Community Development Agency November 7, 2023 Slide 2 Background •On November 18, 2022, the Rent Stabilization and Just Cause Eviction Ordinance (“Ordinance”) was adopted and requires a rental registry where all landlords with rental units must submit registration forms for each rental unit. •Staff has created an online Rental Registry portal for collecting required rental information. •Staff has been working with rental property owners since August 15th to register their units. Property Owners with rental units in the City of Santa Ana must: •Register each rental unit annually •Update the Rental Registry within thirty (30) calendar days of any changes to a rental unit •Report changes of ownership in the Rental Registry •Upload all notices or documents required to be provided from a landlord to a tenant in the Rental Registry Item # 38 Community Development Agency November 7, 2023 Slide 5 Required Notices or Documents after Registration •Any notices or documents required to be provided from a Landlord to a Tenant by the Ordinance, or any other federal, state, or local law, shall be provided by the Landlord to the City through the Rental Registry including but not limited to: •Notice of Rent Increase •Notice of Change in Ownership or Management •Notice of the Existence of the Ordinance •Notice to Cease or Correct •Notice to Perform or Quit, or Notice to Cure or Quit •Notice to Pay Rent or Quit •Notice to Quit or Notice to Terminate Tenancy •Unlawful Detainer Item # 38 Community Development Agency November 7, 2023 Slide 6 Notices or Documents NOT Required after Registration •Notices to enter •Notices to change terms of tenancy not involving a change in rent. Item # 38 Community Development Agency November 7, 2023 Slide 7 Information Collected in the Rental Registry •Address, unit number •Property type (Dropdown -Affordable Housing, Mobilehome, Multifamily, SFR, Condo) •Ownership type (Dropdown –Real Estate Investment Trust, Corp, LLC) •Occupant type (Dropdown -Owner, Manager, Tenant, Subsidized Tenant) •Number of bedrooms & bathrooms •Tenancy start date •Initial rent •Current rent Item # 38 Community Development Agency November 7, 2023 Slide 8 Information NO LONGER Collected •Tenant’s full name (Only Head of Household or Co-Head) •Tenant’s phone number •Tenant’s email address •Tenant’s preferred language Item # 38 Community Development Agency November 7, 2023 Slide 9 Information NOT Collected in the Rental Registry •Landlords are not required to submit: –A lease agreement, –Social Security Number, –Employer Identification Number (Tax Identification Number for businesses), or –Any other confidential information unrelated to compliance with the Ordinance. Item # 38 Community Development Agency November 7, 2023 Slide 10 Securing Information in the Rental Registry •3Di is the City’s software provider –Service Organization Control Type 2 compliant, –Cloud-based SaaS platform is supported by Amazon Web Services –Restricted to authorized users with role-based permissions and is not publicly accessible –While 3Di cannot guarantee security is not breached, 3Di has not had a breach of their data to date. Item # 38 Community Development Agency November 7, 2023 Slide 11 Compliance •Beginning October 1, 2023, the City may commence enforcement against any landlord who fails to register a rental unit, or provide current and accurate data regarding a rental unit pursuant to Section 8-3160(k) •Until a rental unit is registered both completely and accurately, no Landlord shall: •Increase rents, advertise for rent, demand or accept rent, •Evict any Tenant from a Rental Unit, or •Submit to the City a petition, application, claim or request for a rent increase.
