Project Applicant:  Michael Trang, representing 7­Leaves Café (Applicant), and CJ Segerstrom & Sons (Property Owner) Proposed Project:   Applicant is requesting approval of Conditional Use Permit (CUP) No. 2023­13 to allow the drive­thru operations 7­leaves Café at the above­ mentioned location. Environmental Impact: Pursuant to the California Environment Quality Act (CEQA), the project is exempt from further review pursuant to Class 3, Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines. Categorical Exemption ER No. 2022­93 will be filed for this project. Recommended Action: Adopt a resolution approving Conditional Use Permit No. 2023­10, as conditioned. 2.ZONING ORDINANCE AMENDMENT NO. 2023­01 AMENDING CHAPTER 41 OF THE SANTA ANA MUNICIPAL CODE TO INCREASE THE CONDITIONAL USE PERMIT SEPARATION REQUIREMENTS ON NOXIOUS USES FROM SENSITIVE RECEPTORS TO 1,000 FEET, UPDATE THE MASSAGE ESTABLISHMENT ORDINANCE, ADD A CONDITIONAL USE PERMIT SUSPENSION PROCESS AND OTHER CLARIFYING EDITS.  Project Location:   Citywide Project Applicant:  City of Santa Ana, Planning and Building Agency Proposed Project: The City of Santa Ana is proposing to amend various sections of Chapter 41 (Zoning) of the Santa Ana Municipal Code (SAMC). The proposed amendments would increase the conditional use permit (CUP) separation requirement of noxious uses from sensitive receptors from 500 linear feet to 1,000 linear feet, provide updates to the City’s massage ordinance to require a separation requirement from residentially zoned or used properties and regulations for legal nonconforming establishments, establish a CUP suspension process, and provide clarifying edits to typographical errors and various internal inconsistencies. Environmental Impact: Pursuant to the California Environment Quality Act (CEQA), the adoption of this Ordinance is exempt from CEQA review pursuant to Sections 15061(b)(3)/(5) of the CEQA Guidelines because the ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment, as there is no possibility the ordinance will have a significant effect on the environment and are not a "project", as defined in Section 15378 of the CEQA Guidelines. Recommended Action: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 2023­01 Administrative Matters 3. ELECTION OF OFFICER FOR THE PLANNING COMMISSION 2022­2023 PARTIAL TERM. Recommended Action:               a. Elect a Vice Chairperson for the remainder of the 2022­2023 term. 4. ELECTION OF REPRESENTATIVE TO THE HISTORIC RESOURCE COMMISSION. FUTURE AGENDA ITEMS APPEAL INFORMATION The formal action by the Planning Commission shall become effective after the ten­day appeal period, unless the City Council in compliance with section 41­643, 41­644 or 41­645 holds a public hearing on the matter, then the formal action will become effective on the day following the hearing and decision by the City Council. An appeal from the decision or requirement of the Planning Commission may be made by any interested party, individual, or group. The appeal must be filed with the Clerk of the Council, accompanied by the required filing fee, and a copy sent to the Planning Department, within ten days of the date of the Commission's action, by 5:00 p.m. If the final day to appeal falls on a City Hall observed holiday or a day when City hall is closed, the final day to appeal shall be extended to the next day City Hall is open for public business. Please note: Under California Government Code Sec. 65009, if you challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the Planning Commission or City Council at or before the hearing.
