Q0 RECITALS Q A. The patties entered into Agreement No. N-2023-118 ("Agreement") dated April 19, 2023, to retain a qualified provider to provide dance programming in the City's recreation class program. B. The Agreement is in full force and effect through May 31, 2024. C. The parties now wish to amend the Agreement to update the scope of services to include additional locations for the provision of the dance classes contemplated by the Agreement. The Parties therefore agree: 1. Section 1, Scope of Services, is hereby amended to include the additional locations as detailed in Exhibit A -I to this First Amendment. 2. Except as modified by this First Amendment all terms and conditions of the Agreement shall remain in full force and effect. Provider shall teach such or similar classes (1) at the times below at facilities to be designated by the City or (2) on a schedule agreed upon by the parties for each class session or term, including the location, specific days and hours when classes will be held, and holidays to be observed, in accordance with City's needs, Fun with Sounds Parent -and -Me introduction to music and dance, we explore harmonies, beats and rhythm patterns by singing, dancing and playing along to favorite tunes. INSTRUCTOR: Katherina Sutter LOCATION: El Salvador Center, 1825 W Civic Center Dr., Santa Ana, (714) 647-6558 • run with Sounds classes will consist of 4 weeks session, held 1 day per week, 50 minutes per day, Ages 1-4 years old INSTRUCTOR: Katherina Sutter LOCATION: Roosevelt Walker Center, 816 E Chestnut Ave, Santa Ana, CA (714) 647-5220 • Fuji with Sounds classes will consist of 4 weekly sessions for $39 a month, held Tuesdays, I t:15am-12:00pm. Ages 1-4 years old INSTRUCTOR: Katherina Sutter LOCATION: Salgado Center, 706 N Newhope St, Santa Ana, CA (714) 571-4267 • run with Sounds classes will consist of 4 weekly sessions for $39 a month, held Tuesdays, 9:30am- I 0:00am. Ages 14 years old C. Provider shall provide all materials, supplies, equipment, records and personnel. Provider shall be responsible for clean-up of the facilities and materials and shall ensure the safety and effectiveness of instruction. CLASS SIZE A. Each class must have a minimum of 5 paid students and no more than 15 students. B, No registration will be accepted after the second meeting of classes. C. If the minimum registration has not been reached by the day before the second class, the class shall be canceled. Provider will be under no obligation to provide services for the canceled classes, and the City will have no further obligations to pay Provider compensation for the remaining classes that were canceled in that session. CLASSFEES A. Each participant shall pay class registration fees as established by City. B. Provider may not waive class participation/registration fees. C. Only registered participants may participate in class. D. Any refunds to participants will be made in accordance with City policy. B. Any materials fee shall be established by mutual agreement of City and Provider and shall be payable directly to Provider, COVID-19 REQUIREMENTS A. Instructor and participants shall wear a mask at all times to participate. B. Temperature will be taken at the beginning of the class for instructor and participants, C. Social Distancing should be adhered to at all times. E.
