HomeMy WebLinkAboutU.S. DEPARTMENT OF VETERAN AFFAIRSDocuSign SUR �ly�q�P"F3-A75E-12BD81372070 CITY CLERK DATE: N-2024-086 MEMORANDUM OF UNDERSTANDING CAr BETWEEN J UNITED STATES DEPARTMENT OF VETERANS AFFAIRS, LONG BEACH HEALTH CARE SYSTEM, AND THE SANTA ANA POLICE DEPARTMENT This Memorandum of Understanding (MOU) is entered into between the U.S. Department of Veterans Affairs (VA), Long Beach Healthcare System (Long Beach VAHCS), and the Santa Ana Police Department, hereinafter referred to as "parties." d- 1. PURPOSE. To establish general working relationships between the Long Beach VAHCS Police Service and the Santa Ana Police Department as a means of reinforcing interagency coordination and responsibility concerning law enforcement, emergency response, requests for assistance, and physical security and access control operations at the Community Outpatient Clinic (CBOC) located at 1506 Brookhollow Dr. Santa Ana CA 92705 and a Community Resource and Referral Center (CRRC) located at 888 W. Santa Ana Blvd., Ste 150 Santa Ana. VA Policy strictly limits the arrest authority of the VA Police to the VA - owned property. 2.REFERENCES. a) VA Directive 0730, Security and Law Enforcement, 12 December 2012 b) VA Handbook 0730, Security and Law Enforcement, 11 August 2000 c) Concurrent Jurisdiction 3. GENERAL. a. Long Beach VAHCS hospital, also known as Tibor Ruben VA Medical Center, is in the City of Long Beach. VAHCS provides primary, specialty, and extended care to Veterans throughout the Los Angeles and Orange County areas. The mission of the Long Beach VAHCS is to provide timely, efficient, ethical, safe, compassionate, and quality health care to Veteran patients. b. The Santa Ana Police Department has concurrent jurisdiction with the Federal Government over the Long Beach VAHCS Hospital's properties. This jurisdiction grants local police agencies the authority to jointly enforce Federal and State laws with VA Police on Long Beach VAHCS properties. (Concurrent jurisdiction) 4. RESPONSIBILITIES. a. Long Beach VAHCS Police Service will: (1) Maintain law and order and enforce Federal and state laws and VA regulations at the Community Outpatient Clinic to protect property owned or occupied by the VA and persons on the property. DOcuSign Envelope ID: CGCFD37D-041A4CF3•A76E-12BD81372070 (2) Long Beach VAHCS does have a certified narcotics detection K9, which can assist the Santa Ana Police Officers when requested. (3) Long Beach VAHCS has a Mental Evaluation Team (VMET) consisting of a clinician and a Police Officer that can assist with Veterans in crisis. b. Santa Ana Police Department will: (1) Respond to the Long Beach VAHCS Police Service's requests for assistance. Such assistance may include, but is not limited to, the following situations: (A) Armed hostage -taking situations that would require an armed response to assist VA Police in containing the situation until appropriate Federal agencies (such as the Federal Bureau of Investigation - FBI) can respond to assume control. (B) Crimes involving armed robberies of funds, drugs, or properties where the Individuals committing the crimes leave VA Police jurisdiction. (C) Vehicle accident Investigations may result In non -injuries, injuries, or death involving the VA Police patrol vehicles or any other vehicle accident involving a fatality or severe injury. (D) Any major incident requiring additional Officers for traffic control to allow emergency vehicles clear access to the facility. (2) Provide additional Officers when needed to assist with the physical arrest of a violent/disorderly person(s) who poses a severe threat to VA patients, visitors, medical staff, or themselves. (3) Assist in the transportation of prisoner(s) who have been arrested at the Community Outpatient Clinics. (4) Authorize access to and use of Santa Ana Police Department's dispatch and patrol units in the field for VA Police. The parties agree that accessing and using such information is limited to official law enforcement purposes, and reprogramming VA radios would be at no cost to the Santa Ana Police Department. (5) Should any VA Police Officer be involved in a shooting, the FBI will be notified immediately. If the FBI declines investigation or the FBI response is delayed, the Santa Ana Police Department may provide investigative assistance to Long Beach VAHCS Police. This assistance may range from establishing, preserving, and controlling the crime scene to being the primary investigating agency. (B) COMPACT ACT Section 205 Police Crisis Intervention Training for VA Police requires that each VA Medical Center police service develop a plan to enter partnerships with local mental health organizations and experts, Veteran community organizations, as well as local Police Departments to share training resources on Crisis intervention Teams (CIT). This assistance may range from collaborative training and sharing law enforcement to coordinated Intervention tactics when an extreme crisis involves a veteran(s). The provisions of this MOU are effective upon signature and date as indicated below and will be reviewed every three years or as required. b. This agreement may be unilaterally suspended or canceled by either side upon giving the other party at least 180 days of written notice. c. This MOU does not create additional jurisdiction or limit or modify existing jurisdiction vested in the parties. This MOU is intended exclusively to provide guidance and document an agreement for general support between the parties. Nothing herein creates or extends any right, privilege, or benefit to any person or entity. d. Other areas of mutual interest may arise where the other party of this MOU requires services and support from one party of this MOU. This MOU is not meant to limit those instances nor prohibit cooperation outside the above -listed situations set forth and agreed upon.
