Ordinance Establishing Distance Requirements for Targeted Residential Picketing
Dear Hon. Mayor and Council Members:
In the timeless wisdom of the Supreme Court's decision of Carey v. Brown, resides a
fundamental truth: the sanctity of the home is sacrosanct. It is the fortress of tranquility, the
bastion of peace, the haven where individuals seek solace from the tumult of the world. It is
within these hallowed walls that families nurture, dream, and find respite from the rigors of daily
existence. Such an essential refuge must be safeguarded from undue intrusion and disruption.
Thus, it is with great urgency and conviction that the board of the Floral Park Neighborhood
Association implores this Council to consider and adopt the proposed ordinance prohibiting
targeted residential picketing within our community.
Our neighborhood has regrettably become the unfortunate stage for a series of disruptive and
distressing protests. These demonstrations, characterized by blaring sirens, raucous bullhorns,
and incessant drumming, have not only violated the peace and quietude of our streets but have
directly targeted a singular neighbor to the detriment of all nearby residents.
In the eloquent words of the Supreme Court, the well-being, tranquility, and privacy of the home
are indeed of the highest order in a free and civilized society. As such, it is imperative that
measures be taken to preserve these cherished values. The proposed ordinance aligns with
established legal principles, recognizing that while the freedom of speech is a bedrock of our
democracy, it must be exercised responsibly and with due regard for the rights and well-being of
others.
In the landmark case of Ward v. Rock Against Racism, 491 U.S. 781, 791 (1989), the Supreme
Court affirmed that governments may impose reasonable restrictions on the time, place, or
manner of protected speech, provided such restrictions are justified by significant governmental
interests and do not unduly infringe upon alternative channels of communication. The ordinance
under consideration meets these criteria, serving to protect the sanctity of the home while still
allowing ample avenues for the expression of ideas and opinions.
In recent months, we have witnessed a troubling erosion of civility within the confines of City
Hall chamber. That behavior has now spilled on to the residential streets of our city. The
adoption of this ordinance represents a critical first step in restoring civility and respect for our
fellow citizens, both in public discourse and private life. It sends a clear message that our
community values the well-being and dignity of all its residents and will not tolerate behavior
that undermines these principles.
We commend the City Council for its commitment to upholding the rights and dignity of all
residents of Santa Ana. By enacting this ordinance, you will not only defend the peace and
tranquility of our neighborhood but also reaffirm the values of respect, civility, and community
that are the hallmarks of our society.
In conclusion, we urge you to stand on the side of decency and justice by adopting the proposed
ordinance prohibiting targeted residential picketing. Let us ensure that our residential
neighborhoods remain havens of peace and refuge.

Dear Hon. Mayor and Council Members:
Regrettably, I am unable to attend the City Council meeting on March 19t" however, it is
important that my voice be heard regarding Agenda Item #24.
As a resident on the corner of North Park Blvd and Benton Way, I have unfortunately been
subjected to numerous protest demonstrations. These gatherings sometimes start as early as 6:30
am on weekends, inundating my home and neighbors with deafening noise from relentless
shouting, bullhorns, drums, and sirens.
While I wholeheartedly support the fundamental right to demonstrate and protest as protected
under our First Amendment, I vehemently oppose allowing such activities to occur mere feet
away from my private residence. This proximity leaves me feeling unsafe and unsettled,
transforming my home from a sanctuary into a place of anxiety and fear.
I strongly urge the City Council to consider and enact the proposed ordinance aimed at regulating
residential picketing. It is my hope that this measure will restore peace and tranquility to my
neighborhood and return our homes back to places of safety and refuge.

I hope our City Council recognizes the dangers and the intrusions into neighbors lives. A persons home is
sacred and if there are concerns, put them in writing and send them to the person or parties. I saw the group
crossing the street at Broadway and Santa Clara early Sunday morning. They walked caring their flags in
unity. Everyone is entitled to their religious beliefs. We need to respect each other and not cross the
boundaries. Santa Ana needs to step up and protect our neighbors and neighborhoods. If it happened to anyone
on the council, they would insist on protection. Do the RIGHT thing tonight.

On Tuesday, you will be discussing an urgency ordinance to forbid protest within 300 feet of a residence. This is outrageous and
a real eroding of First Amendment rights! You need to unequivocally reject this proposal.
Long Beach recently rejected a similar proposal and stood up for the American right to peaceful assembly.

Good afternoon,
I am sending this email because I am appalled at this agenda item. It must be voted against. This is
repugnant and anti -democratic. If city council attempts to restrict the right to peacefully protest and
violates our fundamental ist amendment right it will not be respected and it will incur more protest
which is your citizens' prerogative. If representatives are unwilling to hear dissenting opinions and
engage with voters exercising their ist amendment rights even when they disagree then they are unfit
for public service and should immediately step down. This is a gross violation of our rights. Vote
against Agenda Item #24.
If you are not fit to be a leader then do not choose to be one. I am a lifetime resident of Santa Ana,
currently residing in Ward 5. This is completely unacceptable. Whichever council members put this
on the agenda should be ashamed, lambasted, and not seek reelection.

My husband and I live in Floral Park in Santa Ana. Though the protests of Lou Correa have not disrupted us, we feel there
has been a line crossed on what should be acceptable in a residential neighborhood. The loud noises are meant to be a
menace to the community and should be confined to a particular time of day if they happen at a private residence at
all. The protestors seem very disinclined to have a conversation whatsoever. While I value the freedom to protest in
America, this goes beyond what a noise ordinance should allow.

I am writing in a comment today for Agenda Item #24. 1 am deeply disappointed that this is even on the agenda today.
Lou Correa knew that becoming an elected official would mean that he would have to listen to the citizens that voted for
him. He refuses to show any interest in having a conversation on issues that we feel are important. Just because he has
chosen to listen to his greed & not listen to his community does not mean that he gets to violate our 1st amendment
right to protest simply because he's been "inconvenienced." I am asking that our elected city council members vote to
protect our rights. Please don't make the same mistake that you did your "media rule" that also violated our right to free

Opposition to Adoption of Residential Picketing Ordinance
Dear Mayor Amezcua and Members of the Santa Ana City Council:
The American Civil Liberties Union of Southern California is concerned with an
ordinance listed as Item No. 24 on the March 19 agenda which, if adopted, would prohibit
targeted picketing within 300 feet of a residential dwelling and would impose up to a $1,000 fine
and/or up to six months in jail ("draft ordinance"). The draft ordinance comes on the heels of
robust public discourse and protests by Santa Ana residents urging the Mayor, Councilmembers,
and Congressman Lou Correa to call for a ceasefire of Israel's war on Gaza. In fact, the preamble
to the urgency ordinance confirms that it is intended, at least in part, to insulate the Congressman
from ongoing pro -Palestinian protests that are critical of his positions and actions. Although the
ordinance will force protesters to move nearly an entire football field or full city block away
from the Congressman's home, inhibiting their First Amendment rights, it will not stop protests
altogether. Instead, it will merely ensure that Congressman Correa's neighbors are subject to
hearing protestors' complaints that are intended for the Congressman, whose residence will
likely not be in earshot of the protests. Equally concerning is the fact that, if adopted, the
ordinance will be one of the most restrictive targeted residential protest laws in the Country. We
therefore urge you to vote against this extreme attempt to curb free speech.
A public street is a traditional public forum where picketing enjoys First Amendment
protections, and it does not lose this status "simply because [the street] runs through a residential
neighborhood." Frisby v. Schultz, 487 U.S 474, 480 (1988). Instead, courts have emphasized that
these protections extend to targeted residential picketing. Klein v. San Diego Cnty., 463 F.3d
1029, 103636 n.5 (9th Cir. 2006). This is because the "right to residential privacy does not
encompass a right to remain blissfully unaware of the presence of picketers." Id.; see also
Murray v. Lawson, 138 N.J. 206, 232-33 (1994) (in striking down 300-foot restriction, observing
that keeping picketers "at such a great distance, thereby rendering [the residents'] awareness of
the picketing most unlikely as a practical matter, is unnecessary to protect [the] residential -

privacy interest"). The First Amendment exists precisely to ensure "the unfettered interchange of
ideas for the bringing about of political and social changes desired by the people," and targeted
residential protests of elected officials fall squarely within this purpose. See New York Times v.
Sullivan, 376 U.S. 254, 269 (1964) (there exists a "profound national commitment to the
principle that debate on public issues should be uninhibited, robust, and wide-open, and that it
may well include vehement, caustic, and sometimes unpleasantly sharp attacks on government
and public officials").
Santa Ana residents have previously engaged in targeted residential protests of elected
officials without a suppressive response from the Council. In 2016, for example, following an
unsuccessful hunger strike calling on the City Council not to extend the City's contract with U.S.
Immigration and Customs Enforcement, protesters ended their strike in front of then-
Councilmember Vicente Sarmiento's home. i Since October, Santa Ana residents who want an
end to Israel's war on Gaza have similarly exercised their First Amendment rights by engaging
in targeted residential and commercial protests. On February 22, protesters picketed in front of
the Ebell Club where Mayor Amezcua was hosting a reelection campaign fundraiser, calling on
the Mayor to support a ceasefire resolution. Although Mayor Amezcua purportedly called law
enforcement to the scene, there were no arrests or altercations. Protests in front of Congressman
Correa's home calling for support for a ceasefire have also been ongoing. As stated in the
urgency ordinance, it is only in response to these recent actions espousing pro -Palestinian views
that the Council has now introduced an ordinance to severely limit residential picketing.2
The agendizing of the ordinance in response to ongoing residential protests raises an
inference that the measure is intended to stifle expression of a political viewpoint that the Mayor
and some members of the Council may disagree with, but laws that discriminate based on
viewpoint are unconstitutional.3 Police Dep't of City of Chicago v. Mosley, 408 U.S. 92, 96
(1972) ("under the Equal Protection Clause, not to mention the First Amendment itself,
government may not grant the use of a forum to people whose views it finds acceptable, but deny
use to those wishing to express less favored or more controversial views"). Even if a law is
content -neutral on its face, the law may nonetheless be unconstitutional if it is in fact "a facade
for viewpoint -based discrimination." Cornelius v. NAACP Legal Defense and Educ. Fund, Inc.,
473 U.S. 788, 811 (1985); Reed v. Town of Gilbert, Ariz., 576 U.S.1555 166 (2015) (noting that a
"content -based purpose may be sufficient ... to show that a regulation" discriminates based on
viewpoint) (internal quotation marks omitted). Here, the introduction of the proposed ordinance

councilmembers raises serious concerns that the intent behind the ordinance is to discriminate
against pro -Palestinian speech.
The distance requirement imposed by the draft ordinance is also concerning.
Congressman Correa's home is surrounded by a tall fence and dense greenery. Requiring
protesters to picket nearly a football field away from the Congressman's home will largely
insulate him —but not his neighbors —from the protesters. The draft ordinance includes the same
restrictions as the ordinance at issue in Klein, and the ordinance's likely impact on the Correa
protests mirrors concerns that the Ninth Circuit raised with 300-foot restrictions more broadly.
Although the court in Klein held that San Diego County's ordinance was facially constitutional,
i.e., not unconstitutional in every conceivable application, it acknowledged that the ordinance
was nonetheless problematic. Id. at 1031, 1036. Among the many issues, the ordinance did not
include more limited restrictions on speech. Id. at 1036. The ordinance was also problematic
because it had a one -size -Fits -all approach that allowed picketing at the property line for large
lots with homes that were set back but, as is the case with protests directed at Congressman
Correa, forced picketers several lots away from their target audience in neighborhoods with
smaller lots. Id.
The San Diego County ordinance was also a lot more restrictive than targeted residential
picketing laws upheld by other courts. Id. The Eighth Circuit, for example, upheld an ordinance
in Douglas v. Brownell, 88 F.3d 1511, 1520-21 (8th Cir. 1996), that banned picketing directly in
front of a targeted residence but permitted picketing across the street. That same year, the Eighth
Circuit struck down a ban that prohibited picketing within 200 feet of a targeted residence.
Kirkeby v. Furness, 92 F.3d 655, 660 (8th Cir. 1996). Other courts have also banned restrictions
over 200 feet. See, e.g., Murray, 138 N.J. at 232-33 (banning a 300-foot restriction). The draft
ordinance, like the San Diego ordinance, is thus on the more extreme and restrictive end of
residential picketing laws that courts have upheld. The draft ordinance is particularly concerning
in a city like Santa Ana, where the City Council has historically shown a commitment to civil
rights and liberties by adopting progressive policies following robust public discourse. There is
no reason why Santa Ana should have more restrictive protest laws than Arkansas, a state in the
Eighth Circuit that is not known for its respect for civil liberties.
While the proposed ordinance may be likely to survive a facial constitutional challenge in

Protesting is a fundamental right protected by the first amendment, an individuals right to protest should not be
limited in any way shape or form. Elected officials are supposed to represent their constituents, not lobby
groups.
Lately protests have been aimed towards the conflict in Gaza. A conflict where 10's of thousand innocent lives
have been taken by Israel's collective punishment. Individuals wanting to silence/limit free speech primarily
argue that "conflict on foreign soil does not affect us". That is incorrect, billions of American tax dollars are
given to foreign countries such as Ukraine and Israel annually for military use. The American people have the
right and responsibility to voice their concerns over this, especially when elected officials turn their backs on
them.

Targeted Residential Picketing. The City of Santa Ana (City) must refuse to trample upon the
fundamental right of its residents to protest. Approving this ordinance will not only set a bad
precedent across the City, but across the County and State. Instead of limiting the rights of
residents, the City should focus on fostering open dialogue and engagement between elected
officials and the communities they serve.
The right to peacefully protest is a cornerstone of democracy, allowing individuals to voice their
concerns and hold elected officials accountable. This ordinance comes on the heels of a series of

Dear Mayor Valerie Amezcua and Santa Ana City Council Members,
We write to express strong concerns about the draft ordinance regarding "targeted residential
picketing."
This draft ordinance follows other City actions to stifle First Amendment activity, such as the recent
media policy that, while in effect, had heavily restricted journalists' ability to capture photos and
footage in the City Council chambers. Much of the escalation in restrictions on First Amendment activity
in Santa Ana began shortly after a Council meeting in which the primary topic of debate was whether
to allow Santa Ana voters to decide to expand the local electorate. It is deeply unfortunate that, while
Santa Ana has made strides towards bolstering inclusivity and supporting its working-class residents,
much of what the City Council has been most well-known for during the past several months is its
antagonism towards constituents and their First Amendment rights.
The decisions made by elected officials reach for into the privacy of everyone's homes and affect even
the most intimate aspects of daily life. To insist that certain ramifications of those decisions should not
touch officials in their own private residences is to declare that elected officials deserve more
protection than the people they govern. It is clear that the draft ordinance proposed in Agenda Item
#24 is intended to chill First Amendment activity and shield officials from the inconvenience of hearing
constituents voice dissatisfaction at failures of leadership.
If Council Members are so adamant about chilling First Amendment activity, then they should
adequately and thoroughly explain to the public why the provisions of the draft ordinance, such as the
very wide buffer distance or the penalties, are necessary. Are there many recent examples of
constituents being targeted with picketing at their homes for their political activism or other work that
might warrant such action, in the spirit of the San Jose ordinance referenced in the proposal? Although
the language of the draft ordinance may, on its face, be neutral, it is clear that it is first and foremost
about shielding elected officials rather than the public.
We strongly encourage the Santa Ana City Council to focus on the more pressing task of making Santa
Ana more affordable, inclusive, and resilient instead of continuously developing new proposals and
policies that discourage residents from exercising their First Amendment rights.

I urge you to vote no on agenda item #24, it proposed ordinance that will restrict our right to protest in residential areas. The ordinance comes on the heels of a
series of protests in front of Congressman Lou Correa's house due to his continued silence as more and more elected officials and people across the country dill for

Politicians are supposed to be for the people, not the other
way around. If it's inconvenient for specific politicians to be
protested by their constituents and neighboring
communities then perhaps they should listen to the people

it's fun, it's because it's essential to do everything in our
power during a serious humanitarian crisis. Genocides are
not supposed to be political. Ethnic cleansing is not

I urge you to VOTE NO ON AGENDA ITEM #24, a proposed
ordinance that will restrict our right to protest in residential
areas. The ordinance comes on the heels of a series of
protests in front of Congressman Lou Correa's house due
to his continued silence as more and more elected officials
and people across the country call for a Ceasefire in Gaza.
Since Mayor Amezcua's tenure at the city council, there
has been a clear pattern by members of the council to
curtail views they don't like including: limiting public
comments, pushing agenda items on which young people
have shown up to speak on to later into the night, and
dismissing the results of the city's own budget surveys only
because resident's responses didn't align with their world
view.
This proposed ordinance follows a dangerous pattern and
it should be rejected by all members of the Santa Ana City
Council.
Stop attempting to silence us. We have every right to
protest even in residential areas. We've followed every
noise ordinance, stayed off the streets & even brought
people to help maintain a secure & safe area. The media,
such as ABC 7 and other OC & Santa Ana media groups
have been following our action and are helping spread the
word that you're attempting to step all over our rights to
hold you all accountable.

I would like you all to please vote AGAINST the proposed item that would restrict the community from peacefully
protesting near a politician's home. (Or any home.).
The right to peacefully protest must be protected. This is part of the American government and always has been. How
can we say we live in a free country if we can't protest? We can't. This would set a dangerous precedent for Orange
County and move us toward fascism. Besides, in a purely practical way, a 300 foot buffer zone will not make the
protesters go away. They will just be closer to other people's houses, at a distance of 301 feet from the actual recipient
of the action. How does that make any sense? It doesn't.
This entire thing would be solved if the recipient of the protest would stop supporting genocide. We just want peace.

Mayor and City Council Members,
I am writing in opposition of Item 424. It's quite embarrassing that some of our local elected officials are
wanting to limit our first amendments rights by adopting distance requirements for residential picketing in light
of recent demonstrations at Congressman Lou Correa's home, as well as demonstrations outside of his office
and outside of a reelection fundraiser for Mayor Amezcua. This is what comes with these positions of power;
constituents are demonstrating to elected officials that their representatives are not representing what is morally
right. This is especially true when said elected officials have been avoiding and willfully ignoring the interests
of their constituents, as well as acting in harmful ways. Residents want their voices to be heard and if their
representatives are not willing to meet and listen to them, they have had to resort to demonstrating as the only
means to be heard. Protestors are asking for the end to the genocide of Palestinian people and instead of calling
for a ceasefire to represent what the majority of their constituents want, Lou Correa and Valerie Amezcua are
being cowardice and coercive by trying to implement this ordinance. PLEASE DO NOT ADOPT THIS

Restricting protesting is an attempt to provide cover for shameful complicity with genocide - particularly the complicity
of electeds like Lou Correa. We're not okay with genocide and we're not okay with them covering for genocide while
sweeping us under the rug with this proposal.
We know its uncomfortable to stand for genocide Lou, but highjacking our freedom of speech and using your neighbors
as human shields is not the answer. I personally won't stop protesting and if Correa wants the image of silencing

We know that for electeds like Amezcua and Correa, it can be hard to understand, or be courageous enough to
understand, that kids are literally being starved and bombed to pieces, if protestors are so bad then why aren't the
protestors arrested already Lou Correa? The police are there every time!
Lou Correa just needs to talk to his constituents about what's really impacting them, engage with them in a meaningful
and productive way, he needs to do what he's elected to do!
And if someone can tell Lou Correa to stop wagging his tail to AIPAC, the whole world is calling for a ceasefire, even

This is a clear political ploy to benefit one or two elected officials, who skirt engaging with their constituents
and abpid responsibilies of answering to the public.

Dear Mayor and Councilmembers,
I am writing to you as a community member to urge a rejection of Item 424 which restricts the right to protest in
residential areas. As long of protesters are peacefully organized and outside the private property, as well as
following other local ordinances, there is no justification for restricting the right to organize other than to
silence opinions you do not like. It impedes on the constitutional rights to assemble and exercise free speech. It
is a slippery slope that will make these rights conditional in the city of Santa Ana. Additionally, it is clearly
targeted at protests taking place outside the property of a Congressmember. These protests have been peaceful
and followed existing ordinances. It is people's right to demonstrate against an elected civil servant who is not
following the will of their constituents —in this case, refusing to acknowledge a ongoing genocide, an
international crime of the highest order. Some of the protesters being targeted are community members who are
directly affected by this genocide, both in relations overseas and by bigotry arising here at home. This
community is doing what is in its power to reach the ears of Washington, something some of you have urged
them to be doing rather than coming to the local council. Yet, it is this very act that you are trying to limit.
All in all, this is a motion clearly targeted at a group who have been following laws and exercising their rights.
By making this limited to certain areas, you are sending the message that free speech is conditional in Santa
Ana. Do not be the council that restricted these rights at an important moment in history.

It is clear that you do not stand with the demands of your constituents or with the masses of people around the world who are boldly calling for a

My name is Shirin Senegal, a Palestinian American and Canadian citizen, and I along with a few
individuals led the Cease Fire in the City of Long Beach. I'm the progeny of survivors from the 1948
Nabka, an event that led to the displacement of 750,000 Palestinians and the loss of thousands of
lives. My heritage is intertwined with a narrative of displacement, occupation, and resilience.
As a child, I vividly recall feeling a void in my heart, an emptiness I later understood as a common
sentiment among Palestinians worldwide. This sense of loss emanates from our collective history and
the ongoing struggles of my people. Despite this, we take pride in our origins from the Holy Land and
the responsibility we bear towards it. Yet, the landscape of our coexistence changed with the advent
of Zionist colonial projects, creating divisions in communities that once lived harmoniously.
My upbringing emphasized unity among people, regardless of their backgrounds. This philosophy
resonated with me as I moved to this country, where I built a diverse community that became my
family. As an entrepreneur and nonprofit leader, I've advocated for women, communities of color, and
individuals impacted by the justice system.
However, the current situation in Gaza brings me profound pain. My family, residing there, faces
unimaginable hardships: homes and businesses destroyed, a lack of basic necessities, and living in
constant fear and danger. This situation is a daily reality for my cousin and his family, who recently
endured torture and now live in fear as violence surrounds them. Their resilience and faith in the face
of such adversity are a testament to the Palestinian spirit.
Yet, this struggle is notjust about Palestinians. It's about human dignity and the right to live in peace.
I've dedicated my life to serving various communities, drawing inspiration from my Islamic faith, which

emphasizes compassion, community, and charity. However, I've often hesitated to advocate for
Palestinians, aware of the political repercussions that accompany such actions.
I question why there's such a concerted effort to suppress voices that stand with Palestine. True
righteousness doesn't fear scrutiny. It is evident that the road to change is fraught with challenges
and discomfort. Yet, we cannot be passive in the face of injustice. Imagine if that was your family, your
community that you wanted the murder and displacement of on a daily basis. Would you want laws to
prevent you from fighting for their freedom and safety?
Our current situation is not only a Palestinian issue but also reflects broader concerns about the
allocation of resources and the need for domestic focus. Billions of dollars are sent overseas while
pressing issues, such as homelessness, persist within our borders. This allocation of resources raises
ethical and moral questions, especially considering the humanitarian crises perpetuated by these
policies.
Mayor, as the first female Mayor of Santa Ana, your role extends beyond political affiliations; it
encompasses the safety and welfare of all families, mirroring the values of inclusivity and diversity that
America represents. This isn't about one nation or one people; it's about humanity, freedom of
speech, and creating spaces for dialogue and healing.
For the Council members advocating a Cease Fire, your humanity shines through this decision. While
advocate for a refinement in language to prevent unintended consequences of inciting further
violence or hate towards our communities, I recognize and appreciate this progress, especially given
the considerable opposition faced. To those Council members who have been critical of the
community's responses, I implore you to exhibit empathy and understanding. Imagine if you were in
our shoes, grappling with the loss of family members or witnessing your community suffer in extreme
conditions. It is unreasonable to expect us to remain passive 'good victims' while facing vitriolic and
privileged opposition that escapes accountability due to its status.
I urge you not to pass the proposed ordinance as it contradicts the principles of free speech and
silences critical voices. This moment calls for unity and bridge -building, not further division. We
should be fostering an environment where every voice, especially those marginalized for so long, can
share their pain, joy, hope, and dreams.

I am not in favor of Agenda Item 424. Protest and the ability to gather is a fundamental characteristic of
democracy. To compromise that in anyway is not in the interest of the public good.

To the Council, especially Mayor Amezcua,
As a community member and teacher, I am incredibly embarrassed by the actions of the council as of late, but today's
agenda has pushed me to voice my concerns. To know that the council would even CONSIDER the idea of violating the
first amendment is abhorrent and makes me wonder if some on the council are fit to sit in those positions they
obviously value more than the US Constitution. To try to limit your citizen's right to safely and peacefully protest is a
move that is dipping into fascism, and one that is obviously part of a personal agenda. Any protests that have occurred
recently have been 100% legal, safe, and peaceful, and do not warrant any kind of corrective behavior. To attempt to
stifle the opinions of the community, a community which has deep ties to Palestine whether you like it or not, simply
because you are not in agreement and you feel threatened, is a slippery slope that Santa Ana cannot afford to continue
down. This country was founded on political protest and it continues to be instrumental in making positive change.
Before considering this agenda item, consider your constituents and the rights afforded to us by the Bill of Rights. Just
because Lou Correa may lend you political support, does not mean he is immune to public criticism. Mayor Amezcua, be
better lest you be voted out. You shame us time and time again but it is not too late to do right.

Madam Mayor and Councilmembers:
Today, you will be voting to update an ordinance that regulates demonstrations in front of
residential homes. I ask that you support the modifications to the existing ordinance for the
benefit of our neighbors and for the betterment of our civil discourse. The proposed ordinance
has drawn attention to ongoing demonstrations in front of my home, and I wanted to share my
experience.
Recently, demonstrators have come to my home as early as 6:30 am on weekends and stayed as
late as 9.00 pm on weekdays with bullhorns and sirens. While demonstrators claim to be civil
and peaceful, the reality is much different. Many of my neighbors have shared with me their
anger and distress because of these demonstrations. I ask you to consider their experiences as
you deliberate this ordinance.
As an elected official, I understand the importance of public activism and have personally
participated in many movements. I also know that part of my job includes listening to those who
might disagree with me on policy. I have made a career standing up for our community, even
when my decisions were not universally popular. However, I do not believe there is a place for
taunts, personal insults, and other targeted aggression, including toward my staff or the complete
disregard for the privacy of our neighbors. I ain concerned this type of behavior will lead to
violence.
These demonstrations, which occur outside my home while I am in Washington D.C., target and
taunt my family and neighbors using excessive noise. Typically, protesters employ these types of
tactics when they are refused meetings; however, my staff and I have met with many individuals
and groups on their issue. One of their self-appointed leaders, Omar, continues to claim that their
request is a meeting with me. The truth is I have spoken and met with Omar on numerous
occasions. We have also responded to thousands of emails on the topic. Omar would not share
whether he lives in our community or is from elsewhere, but one thing is clear, he has misstated
the facts and misrepresented my position on this issue and others.
The first time I met Omar was on December 9, 2023, at our event at the Corbin Senior Citizen
Center in Santa Ana. In the middle of the event, Omar and a few of his friends showed up
unannounced, disrupted the event, surrounded me, and began to aggressively argue with me.
They tried to bully me, they made veiled threats, while shoving phone cameras in my face. I was
at Corbin to help seniors with food deliveries and provide information on resources available to
them such as Medicare and Social Security. That disruption did not impact me as much as it took
away from those seniors in attendance looking for assistance. To my surprise, seniors stood up to
Omar and his friends and stated emphatically, "don't worry Lou, we got your back!" Moreover,
Omar Put his hands on one of my staffers, who was seven months pregnant at the time.
A few days later, I returned Omar's request for a phone call. I had a long phone conversation
with him, and it became clear his intentions are not to secure a meeting or have a policy
discussion with me. He argued and issued veiled threats while misrepresenting my position and
the facts.
We have also met with many other individuals and groups wanting to discuss similar issues in
my office, despite many arriving unannounced without an appointment and from outside our
district. My staff and I still took these meetings as a courtesy, even if it meant constituents with
appointments had to wait.
I support peaceful protests. I support public actions to raise awareness of causes. More
importantly, I support civil discourse. While many of my colleagues in Congress who are
experiencing similar disruptions, have chosen to close their offices to the public or move to
"appointment -only" access, I have remained open for constituents who need assistance or want
to meet in good faith.
I have dealt with loud and angry protesters before. In the days of President Trump, "red hats"
would show up and disrupt our events. They would also threaten and scream in Our faces. And
they even instigated fistfights. There is only so much our police can do to prevent these types of
events from escalating.
The health and welfare of my neighbors and my staff is of utmost importance to i-ne. Letting our
neighbors live a peaceful life, free from fear and distress should be a priority to us all.
As a policyrnaker, I will not allow taunts or threats to dictate my actions. As this policy debate
continues, it is important we do our best to keep such discourse civil in the public sphere and
away from people's homes.
I ask that you seriously consider how this unrestricted behavior negatively impacts our neighbors
and adopt this ordinance modification,

Hello Mayor and City Council, I would like this comment to be read as I am not able to make the meeting in person
tonight but will be joining via Zoom. Agenda item #24 is a blatant attempt to silence political dissent and is only being
discussed now, as it pertains to Congressman Lou Correa's failure to listen and respond to constituents on the genocide
in Gaza. Congressman Correa does not take meetings on this "issue" and has doubled down on his support for Israel. If
we cannot use the political channels to get our views heard and represented, we are forced to take other measures such
as protesting outside his home as protestors right now are outside Secretary of State Blinken's Home and Senator Nancy
Pelosi's home, demanding them to use their voice to represent the majority of Americans and the City of Santa Ana itself
in calling for a ceasefire in Gaza. America was founded on the principle of protest, no taxation without representation.
Voting yes to this is siding with public figures who are using their political power to further silence the public that is
speaking out against this war on civilians.

First, I call on Congress member Lou Correa to call for an immediate and permanent ceasefire now!
I am writing as a very concerned citizen regarding the proposed ordinance to prohibit public protest at private
residences. This ordinance is a direct attack on citizens right to free speech and must be rejected immediately.
Elected officials have a responsibility to be accountable to their constituents. When they ignore our demands
and instead listen to the demands of AIPAC money, we have the right to protest and make our demands clear.
Congressmember Correa has ignored our requests and allowed the murder of innocent civilians to continue in
Gaza with our tax dollars and US made missiles. This ordinance is nothing more than an attempt at silencing
dissent and is an absolute abuse of power. The proposed ordinance is a threat to the freedom of speech and
clearly targets specific communities and their allies.
I urge you to carefully consider the implications of this ordinance and its impact on the rights of Santa Ana
residents. Please reject this motion.

I support this ordinance. While I respect the First Amendment rights of those seeking to have their voices heard,
there are reasonable time, place and manner restrictions that should be imposed. Recent events have been highly
