AN 0RD~NANCE TO AMEND "SANTA ANA ~JNICIPAL CODE" BY
AMENDING SECTIONS 9116 AND 9116.1 OF CHAPTER 1 OF
A~TICLE IX REGULATING THE FREQUENCY OF APPLICATIONS
FOR AND NOTICE GiVeN ON PUBLIC HEARINGS BEFORE THE
PLANNING COMMISSION
THE COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1. That the "Santa Aha Municipal Code" be and the same
is hereby amended by amending Sec.tion 9116 of Chapter i of Article
IX thereof by adding at the end of said Section, a new paragraph in
words and figures as follows:
"After t~e Council has denied an application for a
conditional permit, variance, amendment, or other formal
petition or any request made in such application or peti-
tion, no application or petition, or request, which in the
opinion of the Planning Commission or the Council is for the
same or a Substantially similar permission or privilege, ap-
plicable to the same or approximately the same location,
need be received or considered by said Commission or the
Council for a period of six months from the date such pre-
vious application, petition, or request was denied."
SECTION 2. That Section 9116.1 of Chapter l, Article IX be
and the same is hereby amended to read as follows:
"SECTION 9116.1. Same. Notices.
All petitions under Section 9114 to Section 9114.2
inclusive and under ~ec~tion 9115 shall be set for public
hearing as follows:
(a) Not less than ten days nor more than thirty days
~ after the filing of an application or motion of the
Planning Commission the Secretary of the Planning
Commission shall, pursuant to practice defined by
the Planning Commission, set a date for public
hearing on the matter.
(b)
Not less than five days before the date of such
public hearing, public notice shall be given of
such public hearing in either or both of the fol-
lowing manners, as the Planning Commission directs:
1. By posting in front of the property under con-
sideration, a notice consisting of the words "NO-
TICE OF PROPOSED CHANGE OF USE DISTRICT BOUNDARIES
OR CLASSIFICATIOI~" or "NOTICE OF PROPOSED VARIANCE"
or "NOTICE OF PROPOSED CONDITIONAL PERMIT" (if this
type of permit is authorized by Ordinance), as the
case may be, printed in plain type with letters of
not less than one inch in height and a statement
i~ six or eight point type setting forth a de-
scription of the property under consideration, the
nature of the proposed change, variance, or condi-
tional permit, and the time and place at which a
public hearing on the matter will be held. If
more than one parcel of property is involved, then
notices if required, shall be posted not more than
three hundred feet apart on each side of the street
or streets upon which said property abuts and for a
distance of not less than three hundred feet in both
directions from said property along such street or
streets. If the parcel to which the application
applies does not abut a public street, such notices,
if required, shall be placed not more than three
hundred feet apart on the nearest public street lying
within three hundred feet of skid parcel, but need
not extend beyond a distance of three hundred feet
from the exterior limits of said parcel.
2. By mailing or delivering written notice not less
than five days prior to date of such hearing to the

owners of all lots or parcels within three hundred feet
of the exterior boundaries of the property to which the
application applies using for this purpose the last known
name and address of such owners as shown upon the County
tax roll. Such written notice shall contain the same
information as required in Sub-paragraph i above.
"Owner" as used in this section is t.he person to whom
the property is assessed on the Assessor's records.
(c) No imperfection or irregularity in said notices shall
invalidate any proceedings requiring such notices."
SECTION 3. The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be published in three issues
of the Santa aha Register, a newspaper printed, published, and cir-
culated in the City of Santa ~na, and hereby designated for that
purpose. This Ordinance shall take effect 30 days from and after
the day on whic~ it is passed and adopted.
