AND NECESSITY REQUIRE THE ACQUISITION AND IMPRo~]~ENT
DESCRIBED IN ORDINANCE NO. NS-63, ORDERING THE ACQUISITION
AND IMPROVE~{ENT AS IN SAID ORDINANCE SET OUT, FIXING AArD
ESTABLISHING THE BOUNDARIES AND DECLARING THE FORMATION OF
VEHICLE PAl{KING DISTRICT NO. I OF ~ CITY OF S~21TA AHA
WHEREAS, heretofore, on September 20, 1954, the City Council of the
City of Santa Ana adopted Ordinance No. NS-63 describing the land to be in-
cluded within Vehicle Parking District No. l, describing the land to be
acquired for parking places, containing a general description of the improve-
ments proposed to be done and calling a public hearing on November 15, 1954,
at 7:30 o'clock P.M. before said City Council for the hearing of protests and
objections, and
WHEP~, heretofore, said City Council adopted Resolution No. 54-156
approving the report of Sidney L. Lowry required by the Special Assessment
Investigation, Limitation and Majority Protest Act of 1931 and ordering a
public hearing thereon to be held November 15, 1954, and
WHEREAS, the Clerk of the Council has given due notice of said two
hearings as required by law and said hearings have been duly held.
NOW, THEEEFOEE~ THE CITY COUNCIL OF ~=HE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1. That the City Council hereby finds and declares that one
written objection to the formation of said Parking District and two written
objections to inclusions within and requests for exclusion from said Parking
District were filed, and after hearing thereon all three were denied.
SECTION 2. That the public interest and necessity require the
acquisition and improvement hereinbelow and in Ordins~ce No. NS-63 described.
SECTION 3. That the boundaries of said district are hereby fixed
and established as Fourth Street on the South, Spurgeon Street on the East,
Seventh Street on the North and Yzin Street on the West, and the land to be
included within said Parking District is described as:
That portion of Section 7, T. 5 S., R. 9 W., S.B.B. & M. in the
City of Santa Ana, County of Orange, State of California, described
as follows:
All of Blocks 15, 16, 17, 18, 23 and 24, in the "Original Town
of Santa Ama" as shown on a map thereof recorded in Book ~ at Page
51 of Miscellaneous Records of Los Angeles County, California,
and that all lands within said boundaries will be benefited.
SECTION ~. That the land upon which said parking lot is to be
located is described as:
That portion of Section 7~ Township 5 South~ Range 9 West~
San Bernardino Base and Meridian~ in the City of Santa Aua~
County of Orange~ State of California~ described as:
The North 100 feet of Block 17 as shown on a map of "Original
Town of Santa Aha" recorded in Book 2~ Page 51 of Miscellaneous
Maps of Los Angeles County~ California,
~nd that the City Attorney is hereby directed to bring an action in the name
of the City of Santa Ana in the Superior Court of the State of California in
and for the County of Orange~ for condemnation of said land~ which said land,
as in this paragraph described~ is hereby declared to be necessary and the
finding is hereby made that public interest and necessity require the acquisition
of said land in fee simple and he is directed to do all things necessary to
complete said action and obtain such fee simple title in the name of said City.
SECTION 4. That the improvements as set out in Ordinance No. NS-6~
are hereby ordered to be made and the Acting Director of Public Works is hereby
directed to proceed with the letting of a contract for the same and the super-
vision and inspection of said work as soon as title to said land has been
acquired by the City of Santa Ana.
SECTION 5. The Clerk of the Council shall certify to the passage
and adoption of this Ordinance and shall cause the same to be published once
a week for two successive weeks in the Santa Ana Independent~ the official
newspaper of the City. This Ordinance shall take effect 30 days from and
after the date of its final adoption.
