NS-t47 AMENDING THE SANTA ANA MUNICIPAL CODE TO ADOPT THE 1955 UNIFORM BUILDING CODE WITH AMEND- MENTS THERETO THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 8100 through 8115, both inclusive, of Chapter l, Article VIII of the ~anta Ana Municipal Code are here- by repealed. SECTION 2. That new Sections in words and figures as follows are hereby added at the beginning of Chapter l, Article VIII of the Sant~ Ana Municipal Code. "SECTION 8100. Adoption of Uniform Building Code, 1955 Edition..- "Those POrtions hereinafter designated of a certain document, three copies of which are on file in the office of the Clerk of the Council, being marked and designated as 'Uniform Building Code, 1955 Edition, published in 1955 by PACIFIC COAST BUILDING OFFICIALS CONFERENCE,' including Volu~e III hereof, three copies of which are likewise on file, a~e hereby adopted as the Building Code of"the City for regulating the erection, construction, enlargement, alter- ation, repair, moving, removal, demolition, conversion, occupancy, equipment, use height, area and maintenance of all buildings and/or structures in the City; providing for issuance of permits and col- lection of fees therefor; providing penalties for violation of ~h Code, and repealing all Ordinances and parts of Ordinances in con- flic~ therewith; declaring and establishing fire zones; and each and all of such portions of the regulations, provisions, penalties, conditions, and terms of such Code and hereby referred to, are hereby adopted, and made a part hereof as is fully set out in this Chapter. "SECTION 8101. Fire Zones Created. "The entire incorporated area of the City is hereby declared to be and is hereby established as a Fire District and said Fire Dis- trict shall be known and designated as Fire Zones l, 2, and 3, and each such zone shall include such territory or portions of the City as illustrated, outlined and designated on a certain map on file in the office of the Clerk of the Council, being marked and desig- nated as 'Fire Zones of the City of Santa Ana,' whic~ is hereby adopted as the fire zoning map of the City for the application of the regulations included in the Uniform Building Code, 1955 Edi- tion, published in 1955 by PACIFIC CvAST BUILDING OFFICIALS CON- FERENCE. "SECTION 8102. Portions of the Uniform Building Code Adopted. "The portions of said Uniform Building Code so adopted are as follows: "Section 101 to Section 6004, Chapters 1 to 60, both inclusive, both Sections inclusive, being of said Code; and also that Section of the Code marked 'Appendix' being Section 702 (c) to Section 5113, both Sections inclusive, on Pages 309 to 342, in~ clusive, and as herein and hereafter amended. "SECTION 8103. Moved Buildings. "Section l0t (h) of said Uniform Building Code is amended by adding at the end thereof, a new $~entence to read as follows: 'Applications and permits for moving or relocation of buildings or structures within, into, or out from the City shall be governed by Chapter 6 of Article VIII of the Santa Ana Municipal Code, as amended.' "SECTION 8104. Creation of Department. "Section ~201 of said Uniform Building Code is hereby amended to read as follows: ,There is hereby established in the City, the Department of Building Safety and Housing, which shall be under the Jurisdiction of the Building Official designated by the ap- pointing authority.' "SECTION 8105.1. Fee, Plan Checking. "Section 303 (b) of said Uniform Building Code is amended to' read as follows: 'Plan checking fees shall be charged when in the opinion of the Building Official the plans are of a critical na- ture, in such a case the fee paid shall be equal to one-half of -2- '(2) A fee of $10.00 shall be paid for such temporary use of streets in advance of the issuance of a permit for the use of that portion of any street between the street boundary line and a point seven feet from the toe of the curb nearest said street boundary line so that no area of parking or traveled roadway greate~ ~han seven feet shall be blocked from public use. '(3) No person shall store building materials or equipment in any portion of any street in any manner so that more than seven feet of the parking or traveled portion of the road- way will be in any way restricted or denied to public use except that upon application, the City Council may grant an additional area between said seven foot line and a line which will allow such storage in or blocking of a one-third portion of the roadway of the street that is adjacent to the curb in front of t~he building site, for which a permit has been issued. The grantimg of such a temporary use permit for street or alley use may be under much conditions as the City Council may require and an additional fee in an amount to be fixed by the City Council shall be paid therefor prior to the issuance of any such special permit. Section ¥~02 of said Uniform Building Code is hereby amend- ed in all respects in which the same is inconsistent with the provisions of this Section.' "SECTION 8106. Refunds. "Section 303 of said Uniform Building Code is amended by adding a new Sub-section to read as follows: ' (g) Refunds. The Building Official shall not make any refunds of fees collected amounting to $2.00 or less. In case a refand is made, the amount of such refund shall not be more than 80 per cent of the amount of the fee paid nor shall such refund include any part of the first $2.00 of such fee. No refund of such fee or part thereof shall be made unless applied for within one year from the date of the issuance of the permit. This Sub-section shall apply to fees for Building, Plumbing, Electrical and Plastering Permits. No fees or portions of fees are refundable for House Moving Ap- plications or mileage in conjunction therewith, for Use and Occu- pancy Certificate fees, Plumbing and Electrical examination fees, or Temporary Use of Streets permit fees.' "SECTION 8107. S~airway. "Section 42o of s aid Uniform Building Code is amended by chang- ing the fourth paragraph to read as follows: 'Stairway. Four or more risers ~hall constitute a stairway.' "SECTION 8108. Exceptions and Deviations. "Section 1409 of said Uniform Building Code is amended to read as follows: '(a) Group I occupancies constructed on the roof of multiple- storied buildings shall be considered as an additional story in so far as the construction, location, exposure, stairs, exits, and fire-extinguishing apparatus are concerned. 'A carport open on two or more sides need not have a fire sepa- ration between the carport and the dwelling. Doors between a dwel- ling and a carport shall be self-closing. '(b) Breezeway. A breezeway or covering of single roof con- struction with no concealed or enclosed space shall be permitted between a dwellin~ and a private garage if such buildings are at least five feet apart, provided that a passageway not less than three feet in width be permanently maintained along both sides of the dwelling, and such private garage shall then be deemed to be a detached structure.' "SECTION 8109. Restrictions in Fire Zone NO. 2. "Section 1603 of said Uniform Building Code is amended by adding a new Sub-section to read as follows: '(d) Fire-resistive construction of exterior walls shall not be required on detached Group F or Group J Occupancy buildings having an area of not more than four hundred square feet when such build- ing is ten feet or more from adjacent property line and not less than ten feet from any building on the same building site.' "SECTION 8110. "Chapter 17 of said Uniform Building Code is amended by adding a new Section to read as follows: 'Section 1712. Grouting Mudsills. Mudsills shall be properly grouted with mortar as required in Table No. 24-A, Type A, except on troweled concrete slabs. Grouting shall extend the full width of mudsills.' "SECTION8111. "Section 2501 of said Uniform Building Code is amended by adding a new Sub-section to read as follows: '(d) Infected Lumber. All wood used in any structure shall be substantially free from fungus, dry rot, termites, and all other disease or growth detrimental to lumber., "SECTION 8112. Wood Floors. "Section 3105 of said Uniform Building Code is amended by changing the third paragraph to read as follows: ~Where basements at least forty-eight square feet in area with a minimum seven foot headroom are not provided, there shall be at least one opening through the exterior foundation walls not less than eighteen inches by twenty-four inches with a movable door or screened vent. If a screened vent is constructed, such opening may be computed as a part of the required ventilation space, provided, however, any such door or screen shall be set in a metal frame.' "SECTION 8113. Stairs. "Section 3305, Sub-section (h) of said Uniform Building Code is amended to read as follows: '(h) Exterior Stairways. Every opening in the exterior wall of a building served by an exterior stairway used as a required exit shall be protected by windows of reinforced glass set in metal sash, or self-closing, tight-fitting solid wood doors, one and three-eights inches way.' in thickness, if within ten feet of such stair- -6- "SECTION 8113.1. "Section 3316, Sub-section (a) of said Uniform Building Code is amended by inserting the word 'required' between the wo~,ds 'total' and 'width' in the third line of the second paragraph.' "SECT 0N 811 . "Chapter 25 in the Appendix of said Uniform Building Code is amended by rewording the last two lines of Paragraph 2 to read as follows: 'placed within six inches of any earth, either natural ground or earth fill. '" SECTION 2. The Clerk of the Council shall certify to the passage of this Ordinance and shall cause the same to be published in one issue of the Santa Aha Independent within 15 days after its adoption. This Ordinance shall take effect 30 days from and after the day o£ ~ adop- tion.
