NS-127 AMENDING SECTIONS 3311, 3311.1, 3311.2~, 3311.3, 3311.4 AND 3311.6 OF THE SANTA ANA MUNICIPAL CODE PROVIDING FOR PAP~ING MATER HOODS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLIXMS: SECTION 1. That Sections 3311, 3311.1, 3311.2, 3311.3,~331!.4 and 3311.6 of the Santa Aha Municipal Code be amended to read as follows: "SECTION 3311. Parking Meter Hoods. Any person doing any building, construction, alteration, repair, or addition to the structural detail or part of any building, or rendering any maintenance or ja~.itor service to buildings on a contract basis in the Central Traffic Districts "A" and "B" and any public utility opera- ting maintenance or service vehicles in such traffic districts in the City may apply to the Chief of Police for a permit to use a parking meter hood. Such application shall state the name of the person, if a partnership, the names of the partners, the business address of the applicant, the nature of the business carried on by him, the fact that it is necessary to use a truck or other vehicle because of the equipment thereon, carried thereon, or the materials or machinery transported thereby, in said traffic dis- tricts. Upon approval of s aid application, the Chief of Police shall for- ward said application to the Director of Finance for the issuance of the permit applied for. Such applications shall be numbered serially and be filed by the Director of Finance. "SECTION 3311.1. Same. Issuance of Permit. Upon receipt of an application approved as hereinabove provided for, the Director of Finance shall issue a permit which shall be numbered, and each of which permits shall be accompanied by a hood bearing the same num- ber of this Chapter, a transparent window for the display of the permit here- in referred to, and a hood number, and on the reverse side, shall carry the legend in bold f ace type "NO PARKING." The permit shall further recite the date of issuance, the date upon which it expires and the nam~ and address of the permittee. No permit shall be issued to any applicant who does not hold a paid up business license in the City. "SECTION 3311.2. Same. Charges. The Piin!mum charge for any permit so issued shall be $2.00 per month or any part thereof except that a permit may be issued for a maximum period of six months, for which the fee shall be $9.00. All permittees shall, prior to the issuance or renewal of any permit, make a deposit of $5.00 fbr each hood issued, which deposit shall be returned upon the surrender of the hood in good condition to the office of the Director of Finance. "SECTION 3311.3. Same. Lost or Damaged Hoods. The loss of any permit or hood shall be reported to the Director of Finance and Chief of Police not later than noon on the next succeeding bus- iness day following the loss and the permittee shall pay to the City $5.00 for each hood lost. Permittee shall pay to the City $5.00 for any hood in his possession that becomes damaged beyond repair. In event repair be possi- ble said permittee shall pay the cost of such repair, which in no case shall exceed $5.00. The provisions for payment, in case of damage next hereinabove set out, shall not apply to damage or deterioration from normal usage or to damage by vanS~ ism or malicious mischief committed by persons other than permittee~ his agents or e~ployees. If permittee fails to return the hood and fails to renew his permit granted hereunder, by paying the charges hereinabove fixed therefor, within seven days of the expiration of said permit, he sh~ll pay to the City for such unlawful withholding of such hood, the s~m of $4.00. No new permit or hood shall be issued to any permittee when any payment provided for in this Section has become due and has not been paid. The determination of the cause of damage to any hood shall be made by the Chief of Police. "SECTION 3311.4. Same. Cancellation of Permit. The Chief of Police shall revoke any permit issued hereunder and imme- diately take up end return to the Director of Finance, such permit and the hood accompanying the same, for any of the following reasons. (a) ~hen the permittee has failed to pay ~ny charge provided for in this Chapter. (e) no longer exists. When permittee has failed to pay any fee provided for in this Chapter. When the circumstances or need under which the permit was granted, -2- (d) %~nen pcr~.uittee ceases to carry a business license in said Cit~% fails to pay the current business license fee due thereunder. (e) W-hen the hood is used to cover any parking meter without the display of a current unrevoked permit in the transparent window of said hood. (f) When the hood is used to cover any parking meter fO~ any purpose other than the business purposes permitted by this Chapter. (g) %~nen the hood is not removed from the parking meter Lmmediately upon the c~pletion of work for which this Chapter permits hood to be used. (h) %~hen any person other than permittee or his regular e~ployee or agent is allowed to use the hood. (i) %~rnen the hood is used to cover any parking meter adjacentto and regulating a stall where parking is 1Lmited to 2h minutes or less." SECTION 2. That Section 3311.6 of the Santa Ana Municipal Code be amended to read as follows: "SECTION 3311.6. S~ue. Issuance after Revocation. In event any parking meter hood and permit issued hereunder is revoked for violation of the terrain of this Chapter, permittee shall immediately de- liver the same to the Director of Finance upon receipt of notice of revoca- tion by mail. He may, in writing, request a hearing into the reasons for the revocation before the Council. The Council may hold such hearings dur- ing the day or at such time and place as they may designate and their de- termination shall be final. Unless the Council after hearing ~raive the revocation, no permittee shall be issued a new permit or hood within 30 days of such revocation. The Council at any hearing held, or if there be no hearing requested, the Chief of Police may extend the period during which no new permit or hood shall be issued, to, but not exceeding 180 days." SECTION 3. The Clerk of the Council sh~ll certify to the passage of this Ordi- nance and shall cause the s~me to be published, within 15 days after its adoption, in one issue of the Santa Aha Independent. This Ordinance shall ta~e effect 30 days from and after the date of its adoption.
