NS-157 AMENDING ARTICLE IX OF THE SANTA ANA MUNICIPAL CODE CREATING CHANGES IN DISTRICT BOUNDARIES AND AMENDING SNEE~TS NO. ~ and 45 OF THE DISTRICTING MAP TO SHOW THE RECLASSIFICATION WHEREAS, the Planning Commission of Santa Ana has given notice of and duly held two public hearings in connection with an appllca- tion for change of District Classification and by Resolution No. 910 recommended to the City Council the change requested; and WHEREAS, the City Council gave due notice of and regularly held a public hearing on said application And does now find that public necessity, convenience and general welfare require the fol- lowing amendment and that the uses under the new classification will not be detrimental to the surrounding property. NON, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. .That the real property described as: PARCEL 1. All that certain real property situated in the City of Santa Ana, County of Orange, State of California, described as follows: The South 120 feet of the hereinafter described real property now existing as a sight and sound barrier. Beginning at a point 21-67/96 rods North from the Northeast corner of a certain 5 acre tract of land conveyed by deed from D. H. Samis to W. C. McClay in 1874, said 5 acre tract being the Southeasterly portion of that lot of land known as the Samis Tract; thence West 73-11/13 rods to the land of D. H. Samis; thence South 21-67/9~ rods to the land of W. C. McClay; thence East.a~o~g said McClay's North line, 73-11/13 rods; thence North 21-b?/9b rods to the point of beginning, EXCEPT that portion of said land conveyed to the California Central Railway Company by deed recorded July 30, 1887 in Book 271, Page ll2, of Deeds of Los Angeles Count~ California. ALSO EXCEPT all that portion thereof described as follows: Beginning at a point 21-67/96 ~ods North from the Northeast corner of that certain tract of land conveyed by deed from D. H. Samis to.W.C. McClay, recorded February l, 1875 in Book 36, Page 51 of Deeds of Los Angeles County, California; thence South along the center line ~f McClay Street to a point on the North- easterly right of way line of the California Central Railway Company (now Atchison, Topeka and Santa Fe Railway), as shown by deed recorded in Book 271, Page ll2 of Deeds of Los Angeles Coun- ty, California; thence Northwesterly along said right of way line to a point on the North line of that certain parcel of land con- veyed.to J. D. Foster on August 28, 1885 by deed recorded in Book b7, Page 355 of Deeds of Los Angeles County, California; thence East along said North line to the point of beginning. PARCEL 2. That certain real property situated in the City of Santa Ana, County of Orange, State of California, described as follows: Beginning 60 rods North of the Southeast cor~er of Section 18, Township 5 South, Range 9 West of the San Bernardino Meridian; thence~North 97-1/2 rods; thence West 73-11/13 rods; thence South 97-1/2 rods; and thence East 73-11/13 rods to the point of begin- nibs, reserving a strip of land 30.00 feet wide on the East side for road purposes and a strip of land 20.00 feet wide on the West side for railroad purposes. PARCEL 3. Lots 5, 6 and 7 of the Smith & Maley Subdivision of the McClay Tract, in the City of Santa Aha, County of Orange, State of California, as per map recorded in Book 22, page 96 of Miscel- laneous Maps, Records of Los Angeles County, California. PARCEL 4. The West half of the following: Beginning 195 rods South of the corner of Sections 7, 8, 18, and 17, Township 5 South, Range 9 West of the San Bernardino Meridian, in the City of Santa Ana, County of Orange, State of California; thence East 98-6/13 rods; thence South 6~ rods; thence West 98-$/13 rods; and thence North 65 rods to the point of beginning, all parcels constituting approximately 73 acres, be reclassified from R-1 and R-3 Districts to the M-1 DisTrict and that Shee~ No. 44 and 45 of the Districting Map of Article IX of the Santa Ana Municipal Code be amended to show such reclassification. SECTION 2. The Clerk of the coUncil shall certify to the pas- sage of this Ordinance and shall cause the same to be published within 15 days after its adoption in one issue of the Santa Ana Independent. This Ordinance shall take effect 30 days from and after the date of its adoption.
