OF THE SANTA ANA MUNICIPAL CODE REGULATING THE KEEPING OF DOGS
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1. That Part 1, Chapter 1, Article IV of the Santa Aha
Municipal Code is hereby amended by amending Sections 4110, 4111.3,
and
4112, 4113, 4114,/4117 to read as follows:
"SECTION 4110. Definitions.
For the purpose of this Ohapter the following words and
phrm~es shall be construed to have the meaning herein set forth
unless it is apparent from the context that a different meaning
is intended.
DOG shall mean any male, female or neuter dog over the age
of six months.
UNLICENSED DOG shall mean any dog for which the license
tax has not been paid for the current fiscal year, or any dog to
which a current license tag is not attached as provided for in this
Chapter.
KENneL shall mean any lot, building, structure, inclosure,
premises, or place whereon or wherein three or more dogs are kept
or maintained for the purpose of breeding, training, raising, mar-
keting, boarding or as pets; provided, however, that a ~all animal
hospital, regularly licensed and maintained or managed by a
licensed veterinarian shall not be deemed a kennel.
QUARANTINE shall mean the isolation of a dog or puppy under
six months of age, in a substantial inclosure so that said animal
cannot be subject to contact with othe~ animals or unauthorized
persons.
ANIMAL CONTROL MAN shall mean the employee of the City who
is charged with the enforcement of the p~ovisions of this Chapter
and his regularly appointed deputy.
OWNER shall mean any person having title to, keeping, or hat-
boring any dog for a period of seven consecutive days, except a
duly licensed veterinarian having custody for the purpose of
treating or boarding.
VACCINATION shall mean the inoculation of a dog with canine
rabies vaccine approved by the County Neat and Livestock Inspec-
tor of the County of Orange.
VICIOUS DOG shall mean any dog ~hich is known to have bitten
any person.
SECTION 4111.3. Vaccination Required before Licensing.
Neither the Finance Department, the Animal Control Man, or
any other person shall issue any license for any dog unless and
until such dog has been vaccinated as herein defined and the owner
or person seeking such license shall produce for inspection, a
Certificate from a licensed veterinarian showing vaccination with-
in the preceding twenty-four months, which Certificate may be ac-
cepted as proof of vaccination. Any dog may be exempt from vacci-
nation and license issued therefor without such proof upon pre-
sentation of an Affidavit sworn to within sixty days preceding
the application for license, by a Veterinarian licensed to prac-
tice and actually practicing in the State of California, stating
that in his opinion, the rabies vaccination would be likely to
seriously injure the dog described therein. No person shall al-
low any dog so exempt from rabies vaccination to run at large or
be led about the streets on a leash at any time, and such dog
must be restricted to the securely inclosed yard of the owner.
SECTION 4112. License Tax Imposed.
(a) A license tax is hereby levied on all dogs over the age
of six months, owned, kept, harbored, or in the custody or under
the control of any person within the City, at the rate of three
Dollars for each dog for each two year period, beginning July l,
1956 and upon the first day of every July of every even numbered
year thereafter, payable in advance. Any person importing, any
dog into the City or owning any puppy that reaches the age of
six months after the first quarter of said licensing period has
expired may be granted a license upon the pa~ent of three
quarters of license tax; after one-half of the licensing period
has expired, may be granted a license upon payment of one-half
of said license tax; and after three-fourths of the licensing
period has expired, may be granted a license upon payment of one-
fourth of said license tax. No renewal of an existing license may
be made at a reduced fee without satisfactory proof that the dog
has not been subject to such license tax during the expired portion
of the license period. The Finance Department may provide for
nepal of dog licenses by mail.
(b) Said license tax shall be deemed a debt due the City
from the owner and in addition to the criminal penalties of this
Code provided for, such debt may be collected in the name of the
City as any other debt may be collected. The foregoing license tax
shall not apply to any dog while kept in a duly licensed kennel
nor to any seeing eye dog trained to assist blind persons while
such dog is actually being kept and used by a blind person for the
purpose of aid in going from place to place.
SECTION 4113. Information Required, Record and Tag.
Upon payment of ~ne license fee, the Finance Department or
the Animal Control Man shall issue to ~e owner, a license certificate
and a metallic tag for each dog so licensed. The shape of the tag
shall be changed every two years and shall have stamped thereon,
the te~nination date and an identifying number. Every owner shall
be required to provide each dog, not kept in a kennel, with a collar
to which the license tag must be permanently affixed and shall see
that the collar and_t~g are continuously worn by said dog. In case
a dog tag is lost or destroyed, a duplicate will be issued by the
Finance Department upon presentation of the receipt showing payment
of the license fee for the current license period and upon payment
of the fee fixed for the issuance of such duplicate tag. No owner
shall transfer any dog tag from one dog to another and no person
shall place a dog tag upon any dog except the dog for which it was
issued. The dog collar or harness worn by the animal shall have
the name and address of the owner inscribed thereon.
SECTION 4114. Record of License and Tag.
The Finance Department and the Animal Control Nan shall keep
a record of the license tags issued which record shall contain a
brief description and the name of the dog and the name and address
of the owner.
SECTION 411?. Redeeming Dogs.
In order to redeem any dog that has been impounded, the re-
quirements of the Orange County Pound must be complied with. All
dogs impounded and placed in said Orange County Pound shall be
subject to the rules and regulations thereof."
SECTION 2. The Clerk of the Council shall certify to the pas-
sage of this Ordinance and shall cause the same to be published within
15 days after its adoption, in one issue of the Santa Ana I~ependent.
This Ordinance shall take effect 30 days from and after the date of its
adoption.
