0RD~NANCE N~. ~ AMENDING SECTIONS 5302.1, 5305, 5306, 5305, 5308, AND---'~ OF THE SANTA ANA I~UNICIPAL CODE ~G~AT~N~ OROHA~O HEA~RS. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 5302.1 is hereby amended to read as follows: "Section 5302.1. Same. Any person desiring a permit to operate any heater may file an application so to do wi~h .the County Agricultural Commissioner, the Air Polution Control Officer of Orange County, or such other person as may be designated to issue the same. Such application shall give the following information: (a) The location and extent of the area proposed to be heated for protection from frost damage. (b) The name and address of the owner thereof. (c) The types of heaters and the number of each type for which a permit is requested. (d) The type and kind of fuel proposed to be used in said heaters. (e) A statement that all heaters are in good operabing condi- tion, that all parts fit properly and tightly, are clean and free of carbon, soot and sludge residuee ' ' · ~.~ ~"'' ~ (f) Such additional information as may be ~equired by the is- suing officer. (g) Execute or sign any affidavit or statement regularly re- quired by the issuing office or officer of the County of Orange." SECTION 2. That Sections 5305, 5306, 5307, 5308 and 5309 are hereby amended to read as follows: "Section 5305. Approved Heater Types. After the first day of OctOber, 1957, no combustible material of any kind shall be used, burned, or oxidized for the protection of trees, shrubs or plants from frost damage, in uninclosed areas, except in a heater as herein defined ~d under the conditions herein set forth. This prohibition does not apply to such heating by natural gases, lie~ified petroleum gases, electricity, wind machine, steam,°~ot water. (a) Class I Heaters are any type of heater which is so de- fined and equipped that it will not discharge unconsumed solid carbonaceous r~tter at a rate in excess of 1/2 gram per minute. Class I Heaters include Pipeline Systems, including Kittle Heaters; Universal Return Stack Heaters, its equivalent or better; Briquet or Coke heaters only ~%en used with briquet or coke, and will b e enlarged to include any heaters which are shown by competent test to come within the definition of a Class I Heater. (b) Class II Heaters are hereby permitted for use only when the draft regulator is so adjusted as to permit a meximum air orifice within the limitation indication below for such heater. Permits for Class II Heaters shall set forth the maximum air orifice permitted for each type covered by the permit, and no person shall burn any Class II Heater inthe City with an ori- Fice or an opening greater than that permitted on such permit or set forth herein below, except for the first five minutes after the heater is lighted. No heater discharging unconsumsd solid carbonaceous matter at a rate in excess of one gram per minute shall be considered a Class II heater and no such heater may be used within the City." "Section 5306. Prohibition of Sale of Heaters. No person shall sell, offer for sale, or for use, within the City any orchard heater other than those herein designated as Class I and Class II heaters, nor shall any Class II heater as herein defined be sold or offered for sale or use unless ~ I parts are tight fitting a and the primary air orifice is within the maximum allowable specifi- cations herein above set out for the particular heater after October 1st, 1957-" "Section 5307. Heater 0il Specifications. No person shall burn any fuel in any Class II heater within the City after October 1, 1957 which does not conform to the following minimum specifications: A distillate fuel meeting the following specifications: 1. Gravity °API (American Petroleum Institute) at 60© F.-- 31 Min. (ASTM (American Society for Testing Materials) D-287-39). 2. Flash point minimum 150° F. (Pensky-Martens Closed Testor ASTM Designations: D-93). 3. Distillation: initial (minimum 350° F.; 90%--625© F. max- imum end point 700© F. (maximum): 98% recovery minimum. 4' Carbon residue, bottom 10%, 0.5% (maximum). 5. Sulphur content, per cent by weight, 0.80% (maximum). If oil meeting the above specifications is not available, then in lieu of the above specifications any oil sold, delivered, or used for the purpose of orchard heating shall meet the minimum ASTM specifica- tions of #2 fuel oil or ~2 deisel fuel, and before sale or delivery shall be processed and/or have included therein an additive to sus- pend or homogenize the heavier fractions of the oil with the lighter fractions in order to decrease self-distillation or cracking processes when burning in an orchard heater." -3- "Section 5308. Suspension of Permits. When there exists or has occurred, in the opinion of the County Agricultural Commissioner ~ d his staff, or the Control Officer under the Air Polution Control District of Or~ ge County, any violation of this Chapter, such enforcing officer shall give written notice to the permit holder stating the violations and the ~easons for his action and such notice shall suspend the permit of such violator to operate the orchard heaters,.in violation, or concerned in any way with the violation. If the conditions causing the suspension may be corrected and, in the opinion of the Control Officer further violations of the same nature are adequately Prevented by such correction, he sh~ 1 rein- state the permit upon the completion of such corrective measures. At the time of suspension the Control Officer shall file with the City Council a petition for the continuation of the suspension or the revocation of the permit concerned, and said petition shall be heard at the next meeting of the City Council occurring more than four days ~fter said suspension, unless the petition is sooner withdrawn by the Control Officer. In no event shall suspension of a permit by the Control Officer continue in effect past the date of the first meeting of the City Council occurring more tha~ four days following the effective date of such suspension, unless the suspension is continued by the City Council. Nothing in this Section shall be construed to deny to any permit holder his full rights of appeal to the City Council from the de- cision of the Control Officer. If permit holder desires to appeal, he shall file a written statement containing all of the facts upon which he desires to rely with the Clerk of the Council, City Hall, Santa Ana, and shall serve a copy thereof on the Control Officer, both filing a~d .service ~to be made at ~ ast three days prior to the next meeting of the City Council." -4- "Section 5309. Orange COUnty Procedures Adopted. All permits, regulations, definitions and requirements set out in this Chapter shall confonm as to period of time, dates, days, and determination of compliance with any and all rules adopt- ed by the Air Po~ution Control District of Orange County."
