NS-365 A~IENDING PART 3 OF CHAPTER 3 OF ARTICLE VI OF THE SANTA ANA MUNICIPAL CODE, REGULATING POOL HALLS THE CITY COUNCIL OF TITE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That Part 3 of Chapter 3 of Article VI of the Santa Aha Municipal Code, is hereby amended to read as follows: Part 3 ~- Pool and Billiard Halls Section 6330. Regulations. For the regulation and proper supervision of all busi- nesses where ga~es of billiards, pool or bagatelle are conducted for profit, the same shall be carried on in a single room without partition, anti-rooms or closet rooms, other than water closets or lavatories and entirely inac- cessible from any other room, cellar or attic, provided, however, that the main e~rance or vestibule from the public street shall have glass panel doors. The same to be at all times clean, unglazed and unobstructed so that all parts of said room will be open to view. Section 6331. Application for permit. Any person desiring to engage in any business where games of billiards, pool or bagatelle are conducted for profit shall first make application in writing to the Council, which shall have the sole power and authority to grant a permit to engage in said business. The Council shall have full power to grant or reject said pe~ntt and, after in- vestigation if it shall appear to the Council that said person is a proper person and suitable, that the l~ation and arrangement of the proposed place where said business is to be conducted is satisfactory, the Council shall grant said permit, otherwise it shall reject and deny the same. Section 6332. Right to Control. The Council, in granting a permit or license for the carrying on of said business, reserves the right at all times to determine where said games may or shall be carried on and the character and nature of the building, its surroundings and arrangement and constr~ction and its accessibility and suitability for the purpose of the con- duct of said business. The character, reputation and liability of the person conducting said business and of his employees shall be considered. Section 6333. Entrance Kept Open. The entrance to and into said rooms, at all times dur- ing business hours, shall be open and unobst~.cted to all peace officers and to all members of the public other than minors under the age of 18 years. Section 6334- Certain Games Prohibited. No games of cards, dice or other games of chance shall be carried on in any room in which any of the above busi- nesses shall be conducted or in any room accessible therefrom. Section 6335. Minors. No person under the age of eighteen years shall visit, enter, engage in any ws~ or loiter in or about any room where the aforesaid gaines are being conducted. Section 6336. Hours of Business. All Billiard aud Poolroom parlor businesses operated in the Cit.y shall be closed between the hours of 12:30 A.r~. and 6.30 A.M. Section 6337. Revoking Permit. In addition to the penalties provided for violation of this Code, the Council may revoke any permit given to carry on or conduct a business where games of billiards, pool, or bagatelle are conducted for profit, for any violation of the provisions of this Part, and for repeat- ed violations of law in said place of business. Before such revokation the permittee shall be given notice and accorded a hearing before the Council, as provided for hearings set forth under Part 1 of this Chapter. If the Council determines, after such hearing, that the permittee has willfully violated the terms of this Part 3, or has so conducted his business as ~ have repeated fights, disturbances, batteries or other violati, ons of law occurring in his place of business, the permit shall be revoked or may be continued upon such conditions as the Council may impose. Section 6338. Exceptions Bowling Alleys. %~T~en any room is m~ntained where the games of billiards, pool or bagatelle are conducted for profit, which room is maintained in a building or place wherein are maintained ten or more bowling alleys, all under the same management, which building or place is kept open on a 24-hour basis, the room where billiards, poo~ or bagatelle are plsyed shall be exempt from the requzre~ents of Sections b330 and 6336, except that the entrance to said room or place shall be at all times open, or have clean, unglazed glass, so as to give unobstructed view into said room. SECTION 2. This Ordinance shall become effective thirty days from and after its adoption.
