NS-~66 DECLARING THE RESULT OF THE CANVASS OF THE RETURNS OF THE ELECTION IN THE TERRITORY KNOWN AS "SULLIVAN AND EDINGEH ANNEX" AND APPROVING THE ANNEXATION OF SAID TERRITORY TO THE CITY OF SANTA ANA WHEREAS, heretofore a petition was presented to the City Council requesting that certain territory hereinbelow described be annexed to the City of Santa Aha under the provisions of the Annexation Act of 1913, and the City Council on October 6, 1958 adopted Resolution No. ~, expressing the consent of said Council to the commencement of proceedings under said Act; and WHEREAS, thereafter a notice of intention to circulate petition for said annexation was regularly published, and on the 17th day of October, 1958, the City Council adopted Resolution No. %8-259, ac- knowledging receipt of a copy of said notice of intention to circu- late petition, a copy of the statement accompanying said notice, and an affidavit of publication thereof, and approving the circulation of petition for annexation; and WHEREAS, thereafter a petition was regularly circulated and filed with said City Council, representing more than one-fourth of the qualified electors residing within said territory, and on the first day of December, 1958 said City Council adopted Resolution No. 58-297, declaring intention to call special municipal election on the question of annexation, and fixed a day and hour for the fil- ing and hearing of protests to said election on the part of owners of property within said territory; and W/iEREAS, at 8:00 P.M. on the 29th day of December, 1958, the day and hour so fixed, no protests had been filed and no person was there present to file any written protest against said annexation, and the City Council continued said hearing to 5:00 P.M. on January 8, 1959, at which day and hour no protests had been filed, and the City Council adgpted Resolution No. 59-15 calling a special annexa- tion election to be held in said territory on the 10th day of March, 1959, and thereafter on January 19, 1959, adopted Ordinance No. NS-359 calling, ordering and providing for said election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: 1. That a specisl municipal election was in all respects duly held on Narch 10, 1959, and that the votes cast thereat were duly ~nd regularly canvassed and the returns thereof made at the time and in the form and manner required by law; that the absent voter ballots have been duly canvassed and counted, as required by law; that this City Council has duly canvassed the retuz~s of said election and from said returns and canvass it appears, and this Council finds, that the proposition or measure submitted to vote of the voters was in words as follows: Shall the territory designated ( ' ) "Sullivan and Edinger Annex" be ( YES t ) annexed to the City of Santa Ana?( NO t ) , that the total number of votes cast at said election was Sll , in- cluding votes for and against said proposition; that 239 votes were cast in favor of said proposition and that 72 votes were cast against said proposition; t~at there was only one voting precinct in said territory; that said c~uvassing took place at the hour of 7:30 P.M. in the Council Chambers of the City Hall, Santa Aha, Call- fore, ia at the first regular meeting of said City Council after the date of said election. 2. That the territory designated "Sullivan and Edinger Annex" was contiguous to the City of Santa Ana, was in the County of Orange, State of California, and was and is described as follows: Beginning at the southwest corner of Tract No. 506 as shown on a map thereof recorded in Book 17, pages 26 and 27, Mis- cellaneous Maps, Records of Orange County, California, said southwest corner being an angle point in the city boundary of the City of Santa Aha, California, and running thence along said city boundary on the following courses: Easterly along the southerly line of said Tract No. 506 to the westerly line of Old Newport Road (50°00 feet wide); thence northeasterly along the westerly llne of said 01d Newport Road to its intersection with the westerly extension of the south line of Tract No. 737 as shown on a map thereof recorded in Book 22, page 42, Miscellaneous Maps~ Records of Orange County, California; thence North 89° 29' 40" East alone said south line and its extension of said Tract No. 737, 295.60 feet; thence North 0° 30' 20" West 31.13 feet; thence North 89 29 . 40 East 660.00 feet, thence South 0 30 20 East 31.13 feet; thence North 89° 29' 40" East 62.03 feet; thence North 2° 45' 36" West 60.05 feet; thence South 89° 29' 40"fWest 59.67 feet; thence North 0° 30, 20"~West 1,036.13 -2- feet along the East line of Center Street (60.00 feet wide) to the north line of Edinger Street said north line being 25.00 feet north of center line; thence South 89° 20' 40" West 658.00 feet along said north line of Edinger Street; thence North 0° 16' 20" West 410.60 feet; thence North 89° 29, 40'' East 628.00 feet to the east line of Tract No. 13~? as shown on a map there- of recorded in Book 42, page 13, Miscellaneous Maps, Records of said Or, ge County, California; thence North 0° 16, 20" West along the east line of said Tract No. 1347 and along the east line of Tract No. 1346 as shown on a map thereof recorded in Book 41, page 3,!Miscellaneous Maps, Records of Orange Cg~nty, California, to the no,east corner of said Tract No. 134~$ thence westerly along the north line of said Tract No. 1346 to the southeast corner of Tract No. 604 as shown on a map thereof recorded in Book 24, page 19, Miscellaneous Maps, Records of Orange County, California; thence northerly along the East line of said Tract No. 604 to the south line of Fai rview Avenue (60.00 feet wide); thence westerly along said south line to the west line of Sulliv~ Street (60.00 feet wide); thence southerly along said west line of Sulliv~ Street, said west line being the east line of Sulliva~ and F~ rview Northwest Annex, to the south line of the north 800.00 feet of Section 22, Township 5 South, Range 10 West, San Bernardino Base and Meridian; thence westerly along said south lire, said line being the south line of said Sulliva~ and Fairview Northwest Annex, to the southwest corner of said Sulliva~ and Fairview Northwest Annex; thence northerly along the westerly line of s~ d Sullivan and Fairview Northwest Annex to the northwest corner thereof; thence easterly along the northerly line of said annex 86.10 feet to a~ angle point in said city boundary; thence along the following tvo courses, (bearing based on Sulliv~ Street bearing due North): North 414.66 feet; thence North 89° 48, 30" East 1,263.90 feet to the center line of said Sulliva~ Street; thence North along said center line of Sullivan Street ah along said city boundary 550.26 feet; thence West along said city boundary to the west- erly boundary of the Rancho Santiago de Santa Aha; thence north- easterly along said westerly boundary of said Rancho Santiago de Santa Aha and along said city boundary to the center line of First Street; thence westerly along said benter line of First Street to the easterly right of w~ line of the former Newbert Protection District right of way for the ch~nel of the Santa Aha River and to an angle point in said city boundary; thence departing from said city boundary southwesterly along said easterly right of w~ line of the fenner Newbert Protection District right of way for the channel of the S~ta Aha' River to the northwest corner of Croddyland Annex No. 1 annexed to City of Santa Aha by Ordinance NS-184 filed with the county recorder on June 28, 1 956, as instrument number 88686; thence easterly along the north line of said Crodd~land Annex No. 1, 2,703.86 feet; thence along th? following courses; (Bearing based on 01d Newport Road bearing South 15° 05' 40" West): North 0° 30 i0 West 178.05 feet, thence North 15 47' 53" East 2,513.10 feet to a point onthe arc of a curve concave southwesterly having a radius of 970.00 feet, the radial line through said point bearing North 11° 11' 15" East said curve be- ing on the southerly property line of Edinger Street as described in Book 2115, page 392 of Official Records of Orange County, California; thence southeasterly along said curve to its point of intersection with the southerly line of Edinger Street as shown on a map of Tract No. 1024 recorded in Book 33, page 33, Miscellaneous Maps, Records of Orange County, California; thence southeasterly and easterly along said south line of Edinger Street as show~ on said map of Tract No. 1024 to a point on the arc of a curve concave northeasterly having a radius of 1,030.00 feet, said curve being on the southerly property line of Edinger Street as described in Book 2115, page 392 of -3- Official Records; thence southeasterly along said curve to a tangent line which bears North 89° 30' 00" East; thence North 89° 30' 00" East along said tangent line which is parallel with and 30.00 feet southerly, measul'ed at right angles, f~om the center line of Edin~er Street, 364.99 feet to the West line of said Tract No. 306; thence South 15° 16, 40" West 1,299.75 feet along said west line of T~act No. 506 to the Southwest corner thereof and to the point of beginning. 3- That as the result of said canvass the City Council hereby finds and declares that the majority of the votes cast at said elec- tion were for annexation to said territory of the City of Santa Ana and said territory is hereby declared to be annexed to and, from the effective date of this O~dinance, shall become and be a l~rt of the City of Santa Ana, California. 4. That this Ordinance shall take effect 30 days from and after the date of its a~ption.
