NS-367 DECLARING TH.w, RESULT OF THE CANVASS OF THE RETURNS--6F THE SPECIAL ANNEXATION ELECTION IN THE TERRITORY E~OWN AND DESIGNATED AS "WEST SANTA ANA ANNEX" AND APPROVING AND DECLARING TEE ANNEXATION OF SAID TERRI- TORY TO THE CITY OF SANTA ANA, CALIFOP~NIA WHEREAS, heretofore the City Council of the City of Santa Ana adopted Resolution No. 58-243, in response to a petition for annexa- tion of certain territory consenting to the commencement Of proceed- ings under the Annexation Act of 1913, and thereafter the proponents of said annexation published notice of intention to circulate a petition for said annexation, and thereafter filed a copy of said published notice, together with an accompanying statement and affi- davit showing the publication of the same; and WHEREAS, upon receipt of said documents said City Council adopted Resolution No. 58-260 acknowledging the receipt of said documents and approving the circulation of said petition, and said petition was duly circulated, filed with, and examined by the Clerk of the Council of said City, and the County officer having charge of the registration of voters, and the certificate of said two of- ricers was filed with and shewed to said City Council that said petition had been signed by 49-09 per cent of all of the registered electors in said territory within a period of four days from the commencement of the circulation of said petition, that is, more than one-fourth of the o~ualified electors had signed a petition for annexation; and WHEREAS, said City Council thereon adopted Resolution No. 58-296 declaring its intention to call a special election to submit the question of annexation of said territory to the City of Santa Aha to the electors residing in said territory, designating "West Santa Ana Annex" as an ~l~opriate name by which said territory was to be referred to upon the ballots used at said election, and fixed December 29th, 1958, at 7:30 P.M. in the Council Chambers of the City Hall, Santa Ana, California, as the day and hour for ov~ne~s to show cause why said territory should not be annexed, and/or to file protests against said election; that at said hour it was determined that protests had been filed by less than one-half of the value of said territory, and said protest hea~ng was continued to 5:00 P.M., January 8, 1959, for the filing of further protests; and WHEREAS, at said continued hea~ ng additional protests had been filed and that all of said protests represented an assessed value in the amount of $316,690.00, and that the assessed value of the territory was $1,969,290.00, and it was determined and declared that the protests represented only 16 per cent of the assessed value of the territory and that the owners of one-half of the value of the territory proposed to be annexed, as shown by the last equalized assessment roll of 0range County, had not protested against said election; and '.tHEREAS, the City Council thereupon declared that it had come to their attention that the boundaries of said "West Santa Ana Annex" had inadvertently overlapped or included a small portion of Garden Grove Annexation No. 63, and that said overlapped or included area was less than one-half of I per cent of the "West Santa Ana Annex", and directed that the boundaries of said annexation be a~ended, as permitted by Gca~rnmen~deSection 35121.5, to exclude said small por- tion of overlapped territory, that the new boundary description, to- gether with a new map, be submitted to the 0r~ge County Boundary Commission, and ~hen approved as to definiteness and certainty that it should be used in all future documents and matters relating to said "West Santa Ana Annex"; and WHEREAS, said City Council thereupon adopted Resolution No. %9-14 declaring said facts and fixing the date of March 10, 1959, for a special municipal election on the question of annexation, and thereafter adopted Ordinance No. NS-360 ordering, calling, and pro- viding for a special municipal election to be held in said territory on March 10, 19~, to determine the question of said annexation; and WHEREAS, said election was regularly held on the 10th day of March, 1958, and the ballots at said election presented the following proposition to the electors within said territory: -2- Shall the territory designated ( YES', ) and known as "West Santa Ana ( ) Annex" be annexed to the City ( ' ) of Santa Aha? ( NO , ) and on the 16th day of March, 1959, at the first regular meeting of said City Council occurring more th~ three days after said election, said City Council did meet au d canvass the returns of said election. That the votes cast at said 1518 121 1639 it is hereby declared that a majority of special municipal election on the question of annexation were cast for the annexation, and that the territory designated "West Santa Ana Annex", which was and is contiguous to the City of Santa Ana, in the County of Or~ ge, State of California, and was and is described as follows: Beginning at an angle point in the City boundary of the City of Santa Aha, California, said angle point being the inter- section of the north line of Seventeenth Street (80.00 feet -3- wide) and the easterly right of way line of the former Newbert Protection District Right of Way for the Channel of the Santa Ana River; thence North 89° l~' 40" East along said north line of Seventeenth Street, and along said City boundary 48.7 feet to a point in the northeasterly extension of the monu- mented center line of King Street and to an angle point in said City boundary; thence northeasterly along the westerly boundary of the Rancho Santiago de Santa Aha and along said City'boundary to its intersection with the easterly extension of the north line'of Trask Avenue 20 feet northerly measured at right angles from the center llne of said Trask Avenue; thence westerly along said north line and its easterly extension to the west line of Berrydale Street 30 feet westerly measured at right angles from the center line of said Berrydale Street, snd to the existing City boundary of the City of Garden Grove, Cali- fornia; thence southerly along.said west line of Berrydale to the north line of Tract No. 1369 shown on a map thereof recorded in Book 43, page 17, Miscellaneous Mmp s, Records of Orange County, California; thence westerly along the nc~ th line of said Tract No. 1369 to the northwest corner thereof and to s~ d City boundary of Garden Grove, California, and to the east line of the west half (W 1/2) of the southeast quarter (SE l/4) of Section 3, Township 5 South, R~ge l0 West, San Bernardino Base and Meridian; thence northerly along said southerly prolongation and along said east line to the north line of the south half (S 1/2), of the south half (S 1/2), of the south half (S 1/2), of Section 16, of said Township and Range; thence easterly along said nort~ line and its easterly prolongation, to the westerly right of way line of the former Newbert Protection District right of way for the Channel of the Santa Aha River; thence northerly along said west line of the foEner Newbert Protection District right of way for the Channel of the Santa Ana River to the north line of Fifth Street (60.00 feet wide); thence easterly along s~d north line to its intersection with the northeasterly prolongation of the westerly line of the Bernstein Fifth Street Annex as annexed to the City of Santa Ana, October l, 19~6, by Ordin- ance NS-213; thence southwesterly along said northeasterly prolongation to the northwest corner of said Bernstein Fifth Street Annex and to the center line of said Fifth Street; thence easterly along the center line of Fifth Street and along said City boundary to the center line of King Street; thence in a general northerly direction along said City bound- ary of the City of Santa Ana to the point of beginning, is hereby declared to be and it is ~nexed to and, from the effective date of this 0rdinsnce, shall become and be a part of the City of Santa Ana, California. SECTION 3. That this Ordinance shall take effect 30 days from and after ~he date of its adoption. PASSED AND ADOPTED by the City Council of the City of Santa Ana at 1959.
