ANA ~Ui~ICIPAL CODE TO REGULATE THE LICENSING OF PAWNBROKERS
~AGtEREAS, the business of pawnbroking has, in many instances,
been a source of trouble to local governmental agencies and particu-
larly to law enforcement of ficers throughout this State and elsewhere,
and in many areas is leading to dangerous, undesirable, unfair and
in some cases, unlawful practices by the operators of pawnbroking
establishments, to the detriment and injury of the citizens, and
the Council has determined the desirability of regulating such es-
tablishments in the City of Santa Ana;
NOW, THEP~FORE, THE CITY COUNCIL OF THE CITY OF SANTA ~A
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Article VI, Chapter 3, Part 9 of the Santa
Ana t.,~unicipal Code is hereby ~uended by adding new Sections immed-
lately following Section 6391.4 in words and figures as follows:
"Section 6391.5. Definition.
For the purposes of this Part, every person
in Section 21000 of the Finauce Code of the
California shall be deemed a pawnbroker.

Section 6391.6. Application for Certificate.
Every person desiring to engage in the business of a
pawnbroker shall first make written application to
the Chief of Police of the City, stating his name, age,
residence address, proposed business address, the busi-
ness addresses of all other businesses in which he has
an interest, a statement of the time, place and circum-
stances of each and eve~ time he has been arrested for
any purpose, a statement of the number of employees he
will have in such place of business, the names and ad-
dresses of such employees then known to applicant, and
shall submit himself and each of said employees for the
purpose of having photograohs and fingerprints taken.
Section 6391.7. Granting and Revoking Certificate.
If the Chief of Police finds that the applicant or any
proposed employee has been convicted of a violation of
any statute of this State or Ordinance of this City,
regulating pawnbrokers, or has been convicted of any
crimes involving theft, embezzlement, fraud or false
pretenses, or moral turpitude, he shall refuse to issue
a Certificate directed to the Finance Officer authorizing
him to accept payment of a business license tax from
applicant. Any Certificate issued hereunder may be re-
voked for any reason which would justify a refusal to
issue the s~me. No person shall carry on the business
of a pawnbroker within the City without first receiving
the Certificate herein referred to, from the Chief of Police,
and a clearance as to himself and as to each of his employees
as herein provided for Qr after the Certificate herein re-
ferred to has been revoked, and no person shall employ any
person in such business who would be disqualified hereunder
from obtaining a Certificate to operate such business as
herein provided for, or until such employee has been submitted
to the Chief of Police for checking, as provided for in
Section 6391.6
Section 6391.8. Appeal to Council.
Any person who is refused a Certificate or whose Certificate
is revoked as provided for herein, may appeal the entire
question to the City Council and said appeal shall be regu-
lated by the provisions of Section 6389 of this Code.
Section 6391.9. Hours of Pawnbroker Operation.
No pawnbroker, a~d no person employed by any pawnbroker,
shall accept any item in pawn nor make any loan on any item
of personal property except between the hours of 7 A. M. and
? P. M. of any day."
SECTION 2. This Ordinance shall become effective 30 days from and
after the date of its adoption.
