N$-~3~ ORDERING AND PROVIDING FOR A SPECIAL ~UNICIPAL ELECT--~0 BE HELD IN THAT TERRITORY DESIGNAT~ "SOUTH SA~WTA ANA ANNEX NO. 2" ON APRIL 26th, 1960, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS IN SAID TERRITORY THE QUESTION OF ANNEXATION TO THE CITY OF SANTA ANA WHEREAS, heretofore all of the steps necessary for the initia- tion of annexation procedure under the Annexation Act of 1913 have been completed as required by law, including the adoption of Resolu- tion No. 60-16 detailing the proc e dures and providing for a special election to be held on April 5, 1960 for submission to the electors residing in the territory herei~below described the q~estion of annexation of said territory to the City of Santa Ana; and WHEREAS, a mandamus proceeding No. 86382 has been filed in the Superior Court of Orange County, California, has not yet been decided, and an Alternative Writ of :andate has been issued by said Court restraining the City from proceeding with said annexation, thereby tolling the statutory requirement that said election be held within 75 days of the final protest hearing. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF sANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That the original date fixed for a special election on the question of annexation is hereby canceled and ch~ged, and a special election is hereby called and ordered to be held on the 26th day of Apr,.l, 1960, in that certain territory hereinbelow described, and designated as "South Santa Ana Annex No. 2", and said name is declare~ to be the na~e by which said territory shall be indicated upon the ballots at s~id election. Said territory lies in the County of Orange, State of California and is described as: -1- SOUTH SANTA ANAANNEXNO. 2 AS A~ENDED Beginning at a point on the center line of Edinger Street, 1,53~.00 feet westerly fn~m the intersection of the center lines of Edinger Street and Bristol Stree% said point of beginning being an angle point in the City boundary of the City of Santa Ana~ California, said point also being the point of intersection of the center line of Edinger Street with the northerly extension of the West line of Lot 3 as shown on a record of survey map filed in Book 3, page 29~ Records of Surveys in the Office of the County Recorder of Orange County, California, thence southerly along said West line of Lot 3 and its extension and along said city boundary~ 659.6h feet to the southerly line of the tract of land described in de~d to H. F. Rogers and wife dated September 6~ 1927, and recorded in book 87, page 28 of Official Records of said Ornage County, and to the South line of said Lot 3~ and to an angle point in said city boundary; thence easterly along said South line of Lot 3 and along said city boundary 15.OO feet more or less to an angle point in said city boundary, and to the East line of that certain property described as Parcel i in deed to James A. Lukens and Florence B. L~kens dated June 19, 1958, and recorded in book 4351, page ~38, Official Records of said Orange County; thence southerly slong said East line 658.14 feet more or less and along said city boundary to the north line of Tract No. 2P08 as shown on a map thereof recorded in Miscellaneous Nap Book 6h~ pages 23 and 9&, Records of ~aid Orange County, and to an angle point iu said city boundary; thence westerly along said c~ty boundary and along said North l~ne of Tract No. ~208 to the Northwest corner of said Tract No. 2P08, and to an angle point in said city boundary; thence Sontheasterly and Southerly along the westerly line of said Tract No. 7208 and Tract No. 2207, per M.M. 62/23,2~ and along said boundary to the North line of Section 96~ Township 5 South, Range l0 West, San Bernardino B~se and ~eridian, and to an angle point in said city boundary; thence westerly, Southwesterly and Southerly along the northerly and Westerly line of the "Delhi and Bristol S. W. Annex" as established by the City of Santa Ana Ordinance NS 272 passed on August 1957 to the North line of "Segerstrom Annex No. l" as established by the City -2- of Santa Ana Ordinance NS-193 passed on July 16,1956, and to an angle point in said city boundary thence westerly, southerly, easterly, and northerly along the boundary of said "SegerstromAnnex No. l" to the Southwest corner of "Wild Annex" as established by Ordinance NS-120, passed August l, 1955, and to an angle pofnt in said city boundary~ thence northeasterly along the southeasterly line of said Wild Annex to the Southwest corner of "Antone Borchard Annex" established by Ordinance NS-53 passed July 19, 1954; thence northeasterly along the southeasterly line of said "Antone BorchardAnnex" to the Southwest corner of "Delhi and. Main S. W. Annex" established by Ordinance NS-318 passed on April 21, 1958; thence northeasterly along the southeasterly line of said "Delhi and Main S. W. Annex" to the west line of "Glorietta Addition" established by Ordinance No. 903, passed December 16, 1929, and to an angle point in said city boundary; thence southerly and easterly along the boundary of said "Glorietta Addition" to the Northwest corner of "Main and Newport N.E. Annex" as established by Ordinance N8-320 passed May 5, 1958, and to an angle point in said city boundary; thence southerly along the west line of said "Main and Newport N. E. Annex" and along said city boundary to its intersection with a line which is parallel with and 30 feet southeasterly, measured at right angles, from the center line of Newport Avenue, and to an angle point in said city boundary; thence departing from said city boundary westerly in a straight line at right angles to said east line of Main Street to the northwesterly line of that property conveyed by Harvey L. Bear and Lillian M. Bear ko the State of California by a deed dated February ll, 19h2, and recorded in Book ll~l, page 149 of Official Records of Orange County, California; thence southwesterly along said northwesterly line to its inter- section with the northwesterly line to the 50 foot strip of land described in deed to the Se~te of California recorded in Book 783~ page &~O of said C~ficia/ Re~rd~: thence southwesterly along said northwesterly line of said 50 foot strip of land to its intersection with the north line of Baker Avenue, said north line being 40 feet northerly, measured at right angles, from the center line of Baker Avenue) thence westerly along said North line of Baker Avenue to the west line of Lot 3 in Block E of the Berry Tract as shown on a -3- -3- map recorded in Book 30, page 74, ~iscellaneous Records of Los Angeles County, California; thence northerly along said west line of Lot 3 to the South line of the North half of said Lot 3; thence easterly along said South line of the North half of Lot 3 to the east line of the west one acre of the north half of said Lot 3; thence northerly along said east line to the southerly line of Paularino Avenue, said sout~rly line being 33.00 feet southerly, measured at right angles, from the center line of Paularino Avenue; thence westerly along said south line of Paularino Avenue and its extensions, to its intersection with the Southerly extension of the East line of Bear Street, said East line being 25 feet Easterly, measured at right angles, from the centerline of Bear Street; thence northerly along said East line of Bear Street and its extension to its intersection with the North line of Block C in said Berry Tract; thence Easterly along said North line of Block C and along the North line of Block D in said Berry Tract to the east line of Bristol Street 80.00 feet wide, as described in Book 2290, page 511 of Official Records of Orange County, C~lifornia; thence northerly along said East line of Bristol Street to the North line of Sunflower Avenue, said North line being 25 feet northerly, measured at right angles, from the center line of said Sunflower Avenue; thence Westerly along said North line of Sunflower Avenue to the East line of Bear Street, said East line being 25 feet easterly measured at right angles, from the centerline of said Bear Street; thence northerly along said East line of Bear Street to the North line of Wakeham Avenue, said North line being 25 feet northerly, measured at right angles, from the center line of said Wakeham Avenue; thence westerly along said North line of Wakeham Avenue and its Westerly extension to the West line of Fairview Road, as it extends southerly from Wakeham Avenue said West line being 30 feet Westerly measured at right angles, from the c~ter line of Fairview Road ( Old Newport Road): thence Southerly along said west line of Fairview Road to the North line of Huntzinger Avenue, said North line being 20 feet northerly, measured at right angles, from the centerline of Huntzinger Avenue; thence Westerly along said North line of Huntzinger Avenue to the East boundary of the "Huntzinger and Harbor N. The proposition to be presented to the electors and to be printed upon the ballots used at said election shall be in the following words: Shall the territory designated and ( known as "South Sas ts Aha Annex No. ( YES , ) 2" be annexed to the City of Santa ( NO ' ) &ua? The precinct boards and two judges for each polling place. shall consist of one inspector The precincts shall be those determined by the City Council by Resolution, and sh~l consist of one or more regular voting precincts or portions thereof, and the voting place or places shall be such as is commonly used for voting within the territory, if there be any such place or places within the territory herein described. The election officers shall be thee nmned in the "NOTICE OF ELECTTON OFFICERS AND POLLING PLACES" to be declared as to form by the City Council. The Clerk of the Council ~ hereby authorized to find and appoint substitutes for any election officer named who is unable or unwilling to act. SECTION 4. Precinct officers shall receive the following com- pensation: Each inspector, $21.00, aud each judge, ~18.00, for their work as such officers, and owners of privately owned polling places shall receive the sum of ~9.00 for the use of each polling place. SEC~TION ~. Said election shall be held and conducted in accord- ance with the statutes regulating municipal elections, the Election Code of the State of California, insofar as the same is applicable to this election, and the Annexation Act of 1913. The polls shall be open from ? A.M. until 7 P.M. on the day of said election and the polls shall be closed at 7 P.M. SECTION 6. The C~rk of the Couucil shall cause a NOTICE OF ELECTION and a NOTICE OF ELECTION OFFICERE ~TD POLLING PLACES to be published once each ~veek for four weeks prior to April 26, 1960, in a newspaper of general circulation p~inted and published outside the City of Santa Ana, but in the County of Orange. -7- SECTION 7.
