N$-~ ADOPTING BY REFERENCE A PLUM~ING CODE KNOWN AS "ORANGE EMPIRE PLUMBING CODE - 1961" PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY, AND THE QUALIFICATION AND REGISTRATION OF PERSONS ENGAGED IN THE BUSINESS OF PLUMBING, OR LABORING AT THE TRADE OF PLUMBING; REQUIRING PERMITS AND INSPEC- TIONS FOR THE INSTALLATION OR ALTERATION OF PLUMBING AND DRAINAGE SYSTEMS; DEFINING CERTAIN TERMS; ESTABLISHING MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING AND DRAINAGE SYSTEMS AND THE INSPEC- TION THEREOF; PROVIDING PENALTIES FOR ITS VIOLATION; AND REPEALING CONFLICTING ORDINANCES; AND AMENDINGSECTIONS 8200, 8201 and 8202, AND REPEALING SECTIONS 8203, 8204, 8205, 8206, 8207, 8208, 8209, 8212, 8213, 8214, 8215, 8216, 8217, 8218, 8219, 8220, 8220.~, 8221, 8222, 8223, 8224, 8225, 8226, 8227, 8228, 8229, 8230, 8231, 8232 AND 8233 OF CHAPTER 2, ARTICLE VIII OF THE SANTA ANA MUNICI- PAL CODE THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 8200 of Chapter 2, Article VIII of the Santa Ana Municipal code is hereby amended to read as follows: Section 8200. Adoption of Oranqe Empire Plumbinq Code - 1961. There is hereby adopted by the City of Santa Ana for the purpose of providing for the protection of the public health and safety and the qualification and registration of persons engaged in the business of plumbing, or laboring at the trade of plumbing; requiring permits and inspections for the installation or alteration of plumbing and drainage systems; establishing minim%u~ regulations for the installation, alter- ation or repair of plumbing and drainage systems and the inspection thereof in the City of Santa Ana, that certain code known as the "ORANGE EMPIRE PLUMBING CODE - 1961" and the whole thereof, save and except such portions as are hereinafter amended, of which code not less than three (3) copies have been and now are on file in the office of the Clerk of the Council~of the City of Santa Aha, and said Plumbing Code is hereby adopted and incorporated as fully as if set forth at length herein as provided for in Section 419 of the Charter of the City of Santa Ana, and from the date on which this Ordinance shall take effect the provisions thereof, subject to the amendments and addition hereinafter set forth, shall be placed within the limit of the City of Santa Ana, and this Code shall be known as the "PLUMBING CODE OF THE CITY OF SANTA ANA". SECTION 2. That Section 8201 of Chapter 2, Article VIII of the Santa Aha Municipal Code is hereby amended to read as follows: Section 8201. Plumbinq Code Adopted. Amendments. The amendments to said Plumbing Code referred to in Section 8200 of this Part and which are hereby made to said Plumbing Code are as follows: -1- 1. That Section 73.012 of said Plumbing Code is hereby amended to read as follows: Sec. 73.012. ~.dministrative Authority and Assistants. Whenever the term "Administrative Authority" or "Superintendent of Building Safety" is used in this Code it shall be construed to mean the Director of Building Safety or his authorized representative. That Section 73.013 of said Plumbing Code is hereby amended to read as follows: Sec. 73.013. Assistants. Whenever the term "Assistants" is used in this Code, it shall be construed to mean the Inspectors designated by the Director of Building Safety. That Section 73.014 of said Plumbing Code is hereby amended to read as follows: S~c. 73.014. Department Havinq Jurisdiction. Unless otherwise provided for by law, the office of the Administrative Authority shall be the Department of Building Safety and Housing. That Subsection (a) of Section 73.0111 of said Plumbing Code is hereby amended to read as follows: Sec. 73.0111. To Whom Permits May Be Issued. (a) No permit shall be issued to any person to do or cause to be done any plumbing or drainage work regulated by this Code, except to a person holding a valid unexpired and unrevoked Plumbing Contractor's Certificate of Qualification or Registration as required by Section 73.023, (UPC 2.3) except when and as otherwise hereinafter provided in this Section; or any person, firm or corpora- tion who holds a valid Contractor's license in the proper classification, issued by the State of California to perform such work. (Such person, firm or corporation may be required to show proof of such license.) That Section 73.159 of said Plumbing code is hereby amended to read as follows: Sec. 73.159. Prohibited Locations. No water heater which depends on the combustion of fuel for heat shall be installed in any room used or designed to be used for sleeping purposes, bathroom, clothes closets, or in any other closet or other confined space opening into any bath or bedroom. Where not prohibited by other regulations, water heaters may be located under a stairway and landing. SECTION 3. That Section 8202 of Chapter 2, Article VIII of the Santa Aha Municipal Code is hereby amended to read as follows: -2- Section 8202. Addition to Plumbinq Code. The addition to said Plumbing Code referred to in Section 8200 of this Part and which is hereby made to said Plumbing Code is as follows: 1. That Section 73.0212 is hereby added to said Plumbing Code to read as follows: Sec. 73.0212. Election to Not Create or Organize Board of Plumber, Examiners. The City of Santa Ana hereby elects not to create or organize any Board of Plumber Examiners for the purpose of examining and issuing certificates to journeyman plumbers and maintenance plumbers or any other class of plumber other than Plumbing Contractor, and in this regard, the City does hereby declare that any individual employed by a Plumbing Contractor who is a bona fide possessor of a valid certificate of competency issued by the Board of Plumber Examiners of the County of Orange qualifying the holder of such certificate to wor]c at =ne trade or calling of plumber for salary or wages, but who does not furnish any materials or supplies in the execution of his work, will be recognized in the same capacity and class of plumbers and upon the same certi- ficate in the City of Santa Ana so long as such person continues to hold such certificate and the same has not been revoked or suspended. SECTION 4. 8209, 8212, 8213, 8221, 8222, 8223, 8232 and 8233 of chapter 2, code are hereby repealed. That Sections 8203, 8204, 8205, 8206, 8207, 8208, 8214, 8215, 8216, 8217, 8218, 8219, 8220, 8220.1, 8224, 8225, 8226, 8227, 8228, 8229, 8230, 8231, Article VIII of the Santa Ana Municipal SECTION 5. This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
