NS-~47 REGULATING THE OPERATION OF FOOD VENDING AND DELIVERY TRUCKS AND WAGONS WHEREAS, the population of the City has rapidly increased during the past ten years, and the City has an established and continuing program of street widening, improvement and extension which is unable to maintain the physical street and highway system of the City in a condition to afford vehicular movement without restrictions or interference due to the large number of vehicles upon the streets of the City and due to the increased number of vehicles parked on the streets of the City, which said ~arked vehicles use one traffic lane for parking purposes: and WHEREAS, the streets of the City have the primary purpose of affording moving traffic an area for use in getting from place to place and to permit a secondary use of less importance, the parking and temporary storage of vehicles on the highest cost parking area existing in the City; and WHEREAS, it has come to the Council's attention that there is presently violation of our minimum parking regulations of trucks and trailers on the streets during the night time and new business ventures being conducted from trucks which are permanently parked on the street for long periods for the purpose of selling foods and drinks upon the streets of the City and not for the purpose of delivery to the home or business of the consumer. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 2 of Article III of the Santa Aha Municipal Code is hereby amended by adding thereto a new section numbered 3263 in words and figures as follows: "SECTION 3263. Regulating On Street Parking of Food Vendinq Trucks. No person shall park, stop or stand any wagon, cart or vehicle upon any part of any street of the City and leave the same so stopped, parked or standing in any one location -1- for a period of time longer than five (5) minutes for the purpose of selling or delivering any food or drink from such wagon, cart or vehicle, and no operator or person shall make a second stop after moving from the last place of parking, stopping or standing within a distance of fifty ($0) feet of the first place of park- ing, stopping or standing. The City Council hereby expresses its intent to permit the traditional delivery or vending of beverages and foods from wagons, carts and vehicles from house to house through the residential areas of the City, but declares its intention to prohibit any such conveyance being used as a store of stationary location for the sale of such wares upon the streets of the City, said streets being for the primary purpose of providing traffic ways for moving vehicles." SECTION 2. This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
