HomeMy WebLinkAboutNS-749ORDINANCE NS- 749 AMENDING PART 2, CHAPTER 6 OF THE SANTA ANA MUNICIPAL CODE REGARDING THE SANTA ANA MUNICIPAL STADIUM THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Part 2, Chapter 6 of the Santa Ana Municipal Code is hereby amended to read as follows: PART 2 - SANTA ANA MUNICIPAL STADIUM SECTION 2620. Regulations. Ail use, rental occupancy and control of that certain property belonging to the City, located upon the west side of Flower Street between 6th and 8th Streets, known as the Santa Ana Municipal Stadium, which includes the Stadium and the area surrounding the Stadium to the fenced boundary thereof, shall be under the terms, conditions and pro- visions of this Part. SECTION 2621. Permits. Permits for use of the Stadium will be issued by the Recreation and Parks Department. A cash deposit of $25.00 will be required with applications filed by other than school users. Applicants must agree to comply with the rules and regulations issued by the Recreation and Parks Department with the approval of the City Manager. Cash deposits will not be refunded. School users will account for their sales, will not be required to make a deposit for use of the Stadium, and will render final accounting and remit payment within ten days after each event. Other users will be required to pay the minimum fee five days in advance of scheduled dates and to render final accounting and payments within three days after each use. SECTION 2622. Rental Rates. 1. Rental rate for an event where no admission charge or free will offering is taken (to cover school practices, graduation exercises, band practices, rehearsals, or similar uses) shall be: Night Use Requiring Flood Lights Day Use Dressing Rooms $10.00 per hour 5.00 per hour 25.00 for each occasion 2. Rental for a scholastic or a charitable event, where an ad- mission charge is made or where a free will offering is taken, shall be a minimum of $200.00 each day, $250.00 each night, or 15% of the gross value of all tickets sold for the event, whichever is greater; provided, however, there shall be no rental fee upon receipts in excess of the first $15,000.00 on any one game, exhibition, athletic event or other use. 3. The rental for a commercial event, where an admission charge is made, shall be a minimum of $250.00 each day, $300.00 each night, or 15% of the gross value of all tickets sold for the event, whichever is greater; provided, however, there shall be no rental fee upon receipts in excess of the first $30,000.00 on any one game, exhibition, athletic event or other use. 4. Where a show, athletic event, or other activity consists of more than one performance, each performance (as distinguished from act) shall constitute a separate event within the terms of this schedule. SECTION 2623. Liquor. No intoxicating liquors shall be sold or consumed upon the premises known as the Santa Ana Municipal Stadium. SECTION 2624. Concessions, Etc. The City reserves unto itself the exclusive right at the Stadium for the vending or renting of merchandise or the granting of concessions therefor, of broadcasting, televising, transcribing or recording any and all exhibitions, games, performances, speeches, entertainments or programs, and no person may do any of the things or exercise any of the rights herein reserved exclusively to the City, without first having obtained from the Council a permit in writing therefor. SECTION 2625. Insurance, Responsibility for Damages. Any person using the Santa Ana Municipal Stadium shall be responsi- ble for any damage or injury to the structures or facilities maintained by the City therein, caused by such person or by the exhibition, per- formance, game or acts. All users of the Stadium shall furnish proof that the City and its officers and employees are "named-insured" on indemnity insurance policies in sums not less than $500,000 personal injury and $100,000 property damage. SECTION 2: This ordinance shall take effect thirty days from and after the date of its adoption.
