HomeMy WebLinkAboutNS-911ORDINANCE NS-911 AMENDING THE SANTA ANA MUNICIPAL CODE TO AMEND SECTIONS 4110., 4111.2., AND 4112. OF PART 1, CHAPTER 1, ARTICLE IV THEP~EOF RELATING TO LICENSING AND VACCINATION REQUIREMENTS OF DOGS WHEREAS, the California Department of Public Health has declared Orange County to be a rabies area within the meaning of Sections 1901.2 and 1920 of the California Health and Safety Code which necessitates the amendment of certain Santa Ana Municipal Code Sections to incorporate the necessary changes to bring the Code up to standard in regard to rabies vaccinations and Santa Ana City licenses; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 4110 of Part 1, Chapter 1, Article IV of the Santa Ana Municipal Code is amended to read as follows: Section 4110. Definitions. For the purpose of this Chapter, the following words and phrases shall be construed to have the meanings herein set forth, unless it is apparent from the context that a different meaning is intended: DOG Any male, female, or neuter dog over the age of four (4) months; UNLICENSED DOG Any dog for which the license tax has not been paid for the current fiscal year, or any dog to which a current license tag is not attached as provided for in this Chapter; KENNEL Any lot, building, structure, inclosure, premises, or place, whereon or wherein three or more dogs are kept or maintained for the purpose of breeding, training, raising, marketing, boarding, or as pets; provided, however, that a small animal hospital, regularly licensed and main- tained or managed by a licensed veterinariar~ shall not be deemed a kennel; QUARANTINE The isolation of a dog or puppy under four (4) months of age in a substantial inclosure so that said animal cannot be subject to contact with other animals or unauthorized persons. ANIMAL CONTROLMAN The employee of the City who is charged with the enforcement of the provisions of this Chapter, and his regularly appointed deputy. OWNER Any person having title to, keeping, or harboring, any dog for a period of seven (7) consecutive days, except a duly licensed veterinarian having custody for the purpose of treating or boarding. -1- VACCINATION VICIOUS DOG The inoculation of a dog with canine rabies vaccine approved by the Director of the Division of Veterinary Public Health, Orange County Health Department. Any dog which is known to have bitten any person. SECTION 2: That Section 4111.2 of Part 1, Chapter 1, Article IV of the Santa Ana Municipal Code is amended to read as follows: Section 4111.2. Possession of Unvaccinated Dog Prohibited. No person shall keep, harbor, or maintain upon his premises, or have title to, any dog over four (4) months of age within the City of Santa Ana when said dog has not been vaccinated as required by this Part, except as otherwise provided herein. SECTION 3: That Section 4112 of Part 1, Chapter 1, Article IV of the Santa Ana Municipal Code is amended to read as follows: Section 4112. License Tax Imposed. (a) A license tax is hereby levied on all dogs over the age of four (4) months owned, kept, harbored, or in the custody or under the control of any person within the City at the rate of Three Dollars ($3.00) for each dog for each two year period, beginning July 1, 1968, and upon the first day of July of every even numbered year thereafter, payable in advance. Any person importing any dog into the City or owning any puppy that reaches the age of four (4) months after the first quarter of said licensing period has expired may be granted a license upon the payment of three-fourths of said license tax; after one-half of the licensing period has expired, may be granted a license upon payment of one-half of said license tax; and after three-fourths of the licensing period has expired, may be granted a license upon payment of one-fourth of said license tax. No renewal of an existing license may be made at a reduced fee without satisfactory proof that the dog has not been subject to such license tax during the expired portion of the license period. The Finance Department may provide for renewal of dog licenses by mail. (b) Said license tax shall be deemed a debt due the City from the owner and, in addition to the criminal penalties provided for this Code, such debt may be collected in the name of the City as any other debt may be collected. The foregoing license tax shall not apply to any dog while kept in a duly licensed kennel, nor to any seeing eye dog trained to assist blind persons while such dog is actually being kept and used by a blind person for the purpose of aid in going from place to place. SECTION 4: That this Ordinance shall take effect thirty (30) days from and after the date of its adoption.
