AND 4118.1 OF THE SANTA ANA MUNICIPAL CODE REGULATING KENNELS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Part 1, Chapter 1 of Article IV of the Santa Aha Municipal Code is hereby amended by amending Section 4118. and Section 4118.1 to read in words and figures as follows: SECTION 4118. Kennels, Fees. A license fee is hereby levied on all kennels in the City which contain more than three (3) dogs. A kennel containing only three (3) dogs shall obtain a license and pay the tax therefor on each of said dogs individually. The kennel license fees are fixed as follows: (a) For kennels containing more than three (3) but less than eleven (11) dogs, the sum of $10.00 per year or fraction thereof. (b) For kennels containing eleven (11) and less than twenty (20) dogs, the sum of $20.00 per year or fraction thereof. (c) For kennels containing more than twenty (20) dogs, the sum of $1.00 per dog per year or fraction thereof. SECTION 4118.1. Kennels, Requirements. Ail pens must be securely enclosed with a wire fence not less than six feet in height. All houses for sleeping must have a floor elevated at least six inches above ground level, must have a cement floor, must be tight against the elements, except for the entrance, and must comply with the requirements of the Building Code. At least 100 square feet of securely fenced run area must be provided for each dog. No person shall allow the runs to become a nuisance in any manner and all dog fertilizer and food scraps must be cleaned up and removed at least once each day. All barking or howling dogs shall be kept in an enclosed room with insulated walls to prevent the travel of sound at an objectionable level from the kennel building. No kennel which contains or is designed to contain more than twenty (20) dogs shall be established or licensed when any part of the kennel buildings or runs are closer than 500 feet to any building used for human habitation, and no such kennel shall be maintained or continued in existence or operation when any building used for human habitation exists within 300 feet of any part of the kennel buildings or runs, unless the number of dogs contained therein is reduced to cc~ply with the paragraphs hereinbelow in this Seqtion set out. No kennel which contains or is designed to contain at least four (4) but not more than nineteen (19) dogs shall be established or licensed if any part of the kennel buildings or runs are closer than 300 feet to any building used for human habitation, and no such kennel shall be maintained or continued in existence or operation when any building used for human habitation exists within 200 feet of any part of the kennel buildings or runs. No kennel shall be established, licensed, or maintained in existence which contains only three (3) dogs when any part of the kennel buildings or runs is closer than 200 feet to any building used for human habitation. The residence of the kennel operator or owner shall not be deemed a building used for human habitation within the language of this Section. -1- SECTION 2: That this Ordinance shall take effect thirty days from and after the date of its adoption.
