SECTION 9334 AND ADDING SECTIONS 9335,9336, 9337,
AND 9338 TO PART 3, CHAPTER 3, ARTICLE IX OF THE
SANTA ANA MUNICIPAL CODE TO PROVIDE FOR UNDERGROUND
UTILITY LINES
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code is hereby
amended by repealing and re-enacting Section 9334 thereof and
adding new sections numbered 9335, 9336, 9337, and 9338 to Part 3,
Chapter 3, Article IX thereof to read in words and figures as
follows:
Section 9334. utility Lines Shall Be Placed Underground.
Utility lines, including, but not limited to, electric,
communications, street lighting, and cable television, shall
be placed underground within any new, revised, or reactivated
residential subdivision. The subdivider is responsible for
making the necessary arrangements with the involved utility
companies for the installation of such facilities. For the
purpose of this Section, appurtenances and associated equip-
ment such as surface mounted transformers, pedestal mounted
terminal boxes and meter cabinets, and concealed ducts in an
underground system may be placed above ground outside the
street right of way. A utility line, the main purpose of
which is not within the original boundaries of the subdivision,
and those utility lines which were in service in the area
covered by the tentative map prior to the filing of the
tentative map, may be placed above ground.
Section 9335. Underground Utilities Shall Be Installed
Prior To Street Improvement.
Underground utility lines which cross underneath the right
of way of any street, alley, or way shall be installed prior
to the improvement of any such street, alley, or way in the
subdivision.
Section 9336. Waiver of Underground Requirements.
The Advisory Agency may waive the requirements of
Sections 9334 or 9335 if topographical, soil, or any other
condition makes such underground installations unreasonable or
impractical.
Section 9337. Application for Wai~er...
When a waiver of Sections 9334 or 9335 is sought, a written
application for such waiver shall be filed With the tentative
map explaining the justification for such request,
Section 9338. Temporary Installations May Be Above Ground.
Above ground installation of utilities may be permitted on
a temporary basis when such utilities are reasonably required
during construction; provided, however, that such utilities
shall be removed or placed underground prior to the final
exoneration of street improvement bonds.
SECTION 2: That this Ordinance shall take effect thirty days
from and after the date of its adoption.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 16thday of J~uar~ , 1967.
