CODE BY REPEALING SECTION 3291 OF PART 9, CHAPTER 2,
ARTICLE III, RELATING TO RAILWAY CROSSINGS
WHEREAS, Section 3291 of the Santa Ana Municipal Code provides
that railway trains or railway cars be operated in such a manner as
not to prevent the use of any street for the purpose of travel for a
period of time longer than five (5) minutes; and
WHEREAS, the Public Utilities Commission of the State of
California has adopted its Resolution S-1278 which provides a ten
(10) minute limitation on the blocking of a public street by a rail-
way vehicle, by which provision it pre-empts our local ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA
DOES ORDAIN AS FOLLOWS:
SECTION 1: That Section 3291 of Part 9, Chapter 2, Article
III of the Santa Ana Municipal Code is hereby repealed.
SECTION 2: That this Ordinance shall take effect thirty days
from and after the date of its adoption.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 18th day of August, 1969.
