HomeMy WebLinkAboutNS-0997ORDINANCE NS-997 CHANGING DISTRICT CLASSIFICATION ON AMENDMENT APPLICATION 651 INITIATED BY THE PLANNING COMMISSION AND AMENDING SECTIONAL DISTRICT MAPS 659 AND 759 (EXHIBIT AA 651 A) WHEREAS, the Planning Commission has given notice of and duly held a public hearing on Amendment Application 651 initiated by the Planning Commission proposing to reclassify from the R-3 District to the R-3H District all residentially zoned property north of Fifth Street, east of Bush Street, south of the Santa Ana Freeway and west of the Southern Pacific Railroad, which property is described hereinbelow; and said Commission, by its Resolution 5903, has recommended APPROVAL of said reclassification in accordance with Exhibit AA 651 A; and WHEREAS, the City Council regularly held a public hearing on said reclassification on published notice as required by law and does now find that the public necessity, convenience, and general welfare require that said property be reclassified from the R-3 District to the R-3H District in accordance with Exhibit A.A. 651-A, and that the new classification will not be detrimental to the surrounding property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the real property in the City of Santa Ana, County of Orange, State of California, described as: PARCEL t: Beginning at that point where the center line of Bush Street intersects the center line of Seventeenth Street; thence northerly along the center line of Bush Street for a distance of 180 feet, more or less, to the TRUE POINT OF BEGINNING; thence continuing northerly along the center line of Bush Street for a distance of 1,498.1 feet, more or less; thence easterly for a distance of 30 feet to the westerly right of way line of the Southern Pacific Railroad; thence southeasterly along the westerly right of way line of the Southern Pacific Railroad for a distance of 1710 feet, more or less; thence westerly along a line approximately parallel to the center line of Seventeenth Street for a distance of 259 feet, more or less; thence northerly for a distance of 15 feet, more or less; thence continuing westerly along a line approximately parallel to the center line of Seventeenth Street for a distance of 188.4 feet, more or less, to the center line of Spurgeon Street; thence southerly for a distance of 5 feet, more or less; thence continuing westerly for a distance of 360 feet, more or less, to the center line of Bush Street and the TRUE POINT OF BEGINNING. PARCEL 2: Beginning at that point where the center line of Bush Street intersects the center line of Seventeenth Street; thence Southerly along the center line of Bush Street for a distance of 224.3 feet, more or less, to the TRUE POINT OF BEGINNING; thence easterly along a line approximately parallel to the center line of Seventeenth Street for a distance of 1,005 feet, more or less, to the westerly right of way line of the Southern Pacific Railroad; thence southeasterly along said right of way line for a distance of 1,526 feet, more or less; thence southerly for a distance of 25 feet, more or less, to the center line of Washington Avenue; thence westerly along the center line of Washington Avenue for a distance of 100 feet, more or less, to the center line of Poinsettia Street; thence -1- southeasterly along the center line of Poinsettia Street for a distance of 150 feet, more or less; thence continuing along the center line of Poinsettia Street in a southeasterly direction for a distance of 415 feet, more or less, to the center line of Vance Street; thence southwesterly along the center line of Vance Street for a distance of 190 feet, more or less, to the center line of an alley; thence southwesterly along the center line of said alley for a distance of 1,687 feet, more or less, to the northerly line of Sixth Street; thence southerly for a distance of 30 feet, to the center line of Sixth Street; thence westerly along the center line of Sixth Street for a distance of 150 feet, more or less, to the center line of Garfield Street; thence southerly along the center line of Garfield Street for a distance of 155.0 feet, more or less; thence westerly along a line approximately parallel to the center line of Sixth Street for a distance of 1347.5 feet, more or less, to the center line of Mortimer Street; thence northerly along the center line of Mortimer Street for a distance of 155 feet, more or less, to the center line of Sixth Street; thence westerly along the center line of Sixth Street for a distance of 310 feet, more or less, to the center line of French Street; thence northerly along the center line of French Street for a distance of 155 feet, more or less; thence westerly along a line approximately parallel to the center line of Sixth Street for a distance of 310 feet, more or less, to the center line of Spurgeon Street; thence northerly along the center line of Spurgeon Street for a distance of 155 feet, more or less, to the center line of Seventh Street; thence westerly along the center line of Seventh Street for a distance of 130 feet, more or less; thence southerly along a line approximately parallel to the center line of Spurgeon Street for a distance of 180 feet, more or less; thence westerly along a line approximately parallel to the center line of Sixth Street for a distance of 25 feet, more or less; thence northerly along a line approximately parallel to the center line of Bush Street for a distance of 805 feet, more or less, to the center line of Ninth Street; thence westerly for a distance of 6 feet, more or less; thence northerly along a line approximately parallel to the center line of Bush Street for a distance of 259.4 feet, more or less, to the southerly right of way line of an alley; thence westerly for a distance of 24.4 feet, more or less, to the center line of an alley; thence northerly along the center line of said alley for a distance of 159.8 feet, more or less, to the center line of Tenth Street; thence easterly along the center line of Tenth Street for a distance of 56.6 feet, more or less; thence northerly along a line approximately parallel to the center line of Spurgeon Street for a distance of 156.0 feet, more or less; thence westerly for a distance of 11.4 feet, more or less; thence continuing northerly for a distance of 636.3 feet, more or less, to the center line of Washington Avenue; thence westerly along the center line of Washington Avenue for a distance of 125 feet, more or less, to the center line of Bush Street; thence northerly along the center line of Bush Street for a distance of 1370.3 feet, more or less, to the TRUE POINT OF BEGINNING, EXCEPTING THEREFROM the following described parcels: (a) Beginning at that point where the center line of Washington Avenue ihtersects the center line of French Street; thence northerly along the center line of French Street for a distance of 170 feet, more or less; thence easterly along a line approximately parallel to the center line of Washington Avenue for a distance of 264.5 feet, more or less; thence southerly along a line approximately parallel to the center line of French Street for a distance of 170 feet, more or less, to the center line of Washington Avenue; thence westerly along the center line of Washington Avenue for a distance of 264.5 feet, more or less, to the point of beginning. -2- (b) Beginning at that point where the center line of Washington Avenue intersects the center line of French Street; thence easterly along the center line of Washington Avenue for a distance of 455.5 feet, more or less, to the TRUE POINT OF BEGINNING; thence northerly along a line approximately parallel to the center line of French Street for a distance of 275 feet, more or less; thence easterly along a line parallel to the center line of Fourteenth Street for a distance of 48.3 feet, more or less; thence southerly along a line approximately parallel to the center line of French Street for a distance of 75 feet, more or less; thence easterly along a line approximately parallel to the center line of Washington Avenue for a distance of 94.3 feet, more or less, to the westerly boundary of an alley; thence southerly along a line approximately parallel to the center line of French Street for a distance of 200 feet, more or less, to the center line of Washington Avenue; thence westerly along the center line of Washington Avenue for a distance of 143.5 feet, more or less, to the TRUE POINT OF BEGINNING. is hereby reclassified from the R-3 District to the R-3H District, and Sectional District Maps 659 and 759 are hereby amended to show said reclassification in accordance with Exhibit AA 651 A. SECTION 2: That this Ordinance shall take effect thirty days from and after the date of its adoption.
