AN ORDINANCE OF THE COUNCIL OF SANTA ANA
CREATING A COMMUNITY REDEVELOPMENT COM-
MISSION FOR THE CITY OF SANTA ANA PURS%5%NT
TO THE COMMUNITY REDEVELOPMENT LAW
WHEREAS, pursuant to the provisions of the California
Community Redevelopment Law, the City Council of the City of
Santa Ana by Ordinance Number NS-l149 declared the need for
a Redevelopment Agency to function in the City of Santa Ana;
and
W~EREAS, pursuant to the provisions of the California Com-
munity Redevelopment Law, the City Council of the City of Santa
Ana declared itself to be the Redevelopment Agency provided in
Ordinance Number NS-1149; and
W~EREAS, Section 33201 of the California Community Redevelop-
ment Law authorizes the City Council of Santa Ana, acting as
the Community Redevelopment Agency, by ordinance to create a
Community Redevelopment Commission; and
WHEREAS, Section 33201 of the California Community Redevelop-
ment Law requires that the number of members of said Come, unity Re-
development Commission, the terms of office, the method of appoint-
ment and removal, shall be provided by ordinance; provided, however,
1) that each Community Redevelopment Commission must have at least
seven members; 2) that no member thereof shall acquire any interest
in any property included within a project area; 3) that each mem-
ber who owns or has any direct or indirect financial interest in
such a property shall immediately make a written disclosure of it
to the legislative body;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA
DOES ORDAIN AS FOLLOWS:
SECTION 1. There is hereby created the Santa Ana Community
Redevelopment Commission consisting of seven (7) members.
SECTION 2. The members of the Community Redevelopment Com-
mission shall be appointed, and may be removed, by the City Council,
subject in both appointment and removal by the affirmative votes
of the majority of the members of the City Council. Vacancies from
whatever cause arising shall be filled in the same manner. Upon
a vacancy occurring, leaving an unexpired portion of a term, any
appointment to fill such a vacancy shall be for the unexpired por-
tion of such term. If a member of the Community Redevelopment
Commission absents himself from three (3) consecutive meetings
of such Commission, unless by permission of the Commission ex-
pressed in its official minutes, or is convicted of a crime in-
volving moral turpitude, his office shall become vacant and
shall be so declared by the Santa Ana City Council.
SECTION 3. The members of the Community Redevelopment Com-
mission shall serve for a term of four (4) years, and until their
respective successors are appointed and qualified, but in no event
shall any person be eligible for reappointment who has served two
(2) consecutive terms of four (4) years each. The members first
appointed to said Community Redevelopment Commission shall so
classify themselves by lot that the term of one of each of their
number shall expire each succeeding July 1st (first). Where the
total number of the members of the Community Redevelopment Com-
mission to be appointed exceeds fomr (4), the classification by
lot shall provide for the pairing of terms to such an extent as
is necessary in order that the terms of at least one (1) and not
more than two (2) shall expire in each succeeding year. There-
after, any appointment to fill an unexpired term shall be for
such an unexpired period.
SECTION 4. No member of the Community Redevelopment Com-
mission shall acquire any interest in any property included
within any project area undertaken by the Community Redevelop-
ment Agency.
SECTION 5. Each member of the Community Redevelopment Com-
mission who owns or has any direct or indirect financial interest
in any property included within a project area as designated by
the Community Redevelopment Agency, shall immediately make a
written disclosure of it to the Santa Ana City Council.
SECTION 6. That the Clerk of the Council shall certify to
the passage of this Ordinance and cause the same to be published
in some daily newspaper printed and published in the City of
Santa Ana.
SECTION 7. That this Ordinance shall take effect thirty
days from and after the date of its adoption.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the l~th day of January
197'3.
