AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OP SANTA ANA ADDING SECTIONS 41-120 and 41-622
TO THE SANTA ANA MUNICIPAL CODE REQUIRING THE
SCREENING OF MECHANICAL EQUIPMENT AND APPUR-
TENANCES ON THE ROOF AND EXTERIOR OF BUILDINGS
WHEREAS, the Santa Aha Planning Commission held a public
hearing at a regularly scheduled meeting on November 27, 1972,
on a proposed amendment to the Zoning Ordinance of the City of
Santa Ana pertaining to the screening of mechanical equipment
or appurtenances on buildings which are hereafter constructed
or expanded; and
WHEREAS, it is proposed that Section 41-120, definition of
mechanical equipment or appurtenances, and Section 41-622,
mechanical equipment or appurtenances: regulations, be added
to Chapter 41, Zoning, of the Santa Ana Municipal Code; and
WHEREAS, no public opposition appeared to protest said
proposed amendment; and
WHEREAS, the Santa Ana Planning Commission did reco~end
the adoption of said proposed amendment to the Zoning Ordinance
to the City Council by its Resolution No. 6017 on November 27,
1972,
NOW, THEREFORE, the City Council of the City of Santa Ana
does ordain as follows:
SECTION 1. The Santa Aha Municipal Code is hereby amended
by adding a section to be numbered Section 41-120, which said
section reads as follows:
Sec. 41-120. Mechanical equipment or appurtenances.
Mechanical equipment or appurtenances shall include air
conditioners, fans, compressors, refrigeration units, exhaust
fans, vents, tanks, stacks, duct work, furnaces, adsorption
units, air filters or purifiers, chimneys, gravity or rotary
vents, or any similar type equipment. This definition does not
include attractively designed and constructed residential type
chimneys on residential units or buildings.
SECTION 2: The Santa Ana Municipal Code is hereby amended
by adding a section to be numbered Section 41-622 which said
section reads as follows:
Sec. 41-622. Mechanical equipment or appurtenances:
Regulations.
Ail mechanical equipment or appurtenances located on the
roof or on the exterior of a building situated on real property
that is zoned or used for commercial, industrial or multiple
family residential (three or more dwelling units) uses, or lo-
cated on such real property, shall be screened.

Every application for a building permit for the development
of property that is zoned or used for commercial, industrial or
multiple family residential uses shall be submitted to the plan-
ning department and shall be accompanied by detailed architec-
tural drawings and plot plans, all to a workable scale, showing
the elevation and location of the proposed screening struc-
tures or facilities, existing buildings and proposed addi-
tion, and any other pertinent information considered appro-
priate by the applicant or planning director pursuant to this
section.
Such plans for the screening shall be submitted to the
planning department for approval, conditional approval, or
denial. No building permit shall be issued until plans are
approved or conditionally approved by the Planning Department.
The decision of the planning department may be appealed to the
Planning Commission and then to the City Council.
In order to more clearly define the screening requirement,
there shall be on file in the office of the planning depart-
ment illustrations entitled "Guides to Screening of Mechanical
Equipment or Appurtenances." Said illustrations shall be
approved by resolution by the Planning Commission and City
Council.
No building permit shall be issued for the erection, con-
struction, enlargement, or structural alteration of any building
or structure in the City of Santa Ana which work exceeds fifty
percent (50%) of the gross floor area of any existing structures
on the property unless the applicant conforms with this section
for the entire existing buildings on the legal parcel.
Ail screening of mechanical equipment or appurtenances on
a building shall meet with the approval of the building depart-
ment.
In all instances where no screening is required, the appli-
cant shall indicate on his plans that this section does not
apply to his proposed structure or building.
SECTION 3: That the Clerk of the Council shall certify
to the passage of this Ordinance and cause the same to be
published in some daily newspaper printed and published in
the City of Santa Ana.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 19~ day
of March , 1973.
