NS-1197 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADDING SECTION 2-618 TO THE SANTA ANA MUNICIPAL CODE PERTAINING TO THE APPOINTMENT OF THE COMMUNITY REDEVELOPMENT AGENCY AS THE BOARD OF PARKING PLACE COMMISSIONERS OF VEHICLE PARK- ING DISTRICT NUMBER ONE WHEREAS, pursuant to the provisions of Part 1 of Divi- sion 18 of the California Streets and Highways Code, other- wise known as the Parking District Law of 1943, the City Council of the City of Santa Aha has by previous ordinance created a vehicle parking district within the City of Santa Ana entitled Vehicle Parking District Number One; and WHEREAS, the City Council has, pursuant to the provisions of said Parking District Law of 1943, previously appointed members to a Board of Parking Place Commissioners to provide for the Administration of the said Parking District; and WHEREAS, the said Parking District Law of 1943, in Sec- tion 31770.1 thereof, states that the legislative body of any city may, by ordinance, provide for the appointment, removal, qualifications, terms of office and number of members of parking place commissioners of such city, and that such board may be an existing board created by City charter or ordinance; and WHEREAS, the City Council now desires that the Community Redevelopment Agency at the City of Santa Aha be appointed as the Board of Parking Place Commissioners for Vehicle Park- ing District Number One in succession to the board as pre- viously established pursuant to the provisions of the said state law; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION l: That the Santa Ana Municipal Code is hereby amended by adding a Section to be numbered 2-618 which said Section reads as follows: Sec. 2-618. Redevelopment Agency appointed Board of Parking Place Commissioners of Vehicle Parking District Number One. The Community Redevelopment Agency is hereby declared to be the Board of Parking Place Commissioners for Vehicle Parking District Number One of the City of Santa Ana, in place of and in succession to the previously appointed members of said board as heretofore established pursuant to the provisions of the Parking District Law of 1943. The number, terms of office, and qualifications of the members of the Board of Park- ing Place Commissioners shall be the same as those of the mem- bers of the Community Redevelopment Agency, and no member of the Community Redevelopment Agency shall be subject to removal from the Board of Parking Place Commissioners. ORDINANCE NO. NS-ll97 PAGE TWO SECTION 2:If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 3: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 4: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
