NS-l199 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADOPTING RULES GOVERNING DISCLOSURE OF FINANCIAL INTERESTS BY CERTAIN OFFICIALS AND MAKING THE DISCLOSURE PROVISIONS OF THE GOVERNMENTAL CON- FLICT OF INTERESTS ACT APPLICABLE TO THEM, DECLARING THE URGENCY THEREOF, AND PROVIDING FOR IMMEDIATE EFFECT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The' Governmental Conflict of Interests Act, effective January 1, 1974, requires in Chapter 4 thereof that certain City officers annually file a statement of certain of their assets, income, investments and employment for in- spection by the public. Section 3704 of that Act provides that this City may adopt rules requiring that additional City officials be covered by these disclosure provisions. The City Council finds that it is in the public interest that a number of City officers not enumerated in the State Act be subject to its provisions, in order that the citizens of Santa Ana may be assured that the private affairs of these officers do not conflict with their public responsibilities. SECTION 2: The Santa Aha Municipal Code is hereby amended by adding a section to be numbered 2-325, which said section reads as follows: Sec. 2-325. Extension of Governmental Conflict of Interests Act Disclosure Provisions to Additional City Officials. In addition to the City Council, Planning Commission, City Manager and Director of Planning, the following City officials shall comply with the provisions of Chapter 4 of Division 4.5 of Title I of the Government Code: City Attorney Clerk of the Council Director of Finance Director of Public Works Director of Building Safety and Housing Director of Recreation and Parks Assistant City Manager Assistant to the City Manager Fire Chief Police Chief Members of the Redevelopment Commission The above-mentioned officials shall comply with the Act and any amendments hereafter adopted as fully as if their posi- tions were enumerated in Sec. 3700(a) of the Government Code, except that, for Members of the Redevelopment Commission, the requirement to disclose interests in real property shall extend only to that property located within a declared redevelop- ment area, property contiguous to such area or property conti- guous to any public street which is contiguous to such area. SECTION 3: This ordinance shall take effect as an emergency measure immediately upon its adoption. The City Council declares that it is necessary to the public peace, health, safety and ORDINANCE NO. NS-1199 PAGE TWO welfare that this ordinance be adopted as an emergency measure. The facts constituting the emergency are: The Governmental Conflicts of Interests Act became effective on January 1, 1974. This ordinance is promulgated under the authority of Section 3704 of that Act. It requires initial compliance not later than the April 15, 1974 date required for officials named in the Act. That compliance date is necessary to eliminate con- fusion on the part of reporting officials and to insure that the public is fully informed of the information required to be disclosed at the earliest possible date for all reporting offi- cials in order that conflicts of interest may be avoided. In order to advise the reporting officials of their responsibili- ties in sufficient time that they may compile the information necessary for complete and accurate reports consistent with the intent of the State Act, it is necessary to make this ordi- nance effective i~ediately. This will prevent inadvertant violations of the Act and provide maximum protection of the public interest. SECTION 4: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 5: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. PASSED AND ADOPTED by the City Council of the City of Santa Ana as an emergency measure at its adjourned regular meeting on the 11 day of March , 1974.
