AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA AMENDING SECTION 2-318 OF THE SANTA
ANA MUNICIPAL CODE PERTAINING TO DISQUALIFICA-
TION OF PUBLIC OFFICIALS IN CONFLICT OF INTEREST
SITUATIONS
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: Section 2-318 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 2-318. Same - Disqualification
An official who refrains from acting in accordance with
Section 3625(b) of the Government Code of the State of calif-
ornia shall declare the fact and nature of the interest which
disqualifies him in the manner provided in this section.
(a) City Council members shall follow the procedure
set out in Section 2-105 of this Code.
(b)
A member of an appointive board or commission
shall openly state to the presiding officer at
a public meeting of said bo~y the fact and nature
of the interest which disqualifies him and shall
not be subject to further inquiry. The disquali-
fied men~ber shall be excused by the presiding of-
ficer and shall absent himself from the meeting
room during debate and vote on the matter.
(c)
Ail other officials named in Section 2-311 who
disqualify themselves from acting pursuant to
Section 3625(b) of the Government Code of the
State of California shall record the fact and
nature of their disqualification in a signed
memorandum, to be filed as herein provided.
A copy shall be provided to the city manager, and,
if an appropriate file pertaining to the matter on
which action is to be taken exists, an additional
copy shall be filed in it. When the disqualified
official is the city manager, city attorney or
clerk of the council, a copy of the memorandum
shall be sent to each member of the City Council,
and an additional copy shall be furnished the
Clerk of the Council for filing.
The city manager shall promulgate such additional
regulations as may be required to implement the
provisions of this sub-seotion.
