NS-1211 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTIONS 8-556, 8-610, 8-620, AND 8-630 OF THE SANTA ANA MUNICIPAL CODE, PERTAINING TO THE ADOPTION OF THE UNIFORM MECHANICAL CODE, 1973 EDITION THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Sections 8-556, 8-610, 8-620 and 8-630 of the Santa Ana Municipal Code are hereby amended to read as follows: Sec. 8-556. Adoption by Reference. There is adopted by the City that certain code known as the Uniform Mechanical Code, ~97'$~F~!tion, together with the appendices and code standards therein, and the whole thereof save and except such portions as are deleted by the amendments set forth.in this Article, of which said code not less than three (3) copies have been and are on file in the office of the Clerk of the Council of the City. The said code is adopted and incorporated as fully as if set forth at length herein as pro- vided for in Section 419 of the Charter of the City, and, sub- ject to all amendments set forth in this Article, shall be in effect within the City of Santa Ana from the effective date of this ordinance. Any provision of this Article amending the "Mechanical Code" or "Uniform Mechanical Code" shall be con- strued as amending the said adopted code, 1973 Edition, includ- ing such provisions enacted prior to the enactment of this ordi- nance and not thereafter repealed. The said adopted code, 1973 Edition, as thus amended, together with all other provisions of this Article, shall be known as the Mechanical Code of the City of Santa Ana. Sec. 8-560. Fees (Section 304) Section 304 of the Uniform Mechanical Code, is amended and subsections are added thereto to read as follows: (a) Mechanical Permit Fee Schedule. Any person desiring a permit required by this Code, shall, at the time of filing an application therefor, pay a fee as required by this section. For the issuance of each permit $ 3.00 For the installation or relocation of each forced-air or gravity type furnace or burner up to and including 100,000 BTU, including ducts and vents attached to such appliance 5.00 More than 100,000 BTU to and including 500,000 BTU 7.50 More than 500,000 BTU to and including 1,000,000 BTU 10.00 More than 1,000,000 BTU to and including 2,000,000 BTU 15.00 More than 2,000,000 BTU For the installation or ~elocation of each floor furnace including vent 25.00 5.00 For the installation or relocation of each suspended heater, recessed wall heater or floor mounted unit heater including vents 5.00 ORDINANCE NO. NS-1211 PAGE TWO For the installation, relocation, or replace- ment of each appliance vent installed and not included in an appliance permit 2.00 For the repair of, alteration of, or addition to each heating appliance, refrigeration unit, comfort cooling unit, absorption unit, or each comfort heating, cooling, absorption, or evap- orative cooling system, including installation of controls and registers regulated by this Code 5.00 For the installation or relocation of each boiler or compressor and including 5 horse- power, or each absorption system to and includ- ing 100,000 BTU's (including vent) 5.00 For the installation or relocation of each boiler or compressor over 5 horsepower to and includ- ing 15 horsepower, or each absorption system over 100,000 BTU's to and including 500,000 BTU's (including vent) 7.50 For the installation or relocation of each boiler or compressor over 15 horsepower to and including 30 horsepower, or each absorption sys- tem over 500,000 BTU's to and including 1,000,000 BTU's (including vent) 10.00 For the installation or relocation of each boiler or compressor over 30 horsepower to and including 50 horsepower, or each absorp- tion system over 1,000,000 BTU's to and includ- ing 2,000,000 BTU's (including vent) 15.00 For the installation or relocation of each boiler or refrigeration compressor over 50 horse- power, or each absorption system over 2,000,000 BTU's (including vent) 25.00 For each air handling unit to and including 2,000 cubic feet per minute, including ducts attached thereto 2.00 For each air handling unit over 2,000 cubic feet per minute and including 10,000 cubic feet per minute, including ducts attached thereto 5.00 For each air handling unit over 10,000 cubic feet per minute 10.00 For each evaporative cooler other than portable type (commercial) 3.00 For each ventilating fan connected to a single duct (commercial) 2.00 For each ventilation system which is not a por- tion of any heating or air conditioning system authorized by a permit (commercial) 4.00 For the installation of each hood which is served by mechanical exhaust, including the fans and ducts attached thereto 5.00 For the installation or relocation of each domes- tic type incinerator 5.00 ORDINANCE NO. NS-1211 PAGE THREE For the installation or relocation of each commercial or industrial type incinerator 20.00 For each appliance or piece of equipment regu- lated by this Code, but not classed in other appliance categories, or for which no other fee is listed in this Code 4.00 Incidental gas piping 2.00 (b) Mechanical Plan Check Fee Schedule. Whenever mechani- cal plans are required by the Building Official, plan check fees shall be in accordance with the following: A. Fifty per cent (50%) of the mechanical permit fee for the following: 1. Any group A through H occupancy. New buildings having an aggregate floor area of 15,000 square feet and over. e Installations other than those listed in 1 and 2 above, where the aggregate BTU input capa- city is 350,000 BTU's and over for comfort heat- ing, or an aggregate of 25 horsepower and over for comfort cooling, or an aggregate of 350,000 BTU input capacity and over for absorption units. Plan check fee for alterations to approved plans, per hour 12.00 C. Minimum charge, per half hour or less 6.00 (c) Investigation Fee. Whenever any work for which a permit is required under the provisions of this Code has been commenced without the authorization of such permit, a special investigation may be required before a permit will be issued for such work. In addition to the regular permit fee and any penalty fee, the said investigation fee which may be collected is as follows: When the Mechanical Permit Fee is: Investigation Fee $10.00 or less More than $10.00 $10.00 25.00 (d) Reinspection Fee. When any reinspection is required due to the negligence of the permit holder, his agent, or other responsible persons, or due to the failure of said par- ties to comply with the previous correction instructions a fee of five dollars ($5.00) may be charged by the Building Official prior to each such reinspection. (e) Refund of Permit Fee. Upon written request from the permittee, refunds of mechanical permit fees may be made to the permittee in an amount equal to eighty per cent (80%) of the mechanical permit fee paid; except that no permit fee shall be refunded under any of the following circumstances: If the mechanical permit fee is five dollars ($5.00 or less. ORDINANCE NO. NS-1211 PAGE FOUR e After one year has elapsed from the date of issuance of the permit. If any inspections have been performed by the Department of Building Safety and Housing. If a permit has been issued for a project located in an area outside of the jurisdiction of the City, one hundred per cent (100%) of the mechanical permit fee may be refunded. If a duplicate permit has been erroneously issued, one hundred per cent (100%) of the duplicated permit fee and plan checking fee may be refunded. In no other case shall any part of any plan checking fee be refunded. Sec. 8-610. Location of Cooling Equipment (Section 1202) Section 1202 of the Uniform Mechanical Code is amended by adding a paragraph to the end thereof to read as follows: When installed outside of a building, no cooling equipment shall be closer than five (5) feet from a side property line. Sec. 8-620. Location of Evaporative Cooling Systems (Section 1302) Section 1302 of the Uniform Mechanical Code is amended by adding a paragraph to the end thereof to read as follows: When installed outside of a building no evaporative cool- ing system shall be closer than five (5) feet from a side property line. Sec~ 8-630. Location of Absorption Refrigerating Equip- ment (Section 1404) Section 1404 of the Uniform Mechanical Code is amended by adding a paragraph to the end thereof to read as follows: When installed outside of a building, no mechanical absorption equipment shall be closer than five (5) feet from a side property line. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordi- nances relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case de- posit in lieu thereof,'required to be posted, filed or depo- sited pursuant to any ordinance, and all rights and obliga- tions thereunder appertaining shall continue in full force and effect. NS-1211 PAGE FIVE SECTION 4: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 5: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
