AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AMENDING SECTION 8-729
OF THE SANTA ANA MUNICIPAL CODE, PERTAIN-
ING TO PERMITS, FEES AND INSPECTIONS UNDER
THE ELECTRICAL CODE OF THE CITY OF SANTA
ANA
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: That Section 8-729 of the Santa Ana MuniCipal
Code is hereby amended to read as follows:
Sec. 8-729. Permits, Fees and Inspections (Article 91).
Article 91 of the Electrical Code is added to read as
follows:
ARTICLE 91 - PERMITS, FEES, AND INSPECTIONS
91-1. PERMITS.
No electrical equipment shall be installed within or on
any building, structure or premises, publicly or privately
owned, nor shall any alteration or addition be made in any such
existing equipment without first securing a permit therefor from
the director of building safety, except as provided in subsection
91-1(a).
(a)
Minor repair work, such as the replacement of lamps
or the repair and connection of portable electrical
equipment to suitable permanently installed receptacles.
91-2. ISSUANCE.
Permits may be issued only to a person, firm or corporation
licensed by the state in the classification authorized to per-
form the work and subject to the conditions and limitations
qualifying under section 91-4, or to an owner qualifying under
section 91-5.
91-3. APPLICATIONS.
Applications for electrical permits, describing the work
to be do~,-~shall~be made in writing to the director of building
safety. The application shall be accompanied by such plans,
specifications and schedules as may be necessary to determine
whether the installations as described will be in conformity
with the requirements of the sections in this code pertaining to
electricity. If it shall be found that the installation as des-
cribed will conform to all legal requirements, and if the appli-
cant has complied with the provisions of the sections in this
code pertaining to electricity, a permit for such installation
may be issued upon receipt of fees therefor, as prescribed in
section 91-12. No deviation may be made from the installation
described in the permit without the written approval of the direc-
tor of building safety.

91-4. ANNUAL MAINTENANCE ELECTRICIAN PERMITS.
An annual permit may be issued to any person, firm, or
corporation regularly employing a maintenance electrician
~pproved by the director of building safety. The maintenance
electrician may install, alter, maintain, or repair electrical
wiring in or on buildings or premises owned or occupied by his
employer and shall keep a detailed record of all such work.
Within fifteen (15) days following the end of each calendar
month, the maintenance electrician shall file an application
accompanied by regular fees and obtain an electrical permit for
~11 electrical work accomplished during the preceding month.
91-5. Owner's permit. As a condition to the issuance of an
electrical permit, the applicant must sign a statement that he
is licensed under the provisions of the California Business
and Professions Code, Division 3, Chapter 9 (Contractor's Li-
cense Law) giving the number of the valid license, or, if the
applicant is exempt from the provisions of this Chapter, the
basis for the alleged exemption.
91-6. No electrical work for which a permit is required shall be
commenced in any building or premises until a permit to do such
work shall have been first obtained.
91-7. Failure to obtain a permit and pay fees therefor before
commencing work shall be deemed evidence of violation of the pro-
visions of this code. Double the amount of permit fee shall be
assessed for work commenced before a permit is issued.
91-8. NO permit shall be transferable. A permit granted to any
one person, firm or corporation shall not authorize any other
person, firm or corporation, except an employee of the permittee,
to do any electric wiring.
91-9. Temporary working permit. When, in the opinion of the
director of building safety, special conditions warrant, a tem-
porary working permit may be issued to allow the permittee to
commence the installation of electrical wiring prior to obtain-
ing a regular electrical permit. However, the temporary work-
ing permit shall be replaced by a regular electrical permit be-
fore the complete rough inspection can be made.
91-10. Expiration of permit. Every permit shall expire and
become null and void for any one or more of the following reasons:
Whenever the electric wiring authorized by a permit
is not commenced within sixty (60) days from the
date of issuance of such permit.
Whenever the electric wiring authorized by a permit
has been suspended, abandoned or discontinued for a
continuous period of one hundred twenty (120) days.
Whenever the electric wiring done during any con-
tinuous period of ninety (90) days amounts to less
than ten (10) per cent of the total of the electric
wiring authorized by such permit.

Before recommencing, proceeding with, or doing any electric
wiring authorized by but not done before expiration of any
such permit, a new permit shall be obtained therefor, and the
fee for such permit shall be the fee required for a new permit.
91-11. Revocations and suspensions of permits. The director
of building safety may suspend or revoke any electrical permit
~or any of the following reasons:
If any reason is found to exist which would have been
cause for denial of such permit.

Any material misrepresentation or falsity in the appli-
cation upon which said permit was issued.

For failure to comply with the provisions of the sec-
tions in this code pertaining to electricity; after due
notice of corrections and the time limit therefor has
expired; or for failure to comply with other codes of
this jurisdiction that may be related to or appertain
to the sections in this code pertaining to electricity.
91-12. FEES
(a)
The fees required in this section must be paid to the
director of building and safety for each electrical
installation for which a permit is required by this
code o
(b)
No permit shall be issued to any person, firm or corpora-
tion unless all fees for permits or additions to permits
are paid in full.
(c)
There shall be a basic permit issuance fee of $3.00 for
all electrical permits issued in addition to other fees
provided for below.
(d) Fee Schedule:
(1) New construction and relocation on residential
single family, multi-family, hotels, motels and all
other H and I occupancies):
One and one half cents (1 1/2 ~) per square
foot per floor; plus $5.00 for each service
meter; and
One cent per square foot for detached or attached
garages or carports on same service; and
$1.25 for each room where electrical radiar~ceil-
ing heat is installed.
(2) Ail occupancies, except as provided for in section
91-12(d) (1) above, including alterations, additions,
repairs, and improvements; use fee schedules as follows:
Service meter ................................ $5.00
Each self-contained factory wired approved unit,
such as air conditioners, home applicances, heaters,
vegetable cases, drinking fountains, heating appli-
ances, multiple outlet assemblies, etc ....... 2.00

91-13. PLAN CHECK FEE
Whenever electrical plans are required by the building
nfficial, plan check fees shall be 50% of the electrical permit
fee and shall be paid at the time of submitting plans.
91-14. SPECIAL INVESTIGATION FEE
A special investigation fee may be charged by the building
official for any inspection of a building, structure, work re-
ports, certification, or any other related work requested by an
owner or his authorized agent. Such fee shall be assessed in
an amount sufficient to reimburse the City for the costs incurred
but in no case shall be less than fifteen dollars ($15).
91-15. REINSPECTION FEE
When any reinspection is required due to the negligence of
the permit holder, his agent, or other responsible person, or
due to the failure of said parties to comply with previous cor-
rection instructions, a fee of five dollars ($5) may be charged
by the building official prior to each such reinspection.
91-16. VIOLATION INVESTIGATION FEE
Whenever any work for which a permit is required under the
provisions of this code has commenced without the authorization
of such permit, an investigation may be required before a permit
will be issued for such work. In addition to the regular elec-
trical permit fee and any penalty fee, an investigation fee
which may be collected is as follows:

91-17. REFUND OF FEES
Upon written request from the permittee, refunds of electrical
permit fees may be made to the permittee in an amount equal to
80% of the electrical permit fee paid; except that no permit fee
shall be refunded under any of the following circumstances:
1. If the electrical permit fee is $5.00 or less.
2. After one year has elapsed from the date of the issuance
of the permit.
3. If any inspections have been performed by the Department
of Building Safety and Housing.

If a permit has been issued for a project located in an
=rea outside of the 9urisdiction of the City, 100% of the
electrical permit fee may be refunded. If a dpulicate permit
has been erroneously issued, 100% of the duplicated permit fee
may be refunded. In no other case shall any part of any plan-
checking fee be refunded.
91-18. When any part of a wiring installation is to be hidden
from view, the person, firm or corporation installing the wiring
shall notify the director of building safety and such parts of
the wiring installation shall not be concealed until they have
been inspected and approved by the director of building
safety.
91-19. Inspections and corrections. Upon completion of the work
which has been authorized by issuance of any permit, except an
annual permit, it shall be the duty of the person, firm, or
corporation installing the same to notify the director of build-
ing safety who shall inspect the installation as soon thereafter
as practicable. If, upon inspection, the installation is not
found to be in conformity with the provisions of this code, the
director of building safety shall notify the person, firm, or
corporation making the installation, stating the defects which
have been found to exist. All defects shall be corrected within
ten (10) days after inspection and notification, or within other
reasonable time as permitted by the director of building safety.
No electrical installation shall be energized until inspected
and approved by the director of building safety.
91-20. TEMPORARY CONNECTION.
When authorizing the connection and use of temporary or
incomplete work, such ~uthorization shall expire at a time to
be stated by the director of building safety.
SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the deci-
sion of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of
~his ordinance. The City Council of the City of Santa Ana
hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that any one or
more sections, subsections, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION 3: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect
the prosecution for violation of ordinances, which violations
were committed prior to the effective date hereof, nor be
construed as affecting any of the provisions of such ordi-
nances relating to the collection of any such license or
penalty or the penal provisions applicable to any violation
thereof, nor to affect the validity of any bond or case de-
posit in lieu thereof, required to be posted, filed or depo-
sited pursuant to any ordinance, and all rights and obliga-
tions thereunder appertaining shall continue in full force
and effect.

SECTION 4: This Ordinance shall take effect thirty (30)
days from and after the date of its adoption.

Santa Ana at its regular meeting held on the 1st day of
July , 1974.
