NS-1228 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTION 41-590 OF THE SANTA ANA MUNICIPAL CODE PERTAINING TO THE REQUIREMENT OF A CONDITIONAL USE PERMIT FOR THE DEVELOPMENT, USE, OR DIVI- SION OF PROPERTY WITHIN THE PRD MODIFIED DISTRICT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION l: That section 41-590 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-590. Conditional use permit required. Any development, use or division of property within a PRD modified district classification, even though such develop- ment, use or division of said property may conform to the base zone to which the PRD modified district may be suffixed, requires the filing and approval of a conditional use permit. (A) Application for permit. Any application for a condi- tional use permit under the provisions of this division and chapter shall be accompanied by a filing fee. No such application shall be accepted for filing unless ac- companied by the required fee. The city council from time to time by resolution shall establish a schedule of fees for such applications, and a copy of this schedule shall be maintained at the office of the planning de- partment. (B) Application contents. An application for a planned residential development shall be in the form of an application for a conditional use permit and shall be accompanied by the following information, maps and plans: (1) A legal description of the real property; a tenta- tive subdivision map may be substituted if the applicant proposes to subdivide the property. (2) The gross land area of the development, the present zoning classification thereof, and the zoning classification and land use of the area surrounding the proposed development, including the location of structures and other improvements. (3) A precise development plan, drawn to scale, show- ing the following information: (a) (b) Location of each existing and each proposed structure in the development area, the use or uses to be contained therein, the number of stories, gross building and floor area, location of entrances and loading points thereof. All streets, curb cuts, driving lanes, parking areas, loading area, public transportation points, and illumination facilities for the same. ORDINANCE NO. (e) Types of surfacing, such as paving, turfing or gravel to be used at the various locations. (4) Plans and elevations of structures to indicate architectural type and construction standards, (5) If the applicant proposed to provide open areas and recreational facilities to be used by the occu- pants of two (2) or more dwelling units, he shall so state in his application and the application shall include a plan, acceptable to the city, for the preservation and maintenance of the common elements of the property, until said project is terminated by either the planning commission, city council, or both. (6) Such other information as may be required by the planning department to assist in the consid- eration of the proposed development. (C) Procedure. The applicant for approval of a planned residential development shall be the owner, all of the owners of the site acting jointly, or an authorized agent. Each prospective applicant is to confer with the plan- ing department in connection with the preparation of a planned residential development prior to the sub- mission of the conditional use permit application to the planning commission. The chief purpose of such a pre-application conference is to benefit the prospec- tive applicant by providing information and clarifi- cation of requirements before such prospective appli- cant incurs any substantial expense in the preparation of plans. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordi- nances relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case de- posit in lieu thereof, required to be posted, filed or depo- sited pursuant to any ordinance, and all rights and obliga- tions thereunder appertaining shall continue in full force ,nd effect. NS-1228 PAGE THREE SECTION 4: The Clerk of the Council shall certify to passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. the S.[.CTION 5: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
