AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTIONS 38-1, 38-2, 38-3 28-20, 38-20a, 38-38, 38-39, 38-40 AND 21-72 OF THE SANTA ANA MUNICIPAL CODE, REPEALING SECTIONS 38-2a OF THE SANTA ANA MUNICIPAL CODE, AND ADDING SECTIONS 38-'1.1 THROUGH. 38-1.27 AND SECTIONS 38-3.1 THROUGH 38-3.20 AND SECTION 38-8a TO THE-SANTA ANA MUNICIPAL CODE, PERTAINING TO THE REGULATION OF VEHICLES FOR HIRE AND TO THE DEFINITIONS OF TERMS, THE APPLICATION FOR AND ISSUANCE OF CERTIFICATES, THE INSPECTION OF VEHICLES AND THE PERMIT FEES AS PROVIDED IN SUCH REGULATIONS THE CITY COUNCIL OF THE CITY OF'SANTA ANA' DOES ORDAIN AS FOLLOWS: SECTION l: Section 38-1 of the Santa Aha Municipal Code is hereby ameSded to read as follows: Sec. 38-l. Definitions. For purposes of this chapter, the words and. phrases set forth in sections 38-1.1 throu'gh 38-1.27 shall have the meanings respectively ascribed to them by such sections. SECT)ON ~: Sections 38-1.1 through 38-1.27 are hereby added to the Santa Aha Municipal Code to read as follows: Sec. 38, I.1. Ambulance. "Ambulance" shall mean any or used for transporting the wounded, shall.include, but not'be limited to, for such purposes. SeC~ 38-1.2. Certificate. privately-owned vehicle equipped injured, sick or dead, and emergency vehicles used "Certificate" shall mean a certi~ica.te of public, convenience and necessity issued by the City of Santa Ana authorizing the holder thereof to conduct an ambulance, motorbus, taxicab, or other, vehicle for hire business in the city. Sec. 38-1.3. Chief of police. "Chief of police" shall mean the Chief of police of the city of Santa. Ana or his duly authorized subordinates. Sec. 38-1.4. City manager. "City manager" shall mean the city manager of. the City of Santa Aha, or his duly authorized subordinates. -Sec. 38;1.5. 'ComPensation. . "Compensation" shall' mean any money, thing of Value, pay- ment, consideration, reward, tip, donation, gratuity or profit paid to, accepted, or received-by the driver of 'any vehicle in e~change for transportation of .a person or persons, whether'paid upon solicitation, demand or contract, or voluntarily, or in- tended as a gratuity or donation. ORDINANCE NO'. PAGE TWO NS-1237 Sec. 38-1.6. Cruising. "Cruising" shall mean the movement or standing of a taxicab on the.public highways or public places for the purpose of search- ing for or soliciting a passenger~for.hire. Sec. 38-1.7. Driver. · "Driver" Shall mean any person in charge' or control of, or driving or operating any motor vehicle upon the streets, alleys or highways of the city, either as owner, agent, employee or otherwise. Sec. 38-1,8. Driver's'permit. ' ' "Driver's permit" shall mean the p~rmit issued by the chief of police to any person operating or driving any vehicle as de- fined in this chapter. Sec. 38-1.9. Fixed taxi stand. "Fixed taxi stand" shall mean a space set aside for the ex- clusive use of one or more taxicabs with marked stalls for each taxicab operating therefrom and which is clearly identified with asign stating the name and telephone number of the opera- tor of such stand. -Sec. 38-1.10. Hearing officer, m '"Hearing officer" shall mean any per. son appointed'by the clerk or the council to conduct the public hearing and submit written findings, conclusions and recommendations. Sec. 38-1.11. Holder. -"Holder" shall mean any pprson holding 'a certificate. Sec. 38-1.12. Jitney.. "Jitney" shall mean a taxicab engaged in the business carrying passengers for hire along a fixed route of travel during a time of total or partial stoppage'. of Sec. 38-1.13. Manifest. "Manifest" shall mean a daily record prepared by the-driver or the management office of all trips made by any ambulance or taxicab showing the date and place of origin, destination, number of passengers, and the amount of charge to each passenger. Sec. 38-1.14. 'Motorbus. "Motorbus" shall mean any motor vehicle used in the business of carrying passengers for hire which receives 'and discharges passengers along a fixed route traversed by;'it,' except any inter- city bus regulated by the Public Utiliti.es Commission. Sec. 38-1.15.-Owner. "Owner" shall mean any person, partnership, firm, entity, or corporation or'stockholder thereof having legal use, control or title of any moto.r vehicle, whether as owner, lessee or other- wise. ORDINANCE NO. NS-1237 PAGE THREE Sec. 38-1.16. Partial Stoppage. "Partial stoppage" shall mean the furnishings of less than the regularly scheduled bus transportation service due to work stoppage, slow down, labor dispute, or when no regular bus ser- vice is scheduled during the interval between termination of o'ne day's scheduled bus service and the commencement .of the next day's scheduled bus serviceJ Sec. 38-1.17. "Passenger for vehicle for hire for Passenger for hire. hire" shall mean a. person transported compensation or other consideration. in a' Sec. 38-1.18. Pick up. "Pick up" shall mean to take into a vehicle. Sec. 38-1.18a. Safety Inspection Sticker. by and found to be in Sec. 38-1.19. "Safety Inspection Sticker" shall mean a sticker affixed a vehicle for hire evidencing that it has been inspected the Santa Ana Police Department or California Highway Patrol safe operating, condition. Solicit. "Solicit" shall mean to endeavor to obtain a passenger for hire by words or gestures. Sec. 38-1.20. Street. "Street" shall mean any place commonly used for the purpose Of public travel. Sec. 38-1.21. Taxicab. "Taxicab" shall mean any motor vehicle used in the business of transportation of passengers for hire,where transportation is not over a fixed and definite route, but is under the control as to destination and/or route, of the passenger or passengers being carried therein. Sec. 38-1.22. Taxicab terminal. "Taxicab terminal" shall mean any office, station, build- i~g, stand, substation or other place of business..of a holder at which calls are or may be received from prospective passen- gers.for hire and from which the holder or his agents or em- ployees direct the dispatch and return of taxicabs. Sec. 38-1.23. Taximeter. "Taximeter" shall mean any mechanical instrument, appliance, device or machine by which the charge for hire of a motor vehicle is mechanically calculated, either for distance traveled or time consumed, or both, and on said instrument, appliance, device or machine such charge is indicated by figures. Sec. 38-1.24. Top light. "Top light" shall'mean an electrically lights of a color and design approved by the operated sign with chief of police. Sec. ~38-1.25. Total stoppage. "Total stoppage" shall mean, the complete halting of bus transportation service furnished within the City of Santa Ana resulting from a labor strike or a disaster. ORDINANCE NO. NS-1237 PAGE FOUR Sec. 38-1.26. Vehicle for hire. "Vehicle for hire" shall mean any ambulance, motorbus, taxicab, jitney or other motor vehicle offered in the City of Santa Ana fom the transportation of passengers for compensa- tion or used or engaged in the soliciting or pick-up of passengers for hire in the City.of Santa Ana, exclusive of any vehicle for which a Certificate of Public C6nvenience is needed and has been granted by the Public Utilities Commission of the State of Calif- ornia. Sec. 38-1.27~ Waiting time. "Waiting time" shall mean the time when the taxicab is not in motion from the time of acceptance to the time of discharge of a passenger, including any time the taxicab is not in motion due to traffic or the request, act or fault of the passenger, except that the first three minutes elapsing prior to the arri- val of the passenger at the beginning of a trip shall not be considered as waiting time, and in no event shall any time be considered as waiting time for any period prior to the time of arrival designated by the prospective passenger when requesting a taxicab. SECTION 3: Section 38-2 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 38-2. Certificate and permit requirements (a) No holder of a certificate of public convenience and necessity'shall engage in, or permit any other person to engage in, the business of-soliciting or picking up passengers for hire in the city in any vehi'cle for hire registered to or owned or controlled by such holder unless such vehicle has been affixed with the stickers and device as required by Sections 38-18 and 38-20a of this chapter, evidencing, that it is authorized to operate within the City o( Santa Ana as a vehicle for hire. (b) No person shall pick up any passenger(s) for hire in · the city in a vehicle for hire unless that vehicle has been affixed with the appropriate stickers and device evidencing that it is authorized to operate within the City of Santa Aha as a vehicle for hire. (c) No person shall solicit any Passenger{s) for hire in the city in a vehicle for hire unless tha% vehicle has been affixed with the appropri.ate stickers and device evidencing that it is authorized to operate within the City of Santa Ana as a vehicle for hire. Three or more violations of subsection (a) of this section within any 12-month period by a holder shall constitute grounds for revocation of such holder's certificates pursuant to Section 38-10. For the purpose of such re- vocation proceedings a presumption is created that any person convicted Of or pleading guilty or nolo Contendere to any violation of subsection (b) or (c) of this section, who was using a vehicle during such violation which at the time of the violation was registered to, or owned or con- trolled by, a holder is deemed to have been acting with the permission of such holder'. SECTION 4: Section 38-2a of the Santa Ana Municipal Code is hereby repealed. SECTION 5: Section 38-3 of the Santa Ana Municipal Code is hereby amended to read as follows: ORDINANCE NO. NS-1237 PAGE FIVE Sec, 38-3, Certificate - application, A'n application for a certificate shall be filed with the clerk of the council, shall be verified under penalty of perjury, shall be accompanied by a fee in the amount of one hundred dollars ($100.00), and shall contain or be accompanied by the information and documentation' specified in sections 38-3.1 through 38-3.20. SECTION 6: Sections 38L3.1 through 38-3.20 are hereby added to the Santa Aha Municipal Code to read as roi.lows: Sec, 38-3.1. Same - identification data. The certificate application shall contain the following: the name, age, residence, ahd business address, . driver's, license number, and present occupation of the person applying for such license. .If the applicant is a partnership or association, the. names, ages, residence addresses, driver's license numbers, and occupations of all partners shall be given, and if the applicant is a corporation, the names, ages, residence addreSses,ldriver's license, numbers, and occupations of all officers, directors, stockholders thereof shall be given in addition to the value and number of shares owned and issued to each. Sec. 38-3.2. Same - financial data. The certificate application shall inclu'de the following statements from eath applicant, or, if an applicant is a partner- ship or other unincorporated association, from each person or corporation which is financially interested in the business: (al (b) A sworn financial statement prepared by a certified .public accountant; and A statement as to whether the applicant, person or corporation has any unpaid judgments standing agafnst him, and, if so, the nature of the acts or transactions giving rise to any such judgment, the court in which it was rendered, and the amount of any unpaid or un- bonded judgment; and (c) A statement of an~ b'ankruptcies, either personal or business, including the number, court and date of discharge. Sec.'38-3.3. Same - previous experience data. The certificate application shall state the experience of the applicant, both in the City of Santa Aha and elsewhere, in the operation of ambulances, motorbuses, or taxicabs or other common carriers for the transportation of passengers. .Sec, 38-3.4. Same public convenience and necessity. The certificate application shal.1, state the facts which · applicant believes tend to establish that public convenience and.necessity require the granting of a certificate. the ORDINANCE NO. NS-1237 PAGE SIX S'~c. 38-3.5. Same vehicle data. The certificate application shall ~tate the number of vehicles to be operated or controlled by the applicant and the makes, body styles, years, serial and fngiQe numbers, state license plate numbers, name of legal owner., apd the seating capacity of the ambulances, motorbuses or taxica'bs for which such Certificate of Public Convenience and Necessity~is being applied for. Sec. 38-3.6. Same - vehicle descriptive data. The certificate application shall contain a description of the proposed color scheme, insignia, trade, style and any other distinguishing characteristics of the proposed design to be used to designate applicant's.vehicle. ~ Sec. 38-3.7~' Same - previous criminal record data. The certificate application shall contain a statement of whether the applicant, or, if the applicant is a firm, partner- ship, association or corporation, whether any of its members, officers or directors, has, at any time within five years prior to the date of such application, been arrested, convicted or pleaded guilty to any crime, felony or misdemeanor, and,Jif so, the date, nature of the offense or arrest and the court in which such charge was made, conviction was obtained or plea of guilty was entered, and the disposition of the case and imposition of sentence and its terms. Sec. 38-3.8. same business location. The certificate application shall state the Place or places within the City of Santa Ana, or elsewhere, where the applicant proposes to establish his office and from which he propos.es to operate. Sec. 38-3.9. Same vehicle encumbrances. The certificate application shall 'contain a statement of whether there are any liens, mortgages, or other encumbrances, including but not limited to conditional sales, contracts, on such ambulances, motorbuses, or.taxicabs and, 'if so, the amount and character thereof and the name of the holder thereof. Sec.'38-3.10. Same -previous licensing'data. 'The certificate appl!cation'shali contain a'.statement of .whether or not said applicant has ever had. any permit, franchise or Certificate of Public Convenience.'and Necessity issued to him that has been suspended or revoked and, if so, circumstances of such suspension or revocation whether in the City of Santa Aha or elsewhere. Sec. 38-3.11. Same - taximeter data. If the'application is for a certifica~ to Operate.'a taxi- 'Cab business, the'application shall state the make and type of 'taximeter intended to be installed on. each taxicab for which such application ismade. ORDINANCE NO. NS-1237 PAGE SEVEN Sec. 38-3.12, Same - proof of safety inspection. The applicant shall include with the certificate application, as to each vehicle for which such application is made, a passenger vehicle inspection check-list from the. Santa Aha Police Department or the California Highway Patrol, indiaating that each such vehicle has been inspected within the previous si~ months and is in safe operating condition. If no such check-li~t was. issued by.the inspecting authority the applicant shall so state in the application and shall state the time and place-of the inspection and whether each such vehicle has an unexpired'safety inspection sticker pursuant to Section 38-39. Sec. 38-3.13. Same , insurance. The certificate application shall include'a policy of insurance in the manner and form required by this :hapte~ from a responsible, 'solvent insurance carrier authorized to ~issue public liability and property damage insurance in the State of California. Sec. 38-3.14. Same number of taxicabs. Where the certificate application is for operation of a taxi- cab business, it shall be accompanied by an agreement that in the event the application is granted, the applicant will keep in operation at all times at least eight (8) taxicabs~ Each application must be for a minimum 6f not less than ~ight (8} taxicabs. Sec. 38-3,15. Same telephone maintenance. Whe.re the certificate application is ~or operation of a taxicab business, it shall be accompanied by an agreement whereby applicant agrees that he will maintain on the premises of his principal place of business, in operating order at all times, one telephone li.nefor every eight {8) taxicabs for which a li- cense has been granted, and that at all times there will be.an operator in charge of said telephone or telephones who shall· de- vote himself exclusively to answering ~aid telephones .and dispatch- · lng taxicabs in response to requests therefor. Sec. 38-3.16. Same - location of vehicles~ The'certificate application shall include a statement that no ambulance, motorbus, or taxicab shall be kept garaged, serviced, "'maintained or repaired on any premises where the zoning chapter of the Santa Ana Municipal Code does not permit~the same. Sec. 38-2.17. Same..- owne~shipdata. ~ The certificate application sh~ll include a statement listing the registered and legal owner of said vehicles and the addresses of either registered and/or legal owner or owners. Sec. 38-3.18. Same - schedule of rates. The Certificate application ~hali';includ'e a scheduie .·rates 'proposed to be charged.· ".- Sec. 38-3.19~ Same - corpo'~ation data,· of If the applicant is a corporation, the certificate applica- tion shall be accompanied by copies o~ the articles of incorpora- tion ~nd by-la~s and of any permits or notifications for the issuance of shares filed with or issued by'the·commissioner'of corporations. ORDINANCE NO. NS-1237 PAGE EIGHT Sec. 38-3.20. Same - additional dnformation. The certificate application Shall contain or be accompanied by such other information as/the Hearing Officer, City Council, City Manager, or Chief.Of Police may deem necessary in all appli- cations or in individual applications for the.~proper protection of the public. SECTION 7: Section 38-8a is added to' the Santa Ana Munici- pal Code to read as follows: Sec. 38-8a, Supplemental certificates· (al Any holder of one or more'certificates of public con- venience and necessity may apply pursuant to this section for supplemental certificates authorizing the operation of not more than seven (7) additional vehicles by the same busi- ness and with the same distinguishing vehicle characteristics as authorized bY the previously issued certificates. (b) An application for supplemental certificate~ brought pursuant to this section shall be filed, processed and de- cided in the same manner as set out in sections 38-3 through 3~-8 with the following exceptions:' (c) · secti {1) The'application'need only contain the information required by section~ 38-3.1, 38-3.4, 28-3.6 and 38-3.20 and, as to the additional vehicles only, the informa-. tion required by sections 38-3.5, 38-3.9, 38-3.12 and .38-3.17. It shall also state the number of vehicles already authorized by certificates previously issued to the holder. (2) The hearing shall not include the determination set forth in subsection (3) of section 38-7. The fit- ness and ability of the applicant shall not be a grounds. · for denial of an application for supplemental certifi- cates brought under this section. (3) The decision'of the hearing officer shall be final and the clerk of the council shall issue certif, icates as determined by the hearing officer, unless an appea1 is taken to the council by any i.nterested person within ten (10) days of the date of the filing' of the hearing officer's report.with the clerk of the council. Any such appeal shall be filed with the clerk of the council, shall-be in writing, and shall state the reasons.for the appeal and the action requested by the appellant to be taken by the council. No holder ~hall file an application pursuant to this on more than once in any calendar year. NS-1237 PAGE NINE The finance director or his designated agent shall maintain a record by vehicle permit number showing the type, make,'passen- get capacity, engine number,, state license number, registered owner, lega) owner, and such other information pertinent to the vehicle bearing the vehicle permit. He shall likewise maintain a listing of each such permit issued classified by the name of the holder of the certificate of convenien'ce and necessity autho- rizing the vehicl~ for hire and by the year in which the license fee is paid. A copy of such listing, or ~ortion thereof, certi- fied as correct by the director of finance, shall be made avail- able upon request to the city council or to any hear.ing officer or interested party at any hearing upon the granting, suspension, or revocation of any certificate of convenience and nec. essity. SECTION 9: Section 38-20a of the Santa A~a Municipal Code .is amended to read as follows: Sec. 38-20 a. Affixing of vehicle permit and device 'evidencing certificate... The finance director or his designated agent shall, at the time he affixes a vehicle permit to the vehicle for hire, also affix a device in the lower right hand corner of the rear window which will indicate that this is a vehicle for which a certifi- cate of convenience and necessity has been granted, provided, however, that he shall not affix such permit or .such device to -.apy vehicle whichdoes not have an unexpired sticker affixed tO' it by the Santa Ana Police Department or the California Highway Patrol evidencing that the vehicle has passed a safety.inspection SECTION ilO: Section 38-38 of the San~a Aha Municipal Code is hereby amended to read as follows: Sec, 38-38. Evidence of Mechanical Condition. (a) Following the issuance of a certificate of convenience and necessity, the holder shall cause each vehicle to which the certificate applies and which is in operating condition tO be inspected pursuant to section 38-39 as often as necessary to have an uQexpired safety inspection sticker continuously affixed to the vehicle.. {b) The chief of police, whenever he has reason to believe that a vehicle to which a certificate applies is in an. un- safe operating condition, whether or not such vehicle has affixed to it an unexpired safety inspection sticker, may, by written notice to the holder of the certificate, require such holder to remove the vehicle from use in the business of soliciting or picking up passengers for hire until such time as the vehicle has passed a new safety inspection. S~C]~ON ll: Section 38-39 of the Santa Aha Municipal Code i$~he~eby amended to read-aU' follows: S~ 38-39. Mechanical ~ondition inspection. (a) A vehicle inspection in satisfaction of the requiCements of section 38-38 shall be an examination of a vehicle to determine that its equipment, including the lights, brakes, ORDINANC£ NO. NS-1237 PAGE TEN Code Code tires and mechanical parts, and any other parts as deemed appropriate by the inspecting authority, are in a good state of repair and free from obvious defects, and to determine that the vehicle will not be dangerously defective in opera- tion. (b) Where the vehicle inspected is an ambulance, particular attention shall be given to determine that the brakes, lights, windshi~d, tires and mechanical parts are maintained in a safe condition, and no such vehicle shall be permitted to operate if any part thereof is defective in any degree which might make the vehicle less safe at high speeds or in quick stops and turns. (c) Any vehicle passing an inspection shall have affixed by the inspecting agency a sticker evidencing that the vehi- cle has been found to be in a safe operating condi'tion and disclosing the expiration date of the sticker. Such expi- ration date shall be determined'by uniform procedure esta- blished by the inspecting authority and shall conform to one of the following standards: (1) It shall be a date six months subsequent to the date of inspection; or (2) ~It shall be a date applicable to al'l vehicles inspected within a period beginning eight months prior to the expiration date and ending two. months prior thereto. (d) The chief of police may enter into arrangements with the California Highway Patrol for the i~spection of vehicles pursuant to the requirements of this section by that agency and may thereafter direct that any or all required inspec- tions be obtained from the California Highway Patrol. He may li. kewise, in his discretion, in order to assure that the inspection standards set forth in this section are met, require any holder to submit any or all vehicles for inspec- tion by the Santa Ana Police Department in lieu of or in addition to any inspection conducted by the California High- way Patrol. SECTION 12: Section 38-.40 of the Santa Aha Municipal is amended to read as follows: Sec. 38-40 Same - enforcement. (a) it shall be a misdemeanor for any person to pick up or to permit any other person to pick up, a passenger for h~re w.ithin the City of Santa Ana in any vehicle for hire which does not have affixed to it an unexpired safety in- spection sticker evidencing that it has been inspected by the Santa Ana Police Department or the California Highway Patrol and found to be in safe operating condition. (b) The chief of polite shall have the power to revoke or suspend a holder's certificate of convenience and neces- sity if the holder is found guilty of violating subsection (a) of this section, or if the holder fails to comply with the provisions of section 38-38 of the Santa Ana Municipal Code after being given ten (10) days written notic'e to so comply. SECTION 13: Section 21-72(41) of the Santa Ana Municipal is amended to read as follows: (41) BUS, TAXI or AMBULANCE, per vehicle 100.00 A (Regulations, Ch. 38) ORDINANCE NO. NS-1237 PAGE ELEVEN SECTION 14: If any section, subsection, sentence, clause phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the valid- ity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 15: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in 'any manner affect the prosecution for viOlation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect th~ validity of any bond or case deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 16: The Clerk of the Council shall certify to the passage and adoption bf this ordinance and shall cause the same to be published in the official newspaper of the City of Santa Ana - within fifteen (15) days after its adoption. SECTION 17: This ordinance shall take effect thirty (30) days from and after the date of its adoption.
