NS-1261 AN ORDINANCE OF THE CItY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTION 5-51 OF THE SANTA ANA MUNICIPAL CODE, DECLARING THE URGENCY THEREOF, AND PROVIDING FOR IMMEDIATE EFFECT PERTAINING TO DOG LICENSING FEES THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: This ordinance is urgently required for the immediate preservation of public peace, health and safety for the reasons that the ordinance (NS-1020) which this ordinance amends required that dog license renewal taxes be paid in ad- vance annually prior to the first day of every July. The Director of Finance must mail dog license renewal notices early in June so that dog license renewal taxes can be paid before the deadline date; such notices have not yet been mailed because this ordinance changes the amount of tax to be levied on dog licenses. Without this ordinance the former ordinance will not effectively protect the health and safety of the citizens of the City. Therefore, the City Council declares that this ordi- nance shall take effect as, and is adopted as, an emergency measure and is to be enforced from the date of its publication. SECTION 2: That Section 5-51(a) of the Santa Ana Municipal Code is hereby amended to read as follows: SECTION 5-51. Taxation - Amount (a) A license tax is levied on all dogs over the age of four (4) months owned, kept, harbored, in the custody of, or under the control of any person within the city. Each license fee shall be paid annually, on the first day of July, to the Director of Finance as provided by Resolution of the City Council. Unless otherwise provided by Resolution the full amount shall be paid for any fraction of the licensing year. The Director of Finance may provide for the renewal of dog licenses by mail. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the vali- dity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sen- tence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconsti- tutional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case deposit in lieu thereof, re- quired to be posted, filed or deposited pursuant to any ordi- nance and all rights and obligations thereunder appertaining shall continue in full force and effect. NS-1261 PAGE TWO SECTION 5: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 6: This ordinance shall take effect upon posting or publication, whichever is earlier. PASSED AND ADOPTED by the City Council of the City of Santa Ana as an emergency measure at its regular meeting held on the 2nd day of June 1975.
