NS- 1275 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING ARTICLE IX, SECTIONS 451 THROUGH 455 TO CHAP- TER 18 OF THE SANTA ANA MUNICIPAL CODE ESTA- BLISHING REQUIREMENTS FOR APPLICATION AND PROCEDURE FOR ISSUANCE OF PERMITS FOR WIPING RAG BUSINESSES. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION l: This ordinance is for the purpose of pre- servation of the public health and safety through regulation of the sanitary condition of wiping rags laundered, sanitized or sold in the City of Santa Ana. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding Article IX, Sections 18-451 through 18-455 to Chapter 18, Health and Sanitation to read as follows: Section 18-451. Definitions. Health Officer shall mean the Orange County Health Officer. 2. Wiping rags shall mean cloths and rags used for any or all of the following purposes: Wiping and cleaning the surfaces of machinery, tools, locomotives, engines, motor cars, auto- mobiles, cars, carriages, windows, furniture, and surfaces of articles, appliances, and engines in factories, shops, steamships, and steamboats. Generally for cleaning in industrial employment. Used by mechanics and workmen for wiping from their hands and bodies soil incident to their employment. Section 18-452. Permit Required. It shall be unlawful for any person to operate any busi- ness of laundering, sanitizing or selling wiping rags in the City of Santa Ana unless, in addition to any other permit or license which may be required, he has a valid permit issued annually by the Health Officer. Section 18-453. Authority of the Health Officer. The Health Officer is hereby authorized to administer and enforce the provisions of the Health and Safety Code of the State of California, and any rules and regulations adopted there- under, pertaining to wiping rags and wiping rag businesses. A permit under this Ordinance shall be issued by the Health Officer if the applicant complies with the provisions of Chapter 4, Part l, Division 5 of the Health and Safety Code and any regulations adopted thereunder. The period of the permit shall be one year from date of issuance. Any permit issued here- under may be suspended or revoked in the manner prescribed in Section 3951 of the Health and Safety Code. ORDINANCE NO. NS-1275 PAGE TWO Section 18-454. Permit Fees. The Health Officer is hereby authorized to collect an annual permit fee of fifty-four dollars ($54.00) from any applicant for a permit under this Ordinance. Section 18-455. Penalty. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor pursuant to Health and Safety Code Section 3960. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Aha hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitu- tional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be con- strued as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder apper- taining shall continue in full force and effect. SECTION 5: The Clerk of the Council shall certify to the passage ~ adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Santa Ana within fifteen (15) days after its adoption. SECTION 6: This ordinance shall take effect thirty (30) days from and after the date of its adoption.
