ORDINANCE NO. NS- 1285
AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING
AMENDMENT APPLICATION NO. 732 FILED BY E. G.
WARMINGTON, REZONING PROPERTY FROM THE Rlt R4
AND LP DISTRICTS TO THE R1-PRD AND R4-PRD
(PLANNED RESIDENTIAL DEVELOPMENT) DISTRICTS,
AND AMENDING SECTIONAL DISTRICT MAP 8-5-9.
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 732,
filed by E. G. Warmington to rezone property generally located
on the east Cabrillo Park Drive, between Wellington Avenue on
the north and Fruit Street on the south, from the R1, R4 and LP
Districts to the R4-PRD District; and
WHEREAS, the Planning Commission by its Resolution No.
6077 has recommended approval of said application subject to the
modification that that portion of the said property presently
zoned in the R1 District be rezoned to the R1-PRD District; and
WHEREAS, the City Council regularly held a public hear-
ing on said reclassification on published notice required by law,
and does now find that the public necessity, convenience and
general welfare require that the said property be reclassified
from the R1, R4 and LP Districts to the R1-PRD and R4-PRD Dis-
tricts, and that the new classification will not be detrimental
to the surrounding property;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property in the City of Santa
Ana, County of Orange, California, described as Parcel 4 of
Parcel Map 918 and Parcel 1 of Parcel Map 919, as shown on maps
recorded in Parcel Map Book 72, pages 13 and 15, in the Office
of the County Recorder, County of Orange, California, is hereby
reclassified from the R1 District to the R1-PRD District and
from the R4 and LP Districts to the R4-PRD District, and that
Sectional District Map 8-5-9 is hereby amended to show said re-
classification, in accordance with Exhibit A.A. 732-B.
SECTION 2: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of com-
petent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance. The City Council
of the City of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one
or more sections, subsections, sentences, clauses, phrases or por-
tions be declared invalid or unconstitutional.
SECTION 3: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating to
the collection of any such license or penalty or the penal provi-
sions applicable to any violation thereof, nor to affect the vali-
dity of any bond or cash deposit in lieu thereof, required to be
posted, filed or deposited pursuant to any ordinance and all rights
and obligations thereunder appertaining shall continue in full
force and effect.

PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its adjourned regular meeting held on the 8th
day of December , 1975.
