AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING DIVISION 2 OF CHAPTER 36 OF
THE SANTA ANA ~93NICIPAL CODE BY REPEALING
ARTICLE VII THEREOF kND ADOPTING AND
ADDING THEIIETO NEW ARTICLES VII AND VII.A
TO ESTABLISH PRI~{A FACIE SPEED LIMITS UPON
CERTAIN STREETS AND PORTIONS OF STREETS
IN THE CITY OF SANTA ANA.
THE CITY COUNCIL OF THE CITY OF SANTA A~;A DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: That Article VII of Division 2, Chapter
36 of the Santa Ana Municipal Code is hereby amended by
repealing said Article (consisting of Sections 36-228 through
36-397, inclusive) in its entirety and adopting and adding to
said Division and Chapter a new Article VII to read as follows:
ARTICLE VII. INCREASED PRI~ FACIE SPEED LIMITS
The City Council of the City of Santa Aha hereby finds
and determines, upon the basis of engineering and traffic sur-
veys made on the dates hereinafter in this Article VII speci-
fied, that a speed greater than 25 miles per hour would facili-
tate the orderly movement of vehicular traffic and would be
reasonable and safe upon the streets and portions of streets
hereinafter specified, which otherwise would be subject to a
prima facie limit of 25 miles per hour, and does hereby deter-
mine and declare prima facie speed limits upon such streets
and portions of streets as are hereinafter respectively speci-
fied. The prima facie speed limits hereinafter specified
shall be effective, respectively, when appropriate signs
giving notice thereof are erected upon the streets and portions
of streets hereinafter specified. The provisions of this
Article shall not apply in respect to any 25 miles per hour
pri~a facie speed limit which is applicable when passing a
school or the grounds thereof. Said prima facie speed limits

SECTION 2: That Division 2, Chapter 36 of the Santa
Ana Municipal Code is hereby amended by adopting and adding
to said Division and Chapter a new Article VII.A. to read as
follows:
ARTICLE VII.A. DECREASED PRI~ FACIE SPEED LIMITS
The City Council of the City of Santa Ana hereby finds
and determines, upon the basis of engineering and traffic sur-
veys made on the dates hereinafter in this Article VII.A speci-
fied, that the prima facie speed limit of 55 miles per hour
is more than is reasonable or safe upon the streets and por-
tions of streets hereinafter specified where the limit of
55 miles per hour is applicable, and does hereby determine
and declare prima facie speed limits upon such streets and
portions of streets as are hereinafter respectively specified,
which said prima facie speed limits are found most appropriate
to facilitate the orderly movement of traffic and are reason-
able and safe. The prima facie speed limits hereinafter
specified shall be effective, respectively, when appropriate
signs giving notice thereof are erect upon the street and
portions of streets hereinafter specified. Said prima facie

SECTION 3: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the
City of Santa Ana hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause, phrase
or portion thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION 4: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were com-
mitted prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.

Santa Ana at its regular meeting held on the 2nd day of
February , 19 76.
