NS-1292 AN ORDINANCE OF THE CITY OF SANTA ANA ~MENDING SECTION 2-742 OF THE SANTA ANA MUNICIPAL CODE TO PROVIDE FOR THE ESTA- BLISHMENT OF RENTAL RATES FOR USE OF THE SANTA ANA MUNICIPAL STADIUM BY COUNCIL RESOLUTION, AND ADDING SECTIONS 2-742.5 AND 31-1.5 TO THE SANTA ANA MUNICIPAL CODE AND AMENDING SECTION 2-743 OF THE SANTA ANA MUNICIPAL CODE, SETTING FORTH THE AUTHORITY OF THE CITY COUNCIL TO PERMIT USE OF THE SANTA ANA MUNICIPAL STADIUM PURSUANT TO CONTRACT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Santa Ana Municipal Code Section 2-742 is hereby amended to read as follows: Sec. 2-742. Rental rates. Rental rates and incidental fees for the use of the Stadium pursuant to permit issued by the recreation and parks department, and the manner of payment thereof, shall be esta- blished by resolution of the City Council. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 2-742.5, which said section reads as follows: Sec. 2-742.5. Use pursuant to contract. The provisions of Sections 2-741 and 2-742 apply only to permits issued by the recreation and parks department. For a series of commercial events, the City Council may permit the use of the stadium pursuant to contract for such periods of time and upon such terms regarding rent, fees, deposits, and time and man- ner of payment as it shall deem appropriate. SECTION 3: That Section 2-743 of the Santa Ana Muni- cipal Code is hereby amended to read as follows: Sec. 2-743. Liquor. No intoxicating liquors shall be sold or consumed upon the premises known as the Santa Ana Municipal Stadium, except pursuant to contract for the use of the stadium approved by the City Council permitting sale and consumption of beer. Any agree- ment between the city and a stadium concessionaire which allows such concessionaire to sell refreshments but prohibits sale of alcoholic beverages shall not prohibit such concessionaire from selling beer when permission for sale and consumption of beer has been granted to a user of the stadium, provided such concession- aire complies with the terms and limitations of the permission granted to such user. SECTION 4: That the Santa Ana Municipal Code is here- by amended by adding a section, to be numbered 31-1.5, which said section reads as follows: Sec. 31-1.5. Santa Ana Municipal Stadium. The provisions of section 31-1 shall not apply to use ORDINANCE NO. NS-1292 PAGE TWO of the Santa Ana Municipal Stadiu~ pursuant to contract approved by the City Council to the extent that such provisions are in- consistent with the terms and conditions of use permitted by such contract. SECTION 5: The City Council of the City of Santa Ana hereby approves and ratifies any agreement previously approved by the City Council providing for use of the stadium which is consistent with the ordinances of the City of Santa Ana as hereby amended. Further, it is the intent of the council that sale of beer and advertising be permitted pursuant to any such contract which permits such uses in the event that the ordinances of the City of Santa Ana are amended to permit such uses. SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsec- tion, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sen- tences, clauses, phrases or portions be declared invalid or unconstitutional.
