HomeMy WebLinkAboutNS-1300RCS:ar 2/11/76 ORDINANCE Ns~i300 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AND ADOPTING A SPECIFIC DEVELOPMENT PLAN FOR THE SENIOR CITIZEN HOUSING PROJECT WHEREAS, the Planning Commission has initiated Amendment Application No. 736 to approve the specific develop- ment plan for the Senior Citizen Housing Project, located between First Street, Ross Street, Birch Street and the North line of former Second Street, and WHEREAS, the Planning Commission has given notice of and duly held a public hearing on Amendment Application No. 736 on January 26, 1976, and considered the plot plans and elevations as the specific development plan for the subject property and has recommended approval of said specific develop- ment plan, and WHEREAS, the City Council regularly held a public hearing on said specific development plan on published notice as required by law, NOW, THEREFORE, the City Council of the City of Santa Aha does ordain as follows: SECTION 1: That the plot plan and elevations, attached hereto as Exhibit A and incorporated by reference herein, are approved and adopted as the Specific Development Plan for the real property located in the City of Santa Ana, County of Orange, State of California, described on Exhibit B, attached hereto and incorporated by reference herein. SECTION 2:If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsec- tion, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses or portions be declared invalid or unconstitutional. SECTIQN 3 : Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which viola- tions were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordin- ance relating to the collection of any such license or penalty nor the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
