NS-1301 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTIONS 41-475, 41-476, 41-477, 41-478, 41-492 and 41-493 OF THE SANTA ANA MUNICIPAL CODE, PERTAINING TO YARD, LAND- SCAPING AND OFF-STREET PARKING REQUIREMENTS IN THE INDUSTRIAL USE DISTRICTS. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES HEREBY ORDAIN AS FOLLOWS: SECTION l: That Section 41-475 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-475. Yards abutting streets. (a) A yard is required along any lot line which abuts a public street which, except as provided in Section 41-476, shall be of an area not less than the length of such lot line in feet multiplied by: (i) twenty (20) feet, if the street is designated in the General Plan of the City as an arterial street; or (ii) ten (10) feet, if the street is not so desig- nated as an arterial street. (b) The yard required by paragraph (a) shall in- clude a strip immediately adjacent to the street and shall be of a width not less than: (i) ten (10) feet, if the street is designated in the General Plan of the City as an arterial street; or (ii) five (5) feet, if the street is not so desig- nated as an arterial street. (c) The area of any one vehicular driveway shall be considered part of the area of any yard required by para- graph (a) to the extent that: (i) the driveway is approximately perpendicular to the street; and (ii) the driveway does not exceed thirty (30) feet in width. (d) Except as provided in paragraph Cc), any yard required by this section shall be landscaped. Signs are per- mitted in such yards provided they are in compliance with the Sign Ordinance of the City of Santa Ana. SECTION 2: That Section 41-476 of the Santa Ana Municipal Code is amended to read as follows: ORDINANCE NO. NS-1501 PAGE TWO Sec. 41-476. Same - reduction of requirements on previously developed streets. The minimum area requirement imposed on any lot by paragraph (a) of Section 41-475 shall be reduced by one-half if seventy-five percent (75%) of the lineal frontage of the side of the street on which the lot is located, measured to the next intersecting cross streets in each direction, has been developed in nonconformity with such requirements. Yard requirements shall be determined separately with res- pect to each street upon which the lot abuts. SECTION 3: That Section 41-477 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-477. Planters abutting interior lot lines. A landscaped planter of a width not less than ten (10) feet is required along any interior lot line to the ex- tent such lot line abuts any property which is neither zoned for industrial uses nor indicated on the General Plan of the City as planned for industrial purposes. SECTION 4: That Section 41-478 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-478. Off-street parking. Off-street parking shall be provided in the manner prescribed in Article IV of this Chapter, except that in any parking area of fifty (50) spaces or more, twenty percent (20%) or less of the required number of parking spaces for warehousing, manufacturing or office uses may be provided in compact car spaces measuring not less than eight (8) feet wide and sixteen (16) feet long. Aisle width between compact car stalls shall be subject to guidelines of the Director of Planning on file in the Planning Department. SECTION 5: That Section 41-492 of the Santa Ana Municipal Code is a~ended to read as follows: Sec. 41-492. Yard and landscape requirements. Yard and landscape requirements are the same as in the M 1 District, as set forth in Sections 41-475, 41-476 and 41-477. SECTION 6: That Section 41-493 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-493. Off-street parking. Off-street parking requirements are the same as in the M 1 District, as set forth in Section 41-478. SECTION 7: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of co~petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. NS-1301 PAGE THREE SECTION 8: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the pro- secution for violation of ordinances, which violations were com- mitted prior to the effective date hereof, nor be construed as affect- ing any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or de- posited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
