NS-1303 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SANTA ANA MUNICIPAL CODE SECTION 34-193 TO INCREASE LOCAL DRAINAGE AREA FEES AND PROVIDE FOR LATER CHANGES THEREIN TO BE MADE BY RESOLUTION OF THE COUNCIL THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 34-193 of the Santa Ana Municipal Code is amended to read as follows: Sec. 34-193. Same--Fees established. The thirteen (13) local drainage areas shall be known, respectively, as "Local Drainage Area No. I" through "Local Drainage Area No. XIII", inclusive. No final subdivision map or final record of survey map shall be approved in any of the local drainage areas until the fee herein- below provided for has been paid in cash or by other and equal consideration as provided for in Section 34-192. The fee to be paid for any land being subdivided or developed in each of the local drainage areas is as set out after the name of said local drainage area hereinbelow. The dollar figure stated for each area is for each gross acre of land, and said figure shall be proportionately reduced, for any fraction of an acre being subdivided or developed, on an exact percentage basis. Same--Fees established. The thirteen (13) local drainage areas shall be known as "Local Drainage Area No. I" through "Local Drainage Area No. XIII". No final subdivision map or final record of survey map shall be approved as to property located in any of the local drainage areas until the fee hereinbelow provided for has been paid in cash or by other and equal consideration as provided in section 34-192. ORDINANCE NO. NS-1303 PAGE TWO The fee to be paid for any land being subdivided or developed in any of the local drainage areas shall be specified by resolu- tion of the City Council, and may be changed from time to time as the cost of construction of said local drainage facilities changes. Said fees shall be stated in any such resolution for each gross acre of land being subdivided or developed, and said figure shall be proportionately reduced, for any fraction of an acre being subdivided or developed on an exact percentage basis. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held tobe invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irres- pective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
