AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 744
FILED BY ELIAS JOHN GARCIA REZONING PRO-
PERTY FROM THE C4 (PLANNED SHOPPING CENTER)
DISTRICT TO THE R 1 (SINGLE-FAMILY RESIDENCE)
DISTRICT AND AFIENDING SECTIONAL DISTRICT MAP

WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 744,
filed by Elias John Garcia to rezone property, generally located
on the north side of McFadden Avenue between Harbor Blvd. and
Newhope Street from the C4 (Planned Shopping Center) District
to the R1 (Single-Family Residence) District, and said Commission
has recommended approval of said application; and
WHEREAS, the City Council regularly held a public hear-
ing on said reclassification on published notice required by law,
and does now find that the public necessity, convenience, and
general welfare require that the said property be reclassified
from the C4 (Planned Shopping Center) District to the R1 (Single-
Family Residence) District, and that such new classification will
not be detrimental to the surrounding property;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property in the City of Santa
Ana, County of Orange, California, described as Parcel 1, as shown
on a map filed in Book 60, Page 26, of Parcel Maps, Records of
Orange County, California, is hereby reclassified from the C4
(Planned Shopping Center) District to the R1 (Single-Family Resi-
dence) District, and that Sectional District Map 16-5-10 is hereby
amended to show said reclassification, in accordance with Exhibit
A.A. 744-A.
SECTION 2: Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the prose-
cution for violation of ordinances, which violations were committed
prior to the effective date hereof, nor be construed as affecting
any of the provisions of such ordinance relating to the collection
of any such license or penalty or the penal provisions applicable
to any violation thereof, nor to affect the validity of any bond or
cash deposit in lieu thereof, required to be posted, filed or depo-
sited pursuant to any ordinance and all rights and obligations there-
under appertaining shall continue in full force and effect.
ADOPTED, this 20th day of September , 1976, by
the following vote:
