GASSER, PAULA GASSER, AND COMMONWEALTH SER- VICE CORP. REZONING PROPERTY FROM THE C1 (COM- MUNITY COMMERICAL) USE DISTRICT TO THE R1 (SINGLE- FAMILY RESIDENCE) USE DISTRICT, AND AMENDING SEC- TIONAL DISTRICT MAP 22-5-10 WHEREAS, the Planning Commission has given notice of and duly held a public hearing on Amendment Application No. 749, filed by Arnold B. Gasser, Paula Gasser, and Commonwealth Service Corp. to rezone property, generally located on the east side of Fairview Street between Borchard and Edinger Avenues from the C1 (Community Commercial) Use District to the (Single-Family Residence) Use Dis- trict, and said Commission has recommended approval of said applica- tion; and WHEREAS, the City Council regularly held a public hear- ing on said reclassification on published notice required by law, and does now find that the public necessity, convenience, and general welfare require that the said property be reclassified from the Cl (Community Commercial) Use District to the R1 (Single-Family Residence) Use District, and that such new classification will not be detrimental to the surrounding property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION l: That the real property in the City of Santa Ana, County of Orange, California, described as all of Parcels 1 and 2 of a map recorded in Book 54, Page 32, of Parcel Maps, County of Orange, California, is hereby reclassified from the C1 (Community Commercial) Use District to the R1 (Single-Family Residence) Use Dis- trict, and that Sectional District Map 22-5-10 is hereby amended to show said reclassification, in accordance with Exhibit A.iA. 749-A. SECTION 2: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be con- strued as affecting any of the provisions of such ordinance re- lating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordi- nance and all rights and obligations thereunder appertaining shall continue in full force and effect. the ADOPTED, this 26th day of O~tober , 1976, by following vote: COUNCILMEN: Ward, Garthe, Ortiz, Yamamoto, AYES: Brandt NOES: COUNCILMEN: None ATTEST: ABSENT: COUNCILMEN: Bricken, Evans CLERK OF THE COUNCIL APPROVED AS TO FORM: KEITH L.
